registration in suitable 'Class' with the PWD, CPWD,

KSEB or KWA for the following civil works.

at F. T. I, Arippa.

PAC—Rs. 10 lakh

EMD—Rs. 25,000

Cost of tender form—Rs. 1,500+VAT.

TOC—3 Months from execution of Agreement

Class of Contractors—'C' Class.

Method of payment by DD from a scheduled

bank in favour of Principal, Kerala Forest School, Arippa

payable at Madathara. Price of tender forms are not

refundable. EMD pledged in the name of Principal,

Kerala Forest School, Arippa should be enclosed with

duly signed tender document.

Tenders without proper EMD or details will be

rejected.

All existing rules and orders regarding tender in

the PWD and KFD will be applicable.

Last date of sale of tender forms from the

Office of Principal, Kerala Forest School, Arippa will be

at 3 p. m. on 1-12-2009.

of Malayattoor Forest Division in silvicultural thinning will be sold in Tender/Auction sale subject to detailed Tender/

Auction sale conditions published in Kerala Gazette No. 50, dated 16-12-2008 in Part III on Pages 481 to 487

(Forest Sheet) by Chief Conservator of Forests (Protection), Thiruvananthapuram vide Notification

No. Pro. (5) 7698/2008 dated 6-12-2008 and other rules in force as per the schedule furnished below. Tender forms

will be available in Divisional Forest Office, Malayattoor and the concerned Range Offices on payment of Rs. 100 +

V.A.T. and Cess and tender will be accepted on the date of tender/re-auction sale upto 9 a.m. at the respective Range

Offices. Tenders received after the stipulated date and time will not be entertained. If the date fixed for Tender/Auction

happens to be a Public Holiday, Harthal or Strike the auction sale will be held on next working day at the scheduled

time and place. Tender will be opened immediately after auction sale and further action will be taken as per sale

conditions. The intending bidders should satisfy themselves about the quantity and quality of the thinned materials put

up for tender/re-auction sale and no complaints will be entertained later on regarding the same.

If there is no bid or

part bid in first date of auction proposed the undisposed materials will be put up for sale in subsequent dates as shown

below at the same time and place. The Auctioning Officer is emprowered to conduct auction completely or partially and

postponement of re-auction without assigning any reason thereof. The successful bidder/tenderer should remit full

bid amount soon after the auction if the bid amount is less than Rs. 20,000 (Twenty thousand). If the bid amount is more

than Rs. 20,000 (Twenty thousand) 35% of the bid amount should be remitted on the date of auction itself subject to a

minimum amount of Rs. 20,000 (Twenty thousand) and maximum of Rs. 1,00,000 (one lakh) by cash or by DD drawn

on a Nationalished Bank. If the 35% of the bid amount exceeds Rs. 1,00,000 (one lakh) balance amount exceeding One

Lakh should be remitted within seven working days from the very next day after the auction.

to be rejected. The Divisional Forest Officer, Nemmara

The successful tenderer should execute the agreement

receipt of work order. If he fails to execute the agreement

departmentally.

of tender forms by cash. The tenderer should execute a

preliminary agreement on Kerala Stamp Paper worth

Rs. 50 along with the tender. Value of the tender forms

once realized will not be refunded at any cost. EMD of

the work should be made through Demand Draft drawn in

any Nationalized Bank or by National Savings Certificates

or by Fixed Deposit Receipt pledged in the name of

Wildlife Warden, Sulthan Bathery payable at

Sulthan Bathery.

Tenders without adequate EMD, incomplete,

defective will be rejected. The undersigned reserves the

right to reject any tender without assigning any reason

thereof. All the rules, regulations, conditions, prevailing

in PWD, Forest Department and Store Purchase

Department will be applicable in this tender also.

If the tender could not be conducted due to any

reason on the above date, the tender should be conducted

on the next working day at the same place and time. If it

It is hereby notified for the information of the public that the right of collection and removal of standing Elavu,

Matty and Sterculia trees in the 1969 Teak and Softwood Plantation, Kannavam (Athirkuzhi 22 Ha), 1969 Teak and

Softwood Plantation Block I (Chikkery Area 50 Ha.) Block II (Peruva Area 33 Ha.) and standing Matty, Elavu trees in

1979 Teak and Softwood Plantation (Mundayod 67.7 Ha) Kannavam Section and 1979 Teak and Softwood Plantation,

Nedumpoyil (Kolappa 60 Ha) of Kannavam Range of this Division as specified in the schedule appended below will be

sold in Tender-cum-Auction by the Divisional Forest Officer, Kannur or any other officers authorized by him on

25-11-2009 at 11 a.m. at the Forest Range Office, Kannavam, subject to the terms and conditions of sale of timber in

Government Timber Depots published in Government Gazette No. 50 dated 16-12-2008, Page No. 481 to 488 of Forest

Sheet as per Pro. (5)-7698/2008 dated 6-12-2008 of the Chief Conservator of Forests (P), Thiruvananthapuram.

Intending Tenderers/Bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten thousand only) for each

Plantation/Block for participating in the Tender/Auction. The successful Tenderers/Bidders have to remit one third of sale

value on the Tender-cum-Auction date. The successful Tenderers/Bidders have to remit the Forest Development Tax, VAT

and Income Tax prevailing in the Department from time to time. In case the notified date happens to be public holiday,

the Tender cum Auction will be conducted on the next working day at the notified place and time. If there is a

requirement of re-auction, it will be conducted on 2-12-2009 at 11 a.m. at the same place.

CONDITIONS

(1)

The auction will be on lumpsum basis for the right of collection and removal of entire Elavu, Matty and

Sterculia tree growth from the above plantations mentioned in the scheduled hereto, the area of which has been surveyed

and demarked on the ground.

(2)

Intending Tenderers/Bidders may inspect the trees and satisfy themselves of the quantity and quality of the

produce before participating in the tender cum auction. Complaints if any, regarding quality and quantity etc. received

after the Tender cum Auction will not be entertained.

(3)

Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another

person unless valid power of attorney is produced prior to the commencement of Tender cum Auction.

(4)

A supply contractor of Kannur Division or any adjacent divisions will not be allowed to bid in the Tender cum

Auction.

(5)

Intending Tenderers/bidders should produce a certificate from the concerned Village Officer showing their

permanent address and duly attesting their signature along with Earnest Money Deposit.

(6)

The Successful Tenderers/Bidders should give an undertaking that he is not related with any officer having

control over the work and that he is not a supply contractor of this or any adjacent Division. If this is proved otherwise,

it shall result in cancellation of the contract and resale of the coupe at his risk and loss of the Contractor.

(7)

No post offer received after 7 days of the conduct of the Tender cum Auction sale and post offer which is

not advantageous by more than 10% of the original offer where the bid amount is Rs. One Lakh and above and more than

20% where the original bid amount is less than one lakh will ordinarily be considered. The post offerer will comply with

following terms.

(a)

Offer should be made within 7 days of Tender cum Auction failing to which the offer will not be

considered.

(b)

Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender cum

Auction date.

(c)

The remittance should be made by the chalan or bank deposit and the Bank receipt should be produced

before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered

notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional

Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer

satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the

re-auction, the price fetched if does not come up to what has been offered by the post offerer, it will be awarded to the

post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to

Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to

the highest Bidders/Tenderers in the re-auction and the amount remitted by the post offerer will be released to him.

Further particulars about the Tender cum Auction can be had either from the Office of the Divisional Forest

Officer or from the Range Officer, Kannavam.

(9)

Intending Tenders/Bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten Thousand

Only) for each Plantation/Block for participating in the Tender/Auction.

The successful Tenderers/Bidders have to remit 1/3rd of sale value on the Tender cum Auction date, failure

to which may result in the forfeiture of the E.M.D. to the Government and the resale of coupe at the risk and loss of the

person concerned.

(11)

The successful Tenderers/Bidders have only the right for the collection and removal of Matty, Elavu and

Sterculia trees as mentioned in the Schedule Appended and will have no right over Teak, Rosewood or such other

unmarked trees.

(12)

The successful Tenderers/Bidders should execute a bounden agreement on a Stamp Paper worth Rs. 50 after

the completion of Tender cum Auction.

(13)

The confirmation of the Tender cum Auction sale will be communicated to the party concerned as early as

possible. Within 15 days from the date of intimation of the confirmation, the successful tenderers/bidders shall remit

the balance of 1/3rd of the sale value and 5% Forest Development Tax, VAT and Income Tax at the rates in force and

security deposit of 10% for the total sale value. The successful tenderers/bidders should execute an agreement on a

Stamp Paper worth Rs. 50. In case of failure to remit the amount within 15 days extension shall be granted by the

Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days

shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to

remit the amount within the extended period further extension for 15 days by the Conservator of Forests and 15 days by

the Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48%

respectively.

The balance 2/3rd sale value should be remitted in two equal installments by the successful tenderers/

bidders. The first installment should be remitted within 15 days from the date of agreement and the second installment

within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful tenderers/

bidders fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal

interest at 12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the

Conservator of Forests concerned and further extension for 30 days by the Chief Conservator of Forests concerned by

realizing penal interest at 48% shall be granted respectively. But all the above extension period will be within the

original contract period. Failure to remit any of the above installment even during the extended period will entail

cancellation of the contract and forfeiture of all money paid till then and all produce remaining in the coupe. The right

thus cancelled will be resold at the risk and loss of the contractor. In calculating interest, 15 days and below will be

reckoned as ½ month and over 15 days as one month.

If the successful tenderers/bidders fails to execute the agreement after remitting the amount even during the

extended period as per the above condition, entire amount paid till then will be forfeited to the Government and all the

produce left unremoved in the coupe will be confiscated to Government after cancelling the Tender cum Auction. The

coupe will be re-auctioned at the risk and loss of the tenderers/bidders. He will be liable for all the loss sustained to the

Government and will have no right over the profit derived out of the re-auction of the coupe.

Failure to remit any of the above installment even during the extended period will entail the cancellation of

the contract and forfeiture of all the money paid till then and confiscation of all the produce remaining in the coupe.

The right thus cancelled will be resold at the risk and loss of the contractor. The contractor will have no right over the

profit derived out of the resale of the coupe.

(17)

The period of contract will be 120 days from the date of intimation of confirmation. No extension of

period of contract shall be granted on ordinary ground. Under special circumstances, for good and sufficient reasons, the

Divisional Forest Officer and the Conservator of Forests and the Chief Conservator of Forests, Northern Region

concerned may grant extension of time for one month, two months and three months respectively on realization of

penalty or penalties for completion of each work for each month mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof —Rs. 750 per hectare.

(b) Unremoved registered logs and unregistered logs—Rs. 100/M3 or fraction thereof

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or

unremoved during the original contract period. The penalty for the first month shall be realized at the above rates,

double the rate for the second month and three times of the original rate for the third month shall be realized.

If the tenderers/bidders fails to remove the entire produce within the above extended period, the whole timber

and firewood collected by the tenderers/bidders as per the agreement will be forfeited to Government and the tenderers/

bidders have not any right on the produce confiscated to Government. In the above circumstances the balance work to

be executed by the tenderers/bidders shall be completed departmentally and all the loss sustained to Government in this

regard shall be realized from the tenderers/bidders.

(18)

Contractor shall be allowed to remove the timber of Mutty, Elave, Sterculia and fire wood from the coupe

subject to the law prevailing in the department from time to time.

(19)

The Contractor or his persons shall be allowed to enter in the coupe only after getting the prior permission

either from the Divisional Forest Officer, Kannur or from the Forest Range Officer, Kannavam.

(20)

The Contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to

a width of 2 Meters and keep the cairns intact.

(21)

The Contractor will be liable for the damages made to other trees in plantations or RF.

(22)

The successful tenderers/bidders may allow to stack the timber in the forest area outside the coupe at the

risk of the tenderers/bidders upto the period of contract. An amount of Rs. 250 will be charged as a ground rent for the

timber unremoved for 1 Hactre or fractions thereof.

(23)

He will be liable for all illegal activities happened 400 Mtr (2 Furlong) surrounding of the coupe. Such

incidents, if noticed by contractor, should be informed the officer concerned, otherwise will lead to the cancellation of

the contract.

(24)

The security deposit will be released to the Contractor on production of clearance certificate of VAT,

Agricultural Income Tax etc. Any liability outstanding will be set off from the security deposit.

(25)

If the value fetched in the re-tender/re-auction is less than that obtained in the original Tender cum Auction,

the difference between them, together with all incidental expenditure to fix up of the resale including notification

charges or any other dues or Government loss as assessed by the Divisional Forest Officer concerned will be recovered

from the defaulting tenderers/bidders through all legal means including Revenue Recovery Act in force.

(26)

General condition of the sale of tree growth prevailing in the department from time to time shall be

applicable to this Tender cum Auction also.

(27)

Only marked trees shall be felled. No unmarked tree shall be felled or damaged while felling a marked tree.
