NOTIFICATION

WHEREAS, the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for the

conservation and management of ecologically fragile lands, minimizing the reduction of degradation of the Eco-System and

Biological Diversity therein.

Now, it is hereby notified for the information of the public that the ownership and possession of the land as per the

details shown in the schedule hereto, in the District of Wayanad has been vested with the Government of Kerala free from

all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguished from

the date of commencement of the Act, i. e. 2nd June 2000.

The publication of the notification is made as required under Section 3(2) of the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg./B1/01/Law dated

3rd May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

Remarks:—Serial Nos. 1 to 14 of the works will be

undertaken at the risk and cost of the previous

Contractor Sri. Thomas Mathai, Puliyirikum

Mukalel, Athirampuzha. In case the tender is

not conducted on the above date it will be on

20-11-2009.

The details and necessary documents will be

obtained from the Office of the Wildlife Warden,

Thiruvananthapuram on any working days till 1 p. m. of

tander date. Tender forms can be obtained by remitting

cash including sale tax with necessary application. The

cost of tender form will not be returned. The terms and

conditions applicable to tender formalities in Kerala

Public Works Department will be applicable to

this works also. Tender forms are not transferable.

G. O. (P.) 84/97/ P&T dated 19-8-1997 related to PWD

tender is also applicable here. The Earnest Money Deposit

will be accepted only as Demand Draft from Nationalised

or Scheduled Bank. The Earnest Money Deposit has to be

pledged in the name of Wildlife Warden,

Thiruvananthapuram and the name of work must be

entered on it. A preliminary agreement in Stamp Paper

worth Rs. 50 in prescribed form should also be submitted

along with the tender. The tender without the preliminary

agreement will be refused. The successful tender is liable

to remit the taxes as per rules. If the tender date becomes

holiday, the tender will be conducted on the next working

day.

It is hereby notified for the information of the public that the right of collection and removal of standing Elavu, Vatta

and Albezia trees in the Match Wood Plantation in Achencovil Range of this Division as specified in the Schedule

appended below will be sold in Tender-cum-Auction by the Divisional Forest Officer, Achencovil or any other Officer

authorized by him on 25-11-2009 at 11 a.m. in the Divisional Forest Office, Achencovil subject to the terms and

conditions of sale of Timber in Government Timber Depots published in Government Gazette No. 50 dated

16-12-2008, Page No. 481 to 488 of Forest Sheet as per Pro. (5)-7698/08 dated 6-12-2008 of the Chief Conservator of Forests

(P), Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the Department. In case

the notified date happens to be a public holiday the Tender/Sale will be conducted on the next working day at the notified

place and time.

Opening of the tender—After the auction of the each Block/Bit.

Alternate date and time—4-12-2009 at 11 a. m.

Period of Contract—60 days from the date of intimation of Confirmation of sale.

Place of Tender/Auction—Divisional Forest Office, Achencovil.

CONDITIONS

1. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu and Vatta tree

growth from the above Plantations/Blocks mentioned in the schedule hereto the area of which has been surveyed and

demarcated on the ground.

2. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the

produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after

the Tender/Auction will not be entertained.

3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless

valid power of attorney is produced prior to commencement of Auction/Tender.

4. A Supply Contractor of Achencovil Division or the adjacent Divisions will not be allowed to bid in the

Auction/Tender.

5. Intending Tenderers/Bidders should produce a Certificate from the concerned Village Officer showing their

permanent address and duly attesting their signature along with Earnest Money Deposit.

6. The successful Tenderers/Bidders should give an undertaking that he is not related to any Officer having control

of the work and that he is not Supply Contractor of this or any adjacent divisions. If this is proved otherwise it shall

result in cancellation of the contract and resale of the coupe at his risk and loss.

7. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer

which is not advantageous by more than 10% of the original offer where the bid amount is Rupees One Lakh and above,

and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered. The post offerer

will comply with following terms :

(a) Offer should be made within Seven days of Tender/Auction failing which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.

before the Divisional Forest Officer concerned within Seven days from the date of receipt of registered notice

to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the

Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post

offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules.

In the re-auction, the price fetched, if does not comes up to what has been offered by the post offerer, it will be awarded

to the post offerer at the amount offered by him. If he backs out the security amount remitted by him will be forfeited

to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded

to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

8. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer

concerned.

9. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten Thousand

only) for each coupe for participating in the Tender/Auction.

Separate tender should be submitted for each block/bit.

10. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date.

If this 35% value

exceeds Rs. 1,00,000, Rs. 1,00,000 will be remit on auction date itself and balance value have to remit in Sub Treasury,

Punalur withm 7 working days through the countersigned chalan issued from this office and submit the

chalan to this office.

11. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from

time to time.

12. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth Rs. 50 after the

completion of the Tender/Auction.

13. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as

possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit

1/3rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security

deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper

worth Rs. 50. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest

Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by

the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within

the extended period further extension for 15 days by the Conservator of Forests and 15 days by the Chief Conservator

of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension

periods mentioned above will be within the original contract period.

14. The balance 2/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders.

The first installment should be remitted within 15 days from the date of agreement and the second installment within

30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders

fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at

12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Conservator

of Forests concerned and further extension for 30 days by the Chief Conservator of Forests concerned by realizing penal

interest at 48% shall be granted respectively. But all the above extended periods will be within the original

contract period.

15. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of

contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the

Divisional Forest Officer and the Conservator of Forests concerned may grant extension of time for one month and two

months respectively on realization of penalty or penalties for completion of each work for each month mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction there of —Rs. 750 per hectare.

(b) Unremoved registered logs and unregistered logs—Rs. 100 per m³ or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or

unremoved during the original contract period. The penalty for the first month shall be realized as the above rates,

double the rate for the second month and three times of the original rate for the third month shall be realized. If the

Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood

collected by the tenderers as per the agreement will be forfeited to Government and the Tenderers/Bidders have not any

right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the

Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from

the Tenderers/Bidders.

16. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a

width of 2 metres and keep the cairns intact.

17. If the value fetched in the re-sale/re-tender is less than that obtained in the original Tender/sale the difference

between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed

by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through legal means

including Revenue Recovery Act in force.

Achencovil on all working days.

Remarks.—If the Tender/Auction could not be conducted on the notified date due to any other reason the

Tender/Auction shall be conducted on 4-12-2009 at 11 a. m. at the same place. In that case tender forms will be issued

till 5 p. m. on 3-12-2009 and the sealed tenders will be accepted till 10 a. m. on 4-12-2009.

25-11-2009 and will be opened by the undersigned or an

officer authorised by him on the same day at 3.30 p. m. in

the presence of the tenderers present. Tenders can be

submitted to the undersigned by registered post also. If

the due date happens to be a holiday, the next working

day will be the due date.

money deposit noted against the work should be paid

along with the tenders by D.D./FDR (Cheque will not be

acceptable) pledged in favour of the undersigned payable

at any nationalised Bank at Marayoor. Incomplete tenders

or tenders without EMD are liable to be rejected. The

undersigned reserves the right to reject any tender without

assigning any reasons thereof. All other conditions

prevailling in the kerala P. W. D. are applicable to this

tender also. If tender does not takes place on 25-11-2009

due to any reasons it will be conducted on 2-12-2009 at

Explanatory Note

The Conservator of Forests, Central Circle, Thrissur

vide Letter No. E1-10242/08, dated 28-3-2009 had

recommended and requested to close down the

Vaniyampara Forest Check post as the same does not

serve any purpose either for strengthening forest

protection or for raising revenue collection as per the
