TENDER/AUCTION NOTICE

It is notified for the information of the public that the Teak Poles, Teak Billet and Jungle Wood, Fire Wood collected

by clear felling from 1968 MW Plantation Savakkotta Bit-II in Thulumala Section of Kallar Range of Achencovil Forest

Division shall be sold in the public tender/auction on the date, time and places as detailed below by the Divisional

Forest Officer, Achencovil or any other officer authorized by him.

The Tender/Auction will be conducted subject to the terms and conditions of the auction sale of timber in

Government Depots and as published by the Chief Conservator of Forests (P), Thiruvananthapuram vide

No. Pro. (5)-6835/2009 dated 2-12-2009 in Kerala Gazette No. 50, dated 22-12-2009 in Forest Sheet from 669 to 675 and also

as per the existing conditions regarding tender/auction in the Forest Department. Any conditions regarding the Tender/

Auction published by the Department after the publication of this notification will also be applicable to this Tender/Auction.

In case the notified date happens to be a public holiday, the sale will be conducted on the next working day at the

notified place and time.

But if the produce could not be sold in full or the Tender/Auction could not be conducted on that date the produce

will be sold on the date specified below.

Intending tenderers/bidders are bound to remit KVAT, K.F.D. Tax, Income Tax and other Taxes in force from time to

time. The Government Orders if any regarding the Tender/Auction sale issued after date of this notification will be

applicable for this Tender/Auction also. The works in the above plantations are in good progress. Hence more quantity

of produce can be presented than the notified quantity in proposed Tender/Auction.

hours on all working days.

It is hereby notified for the information of the public

that the right of collection and removal of standing

Rubber trees and Coconut trees standing in 6.475 Ha

forest land at Perunthenaruvi in Karikulam Forest Station

Ranni Range of this division which is diverted to KSEB

for there Perunthenaruvi Hydro Electric Project as

specified in the schedule appended below will be sold in

Tender-cum-Auction by the Divisional Forest Officer,

Ranni or any other officer authorized by him on 12-4-2012

at 11 a. m. in the Divisional Forest Office, Ranni subject

to the terms and conditions of sale of timber in

Government Timber Depots published in Government

Gazette No. 50 dated 16-12-2008 Page No. 481 to 488 of

Forest sheet as per Pro (5)-7698/08 dated 6-12-2008 of the

Chief Conservator of Forests (P), Thiruvananthapuram

and as per general conditions of the sale of tree growth

prevailing in the department. In case the notified date

happens to be a public holiday the tender/sale will be

intimation of Confirmation of sale.

Intending tenderers/ bidders may inspect the

trees and satisfy themselves of the quantity and quality

of the produce before participating in the tender/auction.

Complaints if any regarding quality and quantity etc.

received after the tender/auction will not be entertained.

Bidder should appear for the auction in person

and nobody will be permitted to bid on behalf of another

unless valid power of attorney is produced prior to

commencement of auction/tender.

A supply contractor of Ranni Division or the

adjacent divisions will not be allowed to bid in the

auction/tender.

Intending tenderers/bidders should produce their

identification proof before participating tender/auction.

The successful tenderers/bidders should give an

undertaking that he is not related to any officer having

control of the work and that he is not supply contractor

of this or any adjacent divisions. If this is proved

otherwise it shall result in cancellation of the contract and

resale of the coupe at his risk and loss.

No petition or post offer received after seven

days of the conduct of the tender/auction sale and post

offer which is not advantageous by more than 10% of the

original offer where the bid amount is one lakh and

above, and more than 20% where the original bid amount

is less than one lakh will ordinarily be considered. The

post offerer will comply with following terms:

(a)

Offer should be made within seven days of

tender/auction failing which the offer will

not be considered.

(b)

Offerer should remit double the amount paid

by the successful tenderers/bidders on the

tender/auction date.

(c)

The remittance should be made by the

chalan or bank deposit and the bank receipt

should be produced before the Divisional

Forest Officer concerned within seven days

from the date of receipt of registered notice

to that effect.

The post offerer after satisfying the conditions

specified above should execute an agreement before the

Divisional Forest Officer concerned, pledging the security

deposit for the due fulfillment of the above terms. If the

post offerer satisfied the conditions, a re-auction of the

right will be conducted after giving the usual publicity as

per rules. In the re-auction, the price fetched, if does not

comes up to what has been offered by the post offerer, it

will be awarded to the post offerer at the amount offered

by him. If he backs out the security amount remitted by

him will be forfeited to Government. If however, the bid

amount is above what has been offered by the post

offerer, the right will be awarded to the highest bidder/

tenderer in the re-auction and the amount remitted by the

post offerer will be released to him.

Further particulars can be had either from the

office of the Divisional Forest Officer or from the Range

Officer concerned.

Intending tenderers/bidders should deposit

an Earnest Money Deposit of 10,000 (Rupees

Ten Thousand only) for participating in the tender/auction.

The successful tenderers/bidders have to remit

35% sale value on the tender/auction date. If this 35%

value exceeds 1,00,000, 1,00,000 will be remit on auction

date itself and balance value have to remit in Sub

Treasury, Ranni within 7 working days through the

countersigned chalan issued from this office and submit

the chalan to this office. If failed to remit this amount,

the EMD will be forfeited to Govt. and the coupe will be

resaled at his risk and loss.

10. If the value fetched in the resale/re-tender is less

than that obtained in the original tender/sale the

difference between them together with all incidental

expenditure to fixing up of the resale including notification

charges as assessed by the Divisional Forest Officer

concerned will be recovered from the defaulting

Tenderers/Bidders through legal means including Revenue

Recovery Act in force.

11. The participating Tenderers/Bidders have only

right to collection and removal of enumerated standing

Rubber/Cocount trees and no right for removal of trees

like Teak, Rose Wood etc.

12. The successful Tenderers/Bidders have to pay

VAT, FDT, Income Tax etc. at the rate prevailing from time

to time.

13. The successful Tenderers/Bidders should execute

a bounded agreement on a stamp paper worth 100

after the completion of the Tender/Auction.

14. The confirmation of the Tender/Auction sale will

ordinarily be communicated to the party concerned as

early as possible. Within 15 days from the date of

intimation of the confirmation the successful Tenderers/

Bidders shall remit 1/3^rd of the balance sale value and 5%

Forest Development Tax, VAT and income tax at the rate

in force and security deposit of 10% for the total sale

value. The successful Tenderers/Bidders should execute

an agreement on a stamp paper worth 100. In case of

failure to remit the amount within 15 days extension shall

be granted by the Divisional Forest Officer for 15 days

subject to the realization of 12% penal interest. Further

extension for 15 days shall be granted by the Divisional

Forest Officer subject to the realization of 24% penal

interest. In case of failure to remit the amount within the

extended period further extension for 15 days by the

Chief Conservator of Forests and 15 days by the Addl.

Principal Chief Conservator of Forests shall be granted

subject to the realization of penal interest at 24% and

48% respectively. But all the extension periods mentioned

above will be within the original contract period.

15. The balance 2/3^rd sale value should be remitted

in two equal installments by the successful Tenderers/

Bidders. The first installment should be remitted within 15

days from the date of agreement and the second

installment within 30 days from the date of agreement or

within the contract period whichever is earlier. If the

successful Tenderers/Bidders fails to remit the above

amount within the period mentioned above, extension for

15 days by realizing penal interest at 12% by Divisional

Forest Officer concerned, extension for 30 days by

realizing penal interest at 24% by the Chief Conservator

of Forests concerned and further extension for 30 days by

the Addl. Principal Chief Conservator of Forests

concerned by realizing penal interest at 48% shall be

granted respectively. But all the above extended periods

will be within the original contract period.

16. The period of contract will be 60 days from the

date of intimation of confirmation. No extension of period

of contract shall be granted on ordinary ground. Under

very special circumstances, for good and sufficient

reasons, the Divisional Forest Officer and the Chief

Conservator of Forests concerned may grant extension

of time for one month and two months respectively on

realization of penalty or penalties for completion of each

work for each month mentioned below:

(a)

Unremoved registered logs and unregistered

logs–100/m³ or fraction thereof.

(b)

Unremoved firewood –50/Tone or fraction

thereof.

Penalty will be assessed and realized on timber,

firewood as the case may be which are either uncollected

or unremoved during the original contract period. The

Penalty for the first month shall be realized as the above

rates; double the rate for the second month and three

times of the original rate for the third month shall be

realized. If the Tenderers/Bidders fail to remove the entire

produce within the above extended period, the whole

timber and firewood collected by the tenders as per the

agreement will be forfeited to Government and the

Tenderers/Bidders have not any right on the produce

confiscated to Government. In the above circumstances

the balance work to be executed by the tenderer shall be

completed departmentally and all the loss sustained to

Government in this regard shall be realized from the

Tenderers/Bidders.

17. The passes for removal of Rubber and Coconut

Timber and Fire Wood collected in the coupe should be

issued only on the basis of the prevailing norms.

18. The Contractor/his agent shall enter the field

only after getting the written permission from the

Divisional Forest Officer, Ranni/Forest Range Officer,

Ranni.

19. The contractor shall at all time during the

currency of the contract, keep the coupe boundaries

cleared to a width of 2 meters and keep the cairns intact.

20. The security deposit will be refunded only after

the successful completion of contract after producing the

clearance certificates of VAT, Income Tax, etc. If there is

any liabilities outstanding in this respect to the

Government that will be adjusted from the security deposit

of the contractor.

21. All common conditions regarding sale coupe are

also applicable to this Tender/Auction.

undersigned or from the Office of the Range Officer,

Ranni on all working days.

Remarks:— If the Tender/Auction could not be conducted

on the notified date due to any other reason

the Tender/Auction shall be conducted on

19-4-2012 at 11 a. m. at the same place. In that

case tender forms will be issued till 5 p. m. on

18-4-2012 and the sealed tenders will be

accepted till 10 a. m. on 19-4-2012.
