Whereas the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for the

conservation and management of ecologically fragile lands, minimizing the reduction of degradation of the Eco-System and

Biological Diversity therein.

Now, it is hereby notified for the information of the public that the ownership and possession of the land as per the

details shown in the schedule hereto, in the District of Palakkad has been vested with the Government of Kerala free from

all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguished from

the date of commencement of the Act, i.e. 2nd June 2000.

The publication of the notification is made as required under section 3(2) of the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg. B1/01/Law

dated 3rd May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

It is hereby notified for the general information of the public that Teak Billets collected from the 1950 Teak

Plantation Sankily in Sankily section of Kulathupuzha Range of Thiruvananthapuram Division will be sold in tender/auction

sale as per the details furnished below subject to the detailed Tender/Auction sale conditions published in Kerala Gazette

No. 50 dated 16-12-2008 in Forest Sheet Page No. 481 to 488 by Chief Conservator of Forests (P), Thiruvananthapuram,

vide Notification No. Pro. (5) 7698/08 dated 6-12-2008 and other rules and conditions in force.

Materials for Auction—Teak Billets.

Quantiy—58.20 MT.

Place where stacked—Venkolla Dumping Depot.

EMD—Rs. 20,000.

Place of Auction—Dumping Depot at Venkolla, Kulathupuzha.

Date and time of Auction—17-12-2009, 11 a. m.

Tender forms will be available in Divisional Forest Office, Thiruvananthapuram and Forest Range Office,

Kulathupuzha on payment of Rs. 200+ VAT. Tenders will be accepted till the date fixed for tender/auction sale upto 9 a. m.

in Range Office. Kulathupuzha. Tenders received after the stipulated date and time will not be entertained. If the date for

Tender/Auction happens to be a public holiday, harthal or strike, the auction sale will be held in the next working day at

the scheduled time and place. Tenders will be opened immediaely after the auction sale and further action will be taken as

per sale conditions. The intending bidders should satisfy themselves about the quantity and quality of the materials put

up for tender/auction sale and no complaints will be entertained later on regarding the same. Further details of tender/

auction sale will be available from the Range Office, Kulathupuzha. Materials taken to stock up to the day before auctions

will be included in sale and hence the quantity shown is approximate. If there is no bid or part bid in the 1 st day of

auction, the balance materials will be put up for sale on subsequent dates shown in the schedule at the same time and

place. The Auctioning Officer has discretion to conduct auction completely or partially and to postpone the auction

without assigning any reason thereof.

If the materials could not be sold fully on 17-12-2009 the remaining materials shall be sold in auction on 24-12-2009

at 11 a.m. If again, some more materials are remaining, to be sold that will be sold in auction on 31-12-2009 at 11 a.m.

TENDER CUM AUCTION NOTICE

No. PC1-3382/2009.

1. It is hereby notified for the information of the public that the right of collection and removal of standing

Cashew, Acacia, Albizia and other species trees in the 1984 Cashew-Albizia and 1987 Cashew-Acacia Plantation in

Anchal Range of this Division as specified in the schedule appended below will be sold in Tender Cum Auction by the

Divisional Forest Officer, Punalur or any other Officer authorized by him on 10-12-2009 at 11 a. m. in the Divisional Forest

Office, Punalur subject to the terms and conditions of sale of Timber in Government Timber Depots published in

Government Gazette No. 50, dated 16-12-2008 Page No. 481 to 488 of Forest Sheet as per Pro. (5)-7698/08 dated 6-12-2008

of the Chief Conservator of Forests (P), Thiruvananthapuram and as per general conditions of sale of tree growth

prevailing in the Department. In case the notified date happens to be a public holiday the Tender/Sale will be conducted

on the next working day at the notified place and time.

2. The auction will be on lumpsum basis for the right of collection and removal of entire Cashew, Acacia, Albizia

and other species trees growth from the above plantations mentioned in the schedule hereto the area of which has

been surveyed and demarcated on the ground.

3. Intending tenderers/ bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce

before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the

Tender/Auction will not be entertained.

4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless

valid power of attorney is produced prior to commencement of Auction/Tender.

5. A supply contractor of Punalur Division or the adjacent divisions will not be allowed to bid in the Auction/Tender.

6. Intending Tenderers/ bidders should produce a certificate from the concerned Village Officer showing their permanent

address and duly attesting their signature along with Earnest Money Deposit.

7. The successful Tenderers/Bidders should give an undertaking that he is not related to any Officer having control of the

work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in

cancellation of the contract and resale of the coupe at his risk and loss.

8. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer which

is not advantageous by more than 10% of the original offer where the bid amount is Rs. One Lakh and

above and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered.

The post offerer will comply with following terms.

(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.

(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the

Tender/Auction date.

before the Divisional Forest Officer concerned within seven days from the date of receipt of registered

notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest

Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the

post offerer satisfied the conditions, a re -auction of the right will be conducted after giving the usual publicity as per rules.

In the re-auction, the price fetched, if does not comes up to what has been offered by the post offerer, it will be awarded to

the post offerer at the amount offered by him. If he backs out the security amount remitted by him will be forfeited to Government.

If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest

Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

9. Further particulars can be had either from the office of the Divisional Forest Officer or from the Range Officer concerned.

10. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten Thousand only)

for each coupe for participating in the Tender/Auction.

11. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date.

12. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from time to time.

13. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth Rs. 50 after the

completion of the Tender/Auction.

14. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible.

With in 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3rd of the balance

sale value and 5% Forest Development Tax, V AT and Income Tax at the rate in force and Security Deposit of 10% for the total

sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper worth Rs. 50. In case of failure

to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of

12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer

subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further

extension for 15 days by the Conservator of Forests and 15 days by the Chief Conservator of Forests

shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the

extension periods mentioned above will be within the original contract period.

15. The balance 2/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders.

The first instalment should be remitted within 15 days from the date of agreement and the second instalment

within 30 days from the date of agreement or within the contract period whichever is earlier. If the

successful Tenderers/Bidders fails to remit the above amount within the period mentioned above,

extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned,

extension for 30 days by realizing penal interest at 24% by the Conservator of Forests concerned and further

extension for 30 days by the Chief Conservator of Forests concerned by realizing penal interest at

48% shall be granted respectively. But all the above extended periods will be within the original contract period.

16. The period of contract will be 60 days from the date of intimation of conformation. No extension of period of contract

shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest

Officer and the Conservator of Forests concerned may grant extension of time for one month and two months

respectively on realization of penalty or penalties for completion of each work for each month mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction there of— Rs. 750 per hectare.

(b) Unremoved registered logs and unregistered logs—Rs. 100/m³ or fraction there of.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during

the original contract period. The Penalty for the first month shall be realized as the above rates; double

the rate for the second month and three times of the original rate for the third month shall be realized.

If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and

firewood collected by the tenders as per the agreement will be forfeited to government and the Tenderers/Bidders have not

any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the

Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the

Tenderers/Bidders.

17. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of

2 meters and keep the cairns intact.

18. If the value fetched in the resale/re-tender is less than that obtained in the original tender/sale the difference

between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed

by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through

legal means including Revenue Recovery Act in force.

It is notified for the information of the public that the Teak Poles and other produce collected by final felling from

the various MW Plantations in Achencovil Range of Achencovil Forest Division shall be sold in the public Tender/Auction

on the date, time and places as detailed in the schedule appended below by the Divisional Forest Officer, Achencovil or

any other officer authorized by him.

The Tender/Auction will be conducted subject to the terms and conditions of the auction sale of timber in

Government Depots and as published by the Chief Conservator of Forests (P) Thiruvananthapuram

vide No. Pro. 5-7698/08 dated 6-12-2008 in Kerala Gazette No. 50 dated 6-12-2008 in forest sheet from 481 to 488 and also

as per the existing conditions regarding tender/auction in the Forest Department. Any conditions regarding tender/auction

published by the Department after the publication of this notification will also be applicable to this tender/auction. In case

the notified dates happens to be a public holiday, the sale will be conducted on the next working day at the notified place

and time.

But if the produce could not be sold in full or the tender/auction could not be conducted on that date the produce

will be sold on the date specified in the remarks column of the schedule appended.

Intending Tenderers/bidders are bound to remit KVAT, K.F.D. Tax, Income tax and other Taxes inforce from time to

time. The Government Orders if any regarding the Tender/Auction sale issued after date of this notification will be

applicable for this tender/auction also. The works in the above plantations are in good progress. Hence more quantity of

produce can be presented than the notified quantity in proposed tender/auction.

undersigned or his deputee on the same day at 3.30 p. m.

in the presence of the applicants attending on that date.

If the due date happens to be a holiday, the next working

day will be the due date. Cost of tender form will not be

refunded at any instances.

The tender forms are not transferable. The Earnest

Money Deposit noted against the work should be paid

along with the tender form by Demand Draft (cheques or

fixed deposit receipts will not be acceptable) in favour of

the undersigned payable at any nationalized bank at

Munnar. Incomplete tender or tenders without EMD are

liable to be rejected. The preliminary agreement in stamp

paper worth Rs. 50 should be enclosed with the tender.

The undersigned reserves the right to reject any tender

without assigning any reason. All other conditions

prevailing in the Kerala Public Works Department and

Forest Range Office, Kannavam, Forest Range Office, Kasaragod till 3 p. m. on the previous working day of auction.
