It is hereby notified for the information of the public that the produces as per the schedule below, collected by Final

felling in 1972 Teak-Elavu Plantation, Kuravanthavalam and 1974 Teak-Elavu Plantation, Kuravanthavalam in Mukkadavu

Section in Pathanapuram Range of this Division will be sold in public tender/auction at the site, time and place mentioned

in the schedule by the Divisional Forest Officer, Punalur or any other officer duly authorized by him subject to the

conditions published in Kerala Gazette No. 50 dated 16-12-2008 by the Chief Conservator of Forests (P.), Vide Letter No.

Pro. (5) 7698/08 dated 6-12-2008.

In case the date of auction happens to be a holiday, the sale will be conducted in the next working day at the same

time and place mentioned in the notification. If the tender/auction could not be conducted on the notified date due to

any other reason or if all the produce put for the tender/auction could not be sold on the above notified date, the same

shall be conducted on 31-12-2009 at the same time and place mentioned in the notification. In addition to the above, the

produce delivered at the dumping depots till the date of tender/auction will also be included in the auction. More details

can be had either from Range Office, Pathanapuram or the office of the undersigned during working hours or in the

Kerala Forest Website www.keralaforest.org.

Tender form can be had from the Forest Range Office, Pathanapuram till 1 p. m. on the day before the auction date

on payment of Rs. 100 + VAT. The last date and time of receipt of tender is at 9 a. m. on the auction date.

It is hereby notified for the information of the public that the right of collection and removal of standing Acacia,

Teak, Eucalyptus and Maruthi trees in the 1995 Eucalyptus Plantation, Karyarakkunnu, Madathara in Anchal Range of

this Division as specified in the schedule appended below will be sold in tender cum Auction by the Divisional Forest

Officer, Punalur or any other officer authorized by him on 26-12-2009 at 11 a. m. in the Divisional Forest Office, Punalur

subject to the terms and conditions of sale of Timber in Government Timber Depots published in Government Gazette

No. 50, dated 16-12-2008 Page No. 481 to 488 of Forest Sheet as per Pro. (5)-7698/08 dated 6-12-2008 of the Chief

Conservator of Forests (P), Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the

department. In case the notified date happens to be a public holiday the Tender/Sale will be conducted on the next

working day at the notified place and time.

The auction will be on lumpsum basis for the right of collection and removal of entire Acacia, Teak, Eucalyptus and

Maruthi trees growth from the above plantations mentioned in the schedule hereto the area of which has

been surveyed and demarcated on the ground.

Contract Period—60 days from the date of intimation of confirmation of sale.

Place of Tender/auction—Divisional Forest Office, Punalur.

Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality

of the produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc.

received after the Tender/Auction will not be entertained.

Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless

valid power of attorney is produced prior to commencement of Auction/Tender.

A supply contractor of Punalur Division or the adjacent divisions will not be allowed to bid in the

Auction/Tender.

Intending Tenderers/ Bidders should produce a certificate from the concerned Village Officer showing their

permanent address and duly attesting their signature along with Earnest Money Deposit.

The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control

of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall

result in cancellation of the contract and resale of the coupe at his risk and loss.

No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer which

is not advantageous by more than 10% of the original offer where the bid amount is Rupees One Lakh and

above and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered.

The post offerer will comply with following terms.

(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be

considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the

Tender/Auction date.

before the Divisional Forest Officer concerned within seven days from the date of receipt of

registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional

Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the

post offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual

publicity as per rules. In the re-auction, the price fetched, if does not comes upto what has been offered by the

post offerer, it will be awarded to the post offerer of the amount offered by him. If he backs out the security

amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been

offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount

remitted by the post offerer will be released to him.

Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer

concerned.

Intending tenderers/bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten Thousand only)

for each coupe for participating in the Tender/Auction.

The successful tenderers/bidders have to remit 35% sale value on the tender/auction date.

The successful tenderers/bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from time to time.

The successful tenderers/bidders should execute a bounded agreement on a Stamp Paper worth Rs. 50

after the completion of the tender/auction.

The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early

as possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall

remit ¹/3rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force

and security deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement

on a Stamp Paper worth Rs. 50. In case of failure to remit the amount within 15 days extension shall be granted by

the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15

days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure

to remit the amount within the extended period further extension for 15 days by the Conservator of Forests and 15 days

by the Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48%

respectively. But all the extension periods mentioned above will be within the original contract period.

The balance ²/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders.

The first installment should be remitted within 15 days from the date of agreement and the second installment

within 30 days from the date of agreement or within the contract period whichever is earlier. If the

successful Tenderers/Bidders fails to remit the above amount within the period mentioned above,

extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned,

extension for 30 days by realizing penal interest at 24% by the Conservator of Forests concerned and further

extension for 30 days by the Chief Conservator of Forests concerned by realizing penal interest at

48% shall be granted respectively. But all the above extended periods will be within the original contract

period.

The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of

contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the

Divisional Forest Officer and the Conservator of Forests concerned may grant extension of time for one month and two

months respectively on realization of penalty or penalties for completion of each work for each month

mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof— Rs. 750 per hectare.

(b) Unremoved registered logs and unregistered logs—Rs. 100/m³ or fraction thereof.

(c)

Unremoved firewood— Rs. 50/Tone or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or

unremoved during the original contract period. The Penalty for the first month shall be realized as the above rates;

double the rate for the second month and three times of the original rate for the third month shall be realized.

If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and

firewood collected by the tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders have

not any right on the produce confiscated to Government. In the above circumstances the balance work to be executed

by the tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized

from the Tenderers/Bidders.

The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of

2 meters and keep the cairns intact.

If the value fetched in the resale/re-tender is less than that obtained in the original tender/sale the difference

between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed

by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through

legal means including Revenue Recovery Act in force.

Remarks:— If the tender/auction could not be conducted on the notified date due to any other reason the

Tender/Auction shall be conducted on 4-1-2010 at 11 a.m. at the same place. In that case tender

forms will be issued till 5 p. m. on 2-1-2010 and the sealed tenders will be accepted till 10 a. m. on 4-1-2010.

for following Civil Work in Kaliyar Forest Range during

2009-10 as shown below :

Kaliyar in Kaliyar Range—Rs. 5,25,000.

Period of Completion— 3 months from the date of

Agreement.

The date of tender is 22-12-2009. The

tender documents can be had from the office of the

undersigned during office hours up to 1 p.m. till

22-12-2009. The tender document, should be properly filled

up and submitted on or before 3 p.m. on 22-12-2009. It

should be accompanied by all necessary documents along

with Earnest Money Deposit in the form of D.D. or Fixed

Depost receipt from Nationalized or Scheduled Bank or

drawn in favour of the undersigned payable at

Kothamangalam. The intending tenderers should execute a

preliminary agreement in a stamp paper worth Rs. 50 along

with tender for the work. Tender not in accordance with

the tender conditions will be rejected. Tender will be

opened by the undersigned or by the officer authorized

by him at 3.30 p.m. on the same day in the presence of

those tenderers who will be present at the time. If the

tender date happens to be a holiday, the tender will be

conducted at the same place and time on the next

working day as per the same conditions stipulated.

If the tender for the work could not be conducted

on the said date, tender for the works would be

conducted at the same place and time without change in

conditions on 29-12-2009 or 6-1-2010 . In such cases,

Sealed competitive tenders are invited from registered

and experienced P. W. D. Contractors for and on behalf of

the Governor of Kerala by the Divisional Forest Officer,

Nemmara for the execution of the following works shown

in the Schedule furnished below. Sealed covers

superscribing the name of work will be opened in the

presence of the available contractors by the Divisional

Forest Officer, Nemmara or any other Officer authorized by

him at the stipulated place and time as shown in the

schedule. The tender forms will be supplied to the

contractors only on production of their Registration Card

and on payment of the cost and VAT of the tender form.

The tender form is not transferable and the cost of the

tender form is non-refundable under any circumstances.

The EMD noted against each works should be paid

along with the tender form by Fixed Deposit Certificates or

DD drawn at any Nationalized Bank at Nemmara in

favour of Divisional Forest Officer, Nemmara. A

Preliminary Agreement in the prescribed format in Kerala

Government Stamp Paper worth Rs. 50 should be attached

with the tender. Incomplete tender or the tender without

the required EMD and Preliminary Agreement are liable to

be rejected. The Divisional Forest Officer, Nemmara

reserves the right to reject any tender without assigning

any reasons. All the rules and regulations regarding

tender in force in PWD and Forest Department are

applicable to this tender also. The Divisional Forest

Officer will be at his liberty to exclude any of the works

mentioned in the Schedule from the tender.

The successful tenderer should execute the agreement

and commence the work within 15 days from the date of

receipt of work order. If he fails to execute the agreement

and to execute the work, the work will be re-tendered at

the risk and loss of the original bidder or execute

departmentally.

Competitive sealed tenders are invited by the

undersigned on behalf of Governor of Kerala in the

prescribed form from eligible contractors registered with

Kerala PWD for following Civil Works in Thamarassery,

Kuttiady and Peruvannamuzhy Forest Ranges during

2009-10. The tender is fixed to be conducted on 22-12-2009.

The tender documents can be purchased from the office

of the undersigned during office hours upto 1 p.m. on

22-12-2009. Cost of tender form is non refundable. The

tender documents should be properly filled up and

should be submitted on or before 2.30 p.m.on 22-12-2009.

It should be accompanied by all necessary documents,

along with Earnest Money Deposit by way of Bankers

DD or Fixed Deposit or National Saving Certificate or any

Approved Certificate drawn in favour of Divisional Forest

Officer, Kozhikode, payable at Kozhikode. The intending

tenderers should furnish a preliminary agreement in Stamp

Paper worth Rs.50 along with tender for each work.

Incomplete tenders, or tenders without necessary

documents or tenders not in accordance with tender

conditions will not be accepted. Tenders will be opened

and scrutinized at 3 p.m. on the same day in the presence

of those tenderers who are present at the time by the

Divisional Forest Officer, Kozhikode or an officer

authorized by him. The Divisional Forest Officer reserves

the right to reject any tender either partly or in full,

without assigning any reason thereof. If the tender date

happens to be a holiday or the tender could not be

conducted on the notified date, due to any other reasons,

the tender will be conducted at the same place and time

on the next working day, as per the same conditions as

detailed below.

If the tender for all works or any of the works could

not be conducted on the said date/dates, tender for such

works will be conducted at the above place and time with

same conditions on 29-12-2009. If tender could not be

conducted even on the date, tender for such works will

be conducted on 5-1-2010 or 12-1-2010, 19-1-2010 or

26-1-2010. Tenders for balance works, if any will be

conducted at the same place and time on 2-2-2010 with

same condition.

Cost of tender forms in respect of works with PAC

from Rs. 5,000 to Rs. 50,000 shall be Rs. 300+VAT and in

respect of works with PAC of Rs. 50,001 to 10 lakhs shall

be Rs.0.20% + VAT of the cost of the work rounded to

the nearest multiple of 100 subject to a minimum of

Rs. 400 + VAT and maximum of Rs. 2,500 + VAT. All

existing rules, regulations, directions etc. prescribed by

Kerala PWD and Forest Department in respect of civil

works shall be applicable for this tender also.
