The following draft of the Kerala Rural Employment Guarantee Fund

(Amendment) Rules, 2010, which the Government of Kerala propose to make in

exercise of the powers conferred by section 32 of the Mahatma Gandhi National

Rural Employment Guarantee Act, 2005 (Central Act 42 of 2005) to amend the

Kerala State Employment Guarantee Fund Rules, 2009 issued by notification

under G. O. (P) No. 138/2009/LSGD dated 20th July, 2009 and published as

S. R. O. No. 624/2009 in the Kerala Gazette Extraordinary No. 1312 dated

20th July, 2009 is hereby published as required by sub-section (1) of the said

section.

Notice is hereby given that the draft rules will be taken up for

consideration after the expiry of a period of 30 days from the date of publication

of this notification in the Gazette and that objections or suggestions, if any, in

respect of the said draft Rules, which may be received from any person, within

the period referred above, will be considered by the Government. Objections or

suggestions, if any, shall be addressed to Additional Chief Secretary to

Government, Local Self Government (DD) Department, Secretariat Annexe,

Thiruvananthapuram.

DRAFT RULES

1.

Short title and commencement.—(1) These rules may be called the

Kerala Rural Employment Guarantee Fund (Amendment) Rules, 2010.

They shall come into force at once.

2.

Amendment of the Rules.—In the Kerala State Employment Guarantee

Fund Rules, 2009,—

(1)

in rule, 1, for sub-rule (1) the following sub-rule shall be

substituted, namely:—

“(1)

These rules may be called the Mahatma Gandhi National Rural

Employment Guarantee Fund Rules, Kerala, 2009.”;

(2)

in rule 2, in sub-rule (1),—

(i)

for clause (b), the following clause shall be substituted,

namely:—

“(b)

“State Fund” means the Mahatma Gandhi National Rural

Employment Guarantee Fund, Kerala established under sub-section (1) of section

21 of the Act.”;

(ii)

for clause (c), the following clause shall be substituted,

namely:—

“(c)

“Management Committee” means the Management Committee

of the Mahatma Gandhi National Rural Employment Guarantee Fund Society,

Kerala, constituted under rule 4.”;

(iii)

after clause (h), the following clause shall be inserted,

namely:—

“(i)

“Fund Society” means the Mahatma Gandhi National Rural

Employment Guarantee Fund Society, Kerala, constituted by the State

Government under rule 4.”;

(3)

for rule 4, the following rule shall be substituted, namely:—

“4.

Constitution of the Mahatma Gandhi National Rural Employment

Guarantee Fund Society, Kerala:-

For the management and administration of the

State Fund and to strengthen the present fund system, a Fund Society registered

under the Travancore-Cochin Literary, Scientific and Charitable Societies

Registration Act, 1955 (Act 12 of 1955) shall function and a Management

Committee consisting of the following officials shall be constituted, namely:—

(i)

Additional Chief Secretary, Local Self Government Department—

Chairperson.

(ii)

Commissioner for Rural Development—Member Secretary.

(iii)

Director of Panchayats—Member.

(iv)

Senior Finance Officer of the Commissionerate of Rural

Development—Member.

(v)

State Performance Audit Officer—Member.

(vi)

Mission Director, Mahatma Gandhi National Rural Employment

Guarantee Scheme—Member”;

(4)

in rule 15, for the words “and any other expenditure of the State

Council”, the words “and expenditure of the State Council except the routine day

to day administrative expenses of the State Council” shall be substituted.

(5)

for the words “the National Rural Employment Guarantee”

wherever they occur, the words “the Mahatma Gandhi National Rural Employment

Guarantee” shall be substituted.
