TENDER-CUM-AUCTION NOTICE
No. PA2-98/2010.
22nd January 2010.
1. It is hereby notified for the information of the public that the right of collection and removal of standing Elavu
trees and Bamboo in the 1973 and 1974 Teak-Elavu Plantations in Pathanapuram Range of this Division as specified in
the schedule appended below will be sold in Tender-cum-Auction by the Divisional Forest Officer, Punalur or any other
officer authorized by him on 24-2-2010 at 11 a. m. in the Divisional Forest Office, Punalur subject to the terms and
conditions of sale of Timber in Government Timber Depots published in Government Gazette No. 50 dated 16-12-2008
Page No. 481 to 488 of Forest Sheet as per Pro. (5)-7698/08 dated 6-12-2008 of the Chief Conservator of Forests (P),
Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the Department. In case the
notified date happens to be a public holiday the Tender/Sale will be conducted on the next working day at the notified
place and time.
2. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu trees and
Bamboo from the above Plantations/Blocks mentioned in the schedule hereto the area of which has
been surveyed and demarcated on the ground.
3. Intending tenderers/ bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce
before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the
Tender/Auction will not be entertained.
4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless
valid power of attorney is produced prior to commencement of Auction/Tender.

5. A supply contractor of Punalur Division or the adjacent divisions will not be allowed to bid in the Auction/Tender.
6. Intending Tenderers/ bidders should produce a certificate from the concerned Village Officer showing their permanent
address and duly attesting their signature along with Earnest Money Deposit.
7. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control of the
work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall result in
cancellation of the contract and resale of the coupe at his risk and loss.
8. No petition or post offer received after seven days of the conduct of the Tender/Auction sale and post offer which
is not advantageous by more than 10% of the original offer where the bid amount is Rupees One Lakh and
above, and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered.
The post offerer will comply with following terms:
(a) Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful Tenderers/Bidders on the
Tender/Auction date.
(c) The remittance should be made by the chalan or bank deposit and the bank receipt should be produced
before the Divisional Forest Officer concerned within seven days from the date of receipt of registered
notice to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest
Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the
post offerer satisfied the conditions, a re -auction of the right will be conducted after giving the usual publicity as per rules.
In the re-auction, the price fetched, if does not comes up to what has been offered by the post offerer, it will be awarded to
the post offerer at the amount offered by him. If he backs out the security amount remitted by him will be forfeited to Government.
If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest
Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
9. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer concerned.
10. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of Rs. 10,000 (Rupees Ten Thousand only)
for each coupe for participating in the Tender/Auction.
11. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date.
12. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from time to time.
13. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth Rs. 50 after the
completion of the Tender/Auction.
14. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible.
Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit of the balance
sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and Security Deposit of 10% for the total
sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper worth Rs. 50. In case of failure
to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of
12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer
subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period further
extension for 15 days by the Conservator of Forests and 15 days by the Chief Conservator of Forests
shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the
extension periods mentioned above will be within the original contract period.
15. The balance sale value should be remitted in two equal instalments by the successful Tenderers/Bidders.
The first instalment should be remitted within 15 days from the date of agreement and the second instalment
within 30 days from the date of agreement or within the contract period whichever is earlier. If the
successful Tenderers/Bidders fails to remit the above amount within the period mentioned above,
extension for 15 days by realizing penal interest at 12% by Divisional Forest Officer concerned,
extension for 30 days by realizing penal interest at 24% by the Conservator of Forests concerned and further
extension for 30 days by the Chief Conservator of Forests concerned by realizing penal interest at
48% shall be granted respectively. But all the above extended periods will be within the original contract period.

16. The period of contract will be 60 days from the date of intimation of conformation. No extension of period of contract
shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest
Officer and the Conservator of Forests concerned may grant extension of time for one month and two months
respectively on realization of penalty or penalties for completion of each work for each month mentioned below:
(a) For enumerated trees and balance unfelled per hectare or fraction thereof— Rs. 750 per hectare.
(b) Unremoved registered logs and unregistered logs—Rs. 100/m3 or fraction thereof.
(c) Unremoved firewood— Rs. 50/Tone or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during
the original contract period. The Penalty for the first month shall be realized as the above rates; double
the rate for the second month and three times of the original rate for the third month shall be realized.
If the Tenderers/Bidders fail to remove the entire produce within the above extended period, the whole timber and
firewood collected by the tenders as per the agreement will be forfeited to government and the Tenderers/Bidders have not
any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the
Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the
Tenderers/Bidders.
17. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of
2 meters and keep the cairns intact.
18. If the value fetched in the resale/re-tender is less than that obtained in the original tender/sale the difference
between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed
by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through
legal means including Revenue Recovery Act in force.

officer authorised for the purpose on the same day at
3.30 p. m. at the Office of Divisional Forest Officer, Ranni
in the presence of the contractors attending on the date.
If the due date happens to be a holiday, the next working
day will be the due date.
The tender forms are not transferable. The earnest
money deposit noted against the work should be paid
along with the tenders by Demand Draft (Cheques will not
be acceptable) pledged in favour of the undersigned
payable at any nationalized Bank/Scheduled bank.
Incomplete tenders and tenders without EMD are liable to
be rejected. The undersigned reserves the right to reject
any tender without assigning any reasons thereof and also

tender. All other conditions prevailing in the Kerala PWD
and Forest Department are applicable to this tender. The
tenders not containing the prescribed preliminary

included in this notification, the same will be again
tendered on 25-2-2010, and if no response it will be
tendered again on 4-3-2010, as per the same conditions
mentioned above, at the same time and venue.

Sealed and competitive tenders for the following
works are invited by the undersigned for and on behalf
of the Governor of Kerala from experienced contractors
under government sector. The contractors/ Firms must
have Test Quality Certificate from Bangalore Power
Research Institute or D.G. S. & D. and also have Income
Tax and V.A.T. Registration. Other special terms and
conditions are specified in the tender form. Sealed cover
containing the tender should superscribe the name of
work. Contractors are liable to abide the following
conditions also:
1.
Conditions laid down in Circular No. 4/2009
dated 27-10-2009 of Principal Chief Conservator of
Forests, Thiruvananthapuram are to be followed
scrupulously. Copy of Circular can be had from Divisional
Forest Office, Nilambur South Division.
2.
Contractors who are eligible for exemption from
payment of cost of tender form, E. M. D., Security Deposit
etc., should produce relevent orders of exemptions from
the competent authority. Such exemption shall be given to
the contractors who are using the materials for fencing
produced/manufactured at their own unit itself. No
exemption shall be granted to those who are using the
materials purchased from open market or otherwise.
3.
Contractors are liable to pledge for a guarantee
for 3 years to the installed fence (system whole) and an
A.M.C. (Maintenance Contract) for further 7 years (Total
10 years). For these purpose, contractors are bound to
execute a bond (M.O.U.) with the beneficiary committee
concerned.

obtained from the office of the undersigned on application
in writing on payment of the cost of the tender form
either in cash or in Money Order (not refundable)
upto 1 p.m. on 25-2-2010 and filled up tender form will be
received on the same day upto 3 p.m. The tenders will be
opened by the undersigned or the person authorised for
the purpose on the same day at 3.30 p.m. in the presence
of the tenderers attending that time. In case due to some
or other reasons the proposed tender is not materialised
on the scheduled date on 25-2-2010 such tender will be
conducted at the same time and schedule on 4-3-2010
and such tender will be opened at 3.30 p.m. on the same
day. If the due date happens to be a holiday, the tender
form will be received on the next day upto 1 p.m. and will
be opened on the same day at 3.30 p.m.
Tender forms are not transferable. The EMD should
be paid along with the tender form by Demand Draft
(cheque will not be acceptable) drawn in favour of the
undersigned payable at any nationalised bank at Nilambur.
Incomplete tender or tender without EMD and Preliminary
Agreement are liable to be rejected. The undersigned
reserves the right to reject any tender without arriving
any reasons and changes the estimate amount marginally
thereof. All the special conditions are attached in the
tender form. But it is informed to the information of the
tenderers that minimum they are liable to pledge 3 years
guarantee for the works to be executed and Security
Deposit pledged on behalf of the work will be released
only on completion of the said period of 3 years
(guarantee period) and Contractor/Firm sign a maintenance
contact with the beneficiary committee for 10 years.

(cheque will not be acceptable) drawn in favour of the
undersigned payable at any Nationalised Bank at Nilambur.
Incomplete tender or tender without EMD and preliminary
agreement are liable to be rejected. The undersigned
reserves the right to reject any tender without arraying
any reasons and changes the estimate amount marginally
thereof. All the conditions prevailing in the Kerala PWD

Bhoodhanam dumping depot of Chedleth Range on the
time and date shown in the schedule. Tenders will be
received till 2.30 p. m. on the previous day of the
concerned auction.

The sale will be subject to the sale notification
conditions issued as per Pro (5)-2613/08 dated 12-6-2008 of
the Chief Conservator of Forest (Protection) and
published in Page Nos. 253 to 259 of the Kerala Gazette
No. 26 dated 24-6-2008 and also subject to the
subsequent amendments in the sale conditions issued in
respect of the auction sale to be conducted in the
Government Timber Depots.
If the date notified for the Re-tender cum sale
happens to be a holiday the tender cum auction sale will
be conducted on the next working day at the same place
and time. No bid lots in this auction will be sold on
24-2-2010 at the same place and time.
Post offers will be accepted as per the conditions
specified in the Gazette. Futher details can be had from
this office or from the office of the Forest Range Officer,
Chedleth Range.
