TENDER-CUM -AUCTION NOTICE

It is hereby notified for the information of the public that the right of collection and removal of standing Elavu, Vatta
and Albezia trees in Achencovil Range of this Division as specified in the Schedule appended below will be sold in
Tender-cum-Auction by the Divisional Forest Officer, Achencovil or any other officer authorized by him on 18-3-2009 at
3 p.m. in the Divisional Forest Office, Achencovil subject to the terms and conditions of sale of Timber in
Government Timber Depots published in Government Gazette No. 50 dated 16-12-2008 vide Page No. 481 to 488 of Forest
Sheet as per Pro. (5)-7698/08 dated 6-12-2008 of the Chief Conservator of Forests (P), Thiruvananthapuram and as per
general conditions of the sale of tree growth prevailing in the department. In case the notified date happens to be a
public holiday the Tender/Sale will be conducted on the next working day at the notified place and time.
2. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu, Vatta and Albezia tree
growth from the above Plantations/Blocks mentioned in the schedule hereto the area of which has been surveyed and
demarcated on the ground.
3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the
produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after
the Tender/Auction will not be entertained.
4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless
valid power of attorney its produced prior to commencement of Auction/Tender.
5. A supply contractor of Achencovil Division or the adjacent Divisions will not be allowed to bid in the Auction/
Tender.

6. Intending Tenderers/Bidders should produce a certificate from the concerned Village Officer showing their
permanent address and duly attesting their signature along with earnest.
7. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control
of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall
result in cancellation of the contract and resale of the coupe at his risk and loss.
8. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer
which is not advantageous by more than 10% of the original offer where the bid amount is Rupees One lakh and above
and more than 20% where the original bid amount is less than One lakh will ordinarily be considered. The post offerer
will comply with following terms.
(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.
(c) The remittance should be made by the chalan or bank deposit and the bank receipt should be produced before
the Divisional Forest Officer concerned within seven days from the date of receipt or registered notice to that
effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the
Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post
offerer satisfied the conditions are auction of the right will be conducted after giving the usual publicity as per rules. In
the re-auction, the price fetched, if does not comes up to what has been offered by the post offerer, it will be awarded to
the post offerer at the amount offered by him. If he backs out the security amount remitted by him will be forfeited to
Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to
the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
9. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a
width of 2 metres and keep the cairns intact.
10. Further particulars can be had either from the office of the Divisional Forest Officer or from the Range Officer
concerned.
11. If the value fetched in the re-sale/re-tender is less than that obtained in the original Tender/sale the difference
between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed
by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through legal means
including Revenue Recovery Act in force.
12. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten Thousand
only) for each coupe for participating in the Tender/Auction.
13. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date.
14. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc., at the rate prevailing from
time to time.
15. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth Rs. 50 after the
completion of the Tender/Auction.
16. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as
possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit
1/3rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security
deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper
worth Rs. 50. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest
Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by
the Divisional Forest Officer subject to the realization of 24 % penal interest. In case of failure to remit the amount within
the extended period further extension for 15 days by the Conservator of Forests and 15 days by the Chief Conservator
of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension
periods mentioned above will be within the original contact period.
17. The balance sale value should be remitted in two equal installments by the successful Tenderers/Bidders. The
first installment should be remitted within 15 days from the date of agreement and the second installment within 30 days
from the date of agreement or within the contract period which ever is earlier. If the successful Tenderers/Bidders fail to
remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by

Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Conservator of
Forests concerned and further extension for 30 days by the Chief Conservator of Forests concerned by realizing penal
interest at 30% shall be granted respectively. But all the above extended periods will be within the original
contract period.
18. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of
contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the
Divisional Forest Officer and the Conservator of Forests concerned may grant extension of time for one month and two
months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:
(a) For enumerated trees and balance unfelled per hectare or fraction thereof —Rs. 750 per hectare.
(b) Un removed registered logs and unregistered logs—Rs. 100 per m3 or fraction thereof.
(c) Un removed firewood—Rs. 50 per M.T. or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or
unremoved during the original contract period. The penalty for the first month shall be realized as the above rates,
double the rate for the second month and three times of the original rate for the third month shall be realized.
If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and
firewood collected by the tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders have
not any right on the produce confiscated to Government. In the above circumstances the balance work to be executed
by the Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be
realized from the Tenderers/Bidders.

The materials collected by thinning teak plantations in Konni/Mannarappara Ranges of Konni Division and stacked
at dumping site shown in the Schedule hereto attached will be sold in Tender/Auction by the undersigned or by any
other officer authorized for the purpose, on the date and time shown in the schedule. The sale condition published by the
Chief Conservator of Forests, Thiruvananthapuram vide Notification No. Pro. (5)-2613/2008 dated 12-6-2008 in the Kerala
Government Gazette No. 26 dated 24-6-2008 and other sale conditions prevalent in the Forest Department are applicable to
this Tender/Auction sale. This Gazette Notification is available in the Website of Forest Department
www.keralaforest.org. & www.keralaforest.gov.in. Any further notification to the sale conditions that may be ordered by
the Government after the publication of this sale notification will also be applicable to the sale. If the notified date of
Tender/Auction declared as a holiday the sale will be conducted on the next working day and if the sale is not possible
on the notification date due to other reasons, the same will be conducted on the alternate date shown in the schedule at
the same place and time without further notification. The intending bidders should satisfy themselves about the quality
and quantity of the materials put up for sale before the commencement of the auction and any complaints whatsoever
will not be entertained after the sale proceedings are over. In case, any Government Department requires any of the
materials, the quantity remaining after their selection only will be auctioned. The quantity that may become ready
for sale after the publication of this notification will also be included in this sale. The Tender/Auction will commence at
time noted in the schedule in the dumping site and will continue till the sale of materials lotted for the day is over.
Tender form can be had from the office of the undersigned till 1 p. m. on the day before the auction date
on payment of Rs. 100 + VAT. The last date and time of receipt of tenders is at 9 a. m. on the auction date.

RE-TENDER NOTICE
No. CA1-3246/2008.
18th February 2009.
The tender for working down Timber and Firewood to the sale Depots from 1935 Rama Varma Teak Plantation in
Pariyaram Range and 1926 Chettikulam Teak Plantation in Vellikulangara Range were called for vide this office Tender
Notice No. CA2-4729/05 dated 4-7-2006. In the tender conducted on 23-8-2006 Sri K.C. Mohammed Iqbal, Kappachalil
House, Mambad College P.O., Malappuram District was the person who quoted the lowest rates. Although the tenders
were confirmed in his name and communicated to him, he did not execute agreement and thus defaulted the tender
conditions. Hence these two works are to be retendered at his risk and loss. In the case of 1926 Teak Plantation
Kannattupadam, eventhough he executed an agreement for the work, he has not taken charge of the plantation and thus
defaulted in carrying out the work. So this work also has to be retendered at the risk and loss.
Therefore sealed competitive tenders are invited separately for each work detailed in the schedule from eligible ‘A’
class forest contractors for working down timber, billets and firewood to the depots mentioned in the schedule.
CONDITIONS
1.
The contractors who have registered under “A” Category should produce Solvency Certificate issued by the
Revenue Department or a Bank Guarantee by a Nationalised Bank under the Bank Guarantee Scheme as below.
A contractor who has defaulted in completing similar works has no right to participate in this tender.
2.
Tender forms can be had from the Divisional Forest Officer, Chalakudy on payment of the cost and VAT shown
in
the
schedule
hereto
on
any
working
day
during
office
hours
upto
1 p. m. on 18-3-2009. The tender forms shall be used only by the person in whose name it is issued and for
the works specified in the schedule given below. Value of tender form will not be refunded.
3.
The tenderers shall fill the tender forms purchased from this office and submit the same together with all the
papers intact. Tender should be addressed in a sealed cover with name of work clearly written thereon, to the
Divisional Forest Officer, Chalakudy so as to reach him in his office at Chalakudy before 3 p. m. on 18-3-2009.
Tenders will be opened at 3.30 p. m. on 18-3-2009.
4.
Tenderers should quote uniform percentage of the departmental basic rate at which they can take up the work
specified in the schedule both in figures and words. Fraction of one percent should not be quoted.
5.
All the correction in the tender forms should be initialed by the tenderer himself.
6.
The EMD of the unsuccessful tenderers will be refunded to them soon after opening of tender.
7.
Sealed tenders will be opened by the Divisional Forest Officer at 3.30 p.m. on the same day in the presence of
such tenderers who elect to be present on the occasion.
8.
If the last date fixed for the receipt of tenders happens to be a holiday, the tenders will be received and opened
on the next working day at the same time and place on the conditions specified above.
9.
Tenders received after the specified date and time, without the requisite enclosures or tender not written up in
proper order or form will be rejected.
10. Each tender should be accompanied by a deposit receipt obtained from an approved Bank in favour of the
Divisional Forest Officer, Chalakudy as Earnest Money Deposit for the work.
11. Further details can be had from the Divisional Forest Officer, Chalakudy or Range Officers, Pariyaram and
Vellikulangara on any working days during office hours. Detailed tender conditions are available in the
Divisional Forest Office, Chalakudy and Range Offices, Pariyaram and Vellikulangara and the tenderers will
peruse and satisfy the conditions before submitting tenders.
Period of Contract —4 (Four) months.
12. If there is no sufficient response for all or any one of the works, tender will be held on 23-3-2009 and if there is
no response on that day also for the remaining work the tender will be held on 27-3-2009 at the same time and
place.
