    Kerala Gazette

[Part III

Kochi.

Registrar (Subordinate Judiciary).

Notification

No. A1-19864/2005.

9th March 2012.

In exercise of the powers conferred by Article 229 of

the Constitution of India, the Honourable the Acting Chief

Justice hereby makes the following amendments to the

Kerala High Court Service Rules, 2007, namely:

Amendment

(C. S. No. 18)

In the Rules,

The following shall be incorporated as sub-rule (3)

of rule 37;

Subject to Rule 37(2) of these rules, prior service of a

member of the service, in the Government of Kerala or the

Central Government or a Local Self-Government Insitution

or a University coming within Rule 20 of Kerala Service

Rules, Part III will be reckoned for pensionary benefits and

for counting weightage of service consequent on revision

of pay and allowances or otherwise as applicable to the

officers under the Government of Kerala.

The above amendment shall be deemed to have come

into force retrospectively with effect from 1-1-2007.

By order,

A. Hariprasad,

Kochi.

Registrar (Subordinate Judiciary)

(Registrar General in-charge).

Explanatory Note

(This note does not form part of this amendment but

is intended to indicate its general purport).

The Kerala High Court Service Rules, 2007 do not

contain specific provision enabling the employees of the

High Court to reckon their prior service in the Government

of Kerala or the Central Government or a Local Self-

Government institution or a University coming within Rule

20 of Kerala Service Rules, part III for pensionary benefits

and for counting weightage of service consequent or

revision of pay and allowances or otherwise as applicable

to the officers under the Government of Kerala. There

have been doubts from various quarters as to whether prior

service in other departments could be counted for service

weightage in the High Court Service. Having considered

the matter in detail, the Honourable Acting Chief Justice

is pleased to incoporate specific provisions to that effect

subject to the orders issued by the Government of Kerala

in this regard. Hence, the amendment.
