No. SVC (1) 46306/1994.

3rd January 2012.

The Principal Agricultural Officer, Wayanad has

reported in his letters No. E(1) 4592/93 dated 5-7-1995 and

17-10-1995 that she, Smt. Anitha John, the then Agricultural

Officer, Krishi Bhavan, Thariyode, had left the office on

19-8-1993 after applying for 43 days leave without

allowance on Medical ground and in continuation to that

applied again for 5 years Leave Without Allowance with

effect from 1-10-1993 to join husband abroad. The leave

could not be sanctioned for want of rectification of certain

defects in her leave application. The communications sent

to her in this regard were returned undelivered stating that

she had left India.

Her action in leaving the office and absenting

from duty unauthorizedly and without getting the

leave sanctioned was violation of condition No. 9 of

Appendix-XII A Part I, KSR’s.

Her above action amounts to serious dereliction

of duty, indifferent and irresponsibility in discharging her

official duties which warrants disciplinary action against

her as contemplated under Rule-15 of KCS (CC & A)

Rules, 1960 and condition No. 9 of Appendix-XII A, Part I,

KSRs, and Para-53 of Manual for disciplinary proceedings.

In the circumstances disciplinary action was

initiated against Smt. Anitha John for unauthorised

absence with effect from 19-8-1993. The Memo of charges

communicated to her in the last known address, as per 2^nd

paper read above was returned undelivered by the postal

authorities stating that “she had left India”. Hence the

Memo of charges and Statement of allegations were

published in the media as per 3^rd paper read above and

she had allowed 15 days to submit her statement of

defence from the publication of the memo of charges. But

she had not responded yet. Hence it was decided to

proceed further in the matter on the presumption that she

has no explanations to offer. Hence an enquiry in the

matter was necessitated as per rule 15 of KCS (CC & A)

Rule-1960.

In the above circumstances, Smt. K. Remadevi,

Administrative Officer of the Directorate of Agriculture was

appointed as the Enquiry Officer as per Order No. SVC (6)

46304/94 dated 6-8-1998 of the Director of Agriculture,

Thiruvananthapuram-33.

The Enquiry Officer conducted a detailed

investigation in the matter. The first sitting was fixed on

13-10-1998 at the Office of the Principal Agricultural

Officer, Wayanad. The Enquiry Notice issued to her was

returned by the Postal authorities stating that “Addressee

left India”.

Another chance was given to her to attend the

enquiry at the chamber of the Senior Administrative Officer

at Vikas Bhavan, on 16-11-1998. Registered Notice issued

to this regard was also returned by the Postal Authorities

repeating the remarks “addressee left India”.

Therefore all the connected records collected

and verified in detail.

It is seen that while applying for leave without

allowance on Medical Certificate from 5-7-1993, 20-7-1993

and 20-8-1993, she had also applied for leave without

allowance for 5 years with effect from 1-7-1993 on personal

ground. This was also not sanctioned. When she was

asked by the Principal Agricultural Officer, Wayanad, as

per Lr. No. E(1) 3801/92 dated 4-8-1993 to clarify whether

she left India without getting the leave sanctioned, she

submitted revised applications for Leave Without

Allowance with effect from 1-10-1993 to join spouse

abroad. From all the above, it is clear that the leave

applied from 5-7-1993, 20-7-1993 and 20-8-1993 was on

false ground and her intention was to go abroad without

getting the leave sanctioned, i.e., from 5-7-1993 itself.

Enquiry Officer finalized the report that

Smt. Anitha John, left India unauthorizedly with effect

from 19-8-1993 and hence to proceed with the Disciplinary

action taken against her as per rules.

In the above circumstances, it was provisionally

decided to remove her from service vide Rule-II (i) (vii) and

as per the procedure laid down under Rule 15 of KCS

(CC & A) 1960 and G.O. (P) No. 209/84/Fin. dated

12-4-1984 and Appendix XII-A, Part-1, KSRs with effect

from the date of unauthorised absence.

She was served with a Show cause Notice

along with copy of Enquiry Report as to why the above

provisional decision should not be confirmed. She was

allowed 15 days from the date of receipt of the

communication to submit her written explanation to this

office under registered post with acknowledgement. If the

explanation is not received within the stipulated time, the

matter will be preceeded on the presumption that she had

no explanation to offer.

The Show cause Notice was published in the

Hindu daily dated 27^th July 2000.

14.

The explanation submitted by her letter vide 8^th

paper read above to the Show cause Notice was not

satisfactory and not acceptable.

In the above circumstances, and as per rule 15 of

KCS (CC & A) Rules 1960, Appendix XII-A, of Part-1,

KSRs and Rule-II (i) (vii) of, KCS (CC & A) Rule 1960 and

Rule-24 of KSR, Smt. Anitha John, formerly Agricultural

Officer, Krishi Bhavan, Thariyode, Wayanad District is

removed from service with effect from 19-8-1993 ie, the

date in which she was unauthorisedly absented from duty.
