FOOD SAFETY OFFICERS UNDER FOOD SAFETY AND

STANDARDS ACT, 2006—ORDERS ISSUED

In exercise of the powers conferred under sub

section 1 of Section 37 of Food Safety and Standards

Act, 2006 (Central Act 34 of 2006), the following Food

Inspectors are appointed as Food Safety Officers for the

Local Areas notified under section 3 (1)(zb) of Food

Safety and Standards Act, 2006.

Explanatory Note

I.

The areas of Jurisdiction of the notified Food Safety

Officers are restricted to the concerned circle/area of

the Mobile Vigilance Squad where they are presently

working or to any other local area as shall be

specified in their transfer order.

II.

According to sub section 1 of Section 37 of FSS

Act, 2006, the Commissioner of Food Safety shall by

notification in the official gazette appoint such

persons as he thinks fit having qualification

prescribed for such local areas as it may be assigned

to them. So each Food Safety Officer need to be

notified on fresh appointment/transfer. This creates a

vacuum in the implementation of the Act,

every time a Food Safety Officer is appointed as fresh

or transferred from one area of jurisdiction to

another. Hence the Food Safety Officers are notified

for the entire State. But their Jurisdiction restricted

to Circle/Municipalities/Corporation as specified in

notification issued by Commissioner of Food Safety

under Section 3 (1)(zb) of the FSS Act, 2006. This

notification is intended to achieve the above object.
