WHEREAS, the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for the

conservation and management of ecologically fragile lands, minimizing the reduction of degradation of the Eco-System and

Biological Diversity therein.

Now, it is hereby notified for the information of the public that the ownership and possession of the land as per

the details shown in the schedule hereto, in the District of Wayanad has been vested with the Government of Kerala free

from all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguished

from the date of commencement of the Act, ie., 2nd June 2000.

The publication of the notification is made as required under Section 3(2) of the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg./B1/01/Law dated

3rd May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

The materials collected by final felling/thinning teak plantations in Konni/Naduvathumoozhy/Mannarappara Ranges

of Konni Forest and stacked at dumping site shown in the schedule hereto attached will be sold in Tender/Auction by

the undersigned or by any other officer authorized for the purpose, on the date and time shown in the schedule.

The

sale condition published by the Chief Conservator of Forests, Thiruvananthapuram vide Notification No. Pro. (5)-6835/2009

dated 2-12-2009 in the Kerala Govt. Gazette No. 54 dated 22-12-2009 and other sale conditions prevalent in the Forest

Department are applicable to this Tender/Auction sale.

This Gazette notification is available in the website of

Forest Department www.keralaforest.org and www.keralaforest.gov.in.

Any further notification to the sale conditions

that may be ordered by the Government after the publication of this sale notification will also be applicable to the

sale.

If the notified date of Tender/Auction declared as a holiday the sale will be conducted on the next working day and

if the sale is not possible on the notification date due to other reasons, the same will be conducted on the alternate date

shown below at the same place and time without further notification.

The intending bidders should satisfy

themselves about the quality and quantity of the materials put up for sale before the commencement of the auction and

any complaints whatsoever will not be entertained after the sale proceedings are over.

In case, any Government

Department requires any of the materials, the quantity remaining after their selection only will be auctioned.

The

quantity that may become ready for sale after the publication of this notification will also be included in this sale.

The

tender/auction will commence at the time noted in the schedule in the dumping site and will continue till the sale of

materials lotted for the day is over.

Tender form can be had from the office of the undersigned till 1 p.m. on the day before the auction date on

payment of Rs. 200 + VAT.

The last date and time of receipt of tender is at 9 a.m. on the auction date.

SANDAL DIVISION, MARAYOOR

TENDER-CUM-AUCTION NOTICE

No. MDE-2638/2010.

23rd July 2010.

Sealed tenders are invited for the sale of the

vehicles which are listed in details hereunder. These

vehicles were seized under Section 52 (1) and being

Proceeded under Section 61 A of Kerala Forest Act,

1961. The Vehicle in Sl. No. 9, was previously bid by

Sri Jainalabdeen, J. K. Iron and Steel 189/2, 3, 8, 9,

10,11, Near Masjid, Diara Street, Palakkad and he failed

to remit all the dues in time. The vehicle will be sold

at the risk and loss of Sri Jainalabdeen. The tender cum-

auction will be conducted on 3rd September, 2010 at

2 p. m. in accordance with the Judgment of Honourable

High Court of Kerala in MACA 1458/2006 dated

2-12-2008 and the direction from Government of Kerala

in Circular No. 89584/G3/08/Home dated 5-1-2009. The

Divisional Forest Officer, Marayoor or the Officer

authorized by him will conduct the tender-cum-auction

at the Office of the Divisional Forest Officer, Sandal

Division, Marayoor. The highest rate quoted in the

tender-cum-auction will be confirmed in the name of

the bidder in accordance with Government order

G. O. (Rt.) No. 92/2009/F&WLD dated 25-2-2009.

If the prescribed date fixed for tender-cum-auction

will be a holiday, tender-cum-auction will be conducted

on the next working day. If nobody participates in the

tender-cum-auction fixed on 3-9-2010, or if any of the

vehicles could not be sold on the tender-cum-auction day,

the tender-cum-auction will be conducted again on

14-9-2010, 2 p. m. as per the same conditions, venue,

isssuance and accepting time of tenders etc. Tender

forms will be issued from this office upto 12 noon of

the tender-cum-auction day and it will be received back

upto 1 p. m. on the tender-cum-auction day. More

details of the tender-cum-auction can be had from

Divisional Forest Office, Marayoor and Range Office,

Marayoor/Kanthalloor during working hours.

EMD—Rs. 10,000.

Value of tender form—Rs. 200 + 4% VAT (for each

vehicle).

Last date and time fixed for sale of tender forms—

3-9-2010 at 12 noon.

Last date and time for acceptance of tender forms—

3-9-2010 at 1 p. m.

Date and time of tender-cum-auction—3-9-2010 at

2 p. m.

CONDITIONS

Those who intend to take part in the tender-

cum-auction can inspect and verify the present

condition of the vehicle in the presence of the

Range Officer, Marayoor. The complaints which

are brought forward after the tender-cum-auction

will not be entertained.

Those who need the tender forms should apply

along with the attested copy of the Identity Card

issued by the Election Commission or Driving

license or a PAN Card or Certificate obtained

from concerned Village Officer, for proving

identity and correct address duly verified with

the original in the office of Divisional Forest

Officer, Marayoor Division.

The prescribed EMD is to be paid at the

Divisional Forest Office, Marayoor before the

commencement of the tender-cum-auction. The

EMD of the bidders, except those of the highest

bidders, will be returned then and there.

If the tender amount is more than EMD, either

50% of the tender amount or Rs. 10,000 (ten

thousand only), whichever is higher (including

EMD), should be remitted on the spot.

The Divisional Forest Officer, Marayoor will be

the sole authority in accepting or rejecting the

tenders with sufficient reasons raised to the best

interest of the Government.

Once there is a notice that the highest bid has

been approved, the balance amount and the

legally payable taxes should be paid by the

highest bidder and the vehicle should be taken

away within 15 days.

In case the due amount are not remitted and

vehicle is not taken away within 15 days,

another 15 days will be allowed on the request

of the highest bidder on payment of 12% penal

interest for the balance anount along with a

ground rent of Rupees twenty per day.

Further

prolongation of the payment will not be

allowed.

The vehicle in this case will be

re-auctioned on his own risk and loss and the

payment already made by the defaulter will be

forfeited to Government.

The insurance of the vehicle by himself should

be ensured by the highest bidder soon after the

delivery of the vehicle from the premises of

Government Sandal Depot, Marayoor.

contractors. Tender documents can be purchased during

office hours from the office of the Divisional Forest

Officer, Timber Sales Division, Kozhikode-28 up to

1 p. m. on the last date fixed for receipt of tender, on

application in writing and on payment of the value of

documents (not transferable) either in cash or by money

order. This amount will not be refunded. Tenders will be

opened at 3 p. m. on the last date of receipt of tender

i. e. on 31-8-2010. If the date mentioned above happens to

be a holiday declared by the Government, the receipt of

the tender and opening of the tender will be on the next

working day. In any case if tender cannot be accepted or

opened in this day it will be again conducted on 7-9-2010.

All conditions stipulated for Kerala P. W. D. works

and Kerala Forest Department works are applicable to this

works also. EMD in the normal course should be

pledged in favour of the Divisional Forest Officer, Timber

Sales Division, Kozhikode and name of work should be

superscribed on the cover of tender. Tenders lacking the

above will be rejected.

The above said estimate amount is only approximate.

Actual amount shall be furnished in the tender form. The

work will be minimized due to paucity of funds.

If the tender could not be conducted due to any

technical or unexpected reasons on the above date

tenders for the above works will be conducted on

9-9-2010 at the same time. If the tender could not

be conducted due to any technical or unexpected

reasons on the above date also, tenders for the above

works will be conducted on 14-9-2010 at the same time.

Tender forms can be had from the office of the

undersigned on direct remittance of cost of tender

form or in through money order along with the

Registration Cards. Value of the forms once realized

will not be refunded at any cost. EMD for the work

should be made through Demand Draft drawn from

any nationalized bank in favour of the Divisional

Forest Officer, South Wayanad Division, Kalpetta and

payable at Kalpetta. Tenders without adequate EMD,

incomplete, defective or belated tenders will be

summarily rejected. The undersigned reserves the

right to reject any tender without assigning any reason

thereof. The Co-operative societies, rendering the

tenders should produce true copies of relevant orders

exempting them from remittance of EMD/security

along with the tenders if any. Otherwise they will have

to remit EMD/ security applicable.

Each and every tender should accompany

preliminary agreement in stamp paper worth Rs. 100

(Rupees one hundred only) duly signed by the

Sealed competitive tenders in the prescribed form

are invited till 3 p. m. on 19-8-2010 from approved

contractors for the following works by the Wildlife

Warden, Aralam Wildlife Division for and on behalf of

the Governor of Kerala. Tender form can be had from

the office of the undersigned till 1 p. m. on the date of

tender on payment of the cost of tender doucuments

along with a request in writing. The last date and time of

receipt of tender in sealed cover superscribing the name

of the work is at 3 p. m. on the tender date. The tender

will be opened at 3.30 p. m. in the presence of the

bidders present on that date. In case the tender is not

happened on 19-8-2010, it will be conducted on

26-8-2010. If it is also not happened on 26-8-2010, it

will be conducted on 2-9-2010 and if it is not happened

on 2-9-2010, it will be conducted on 8-9-2010. If the

tender could not happen on the fixed date due to reasons

beyond our control like public holiday, Hartal etc., the

tender will be take place in the next working day at the same

time and place.

conditions prevailing in Kerala Public Works Department

and Forest Department will be applicable to this work

also.

Tender forms are not transferable.

Tender should

be submitted along with a preliminary agreement signed

and executed in Kerala Government Stamp paper worth

Rs. 100.

Incomplete tender/tenders and without EMD or

tender received after the stipulated time are liable to be

rejected.

The undersigned reserves the right to reject

any tender without assigning any reason thereof.
