EXPLANATORY NOTE
(This is not part of the notification, but is intended
to indicate its general purport.)
In the Criminal Rules of Practice, Kerala, 1982, there
is no provision to retain the certified copies of dying
declarations and statements under Section 164 of the
Code of Criminal Procedure, 1973. As the above
documents are very crucial for adjudication, the High
Court is convinced that it will be helpful if the judicial
officer who has recorded the same retains a certified
photocopy of such statement with the Court of which he
is the Presiding Officer, so that if the original is lost, it
can be substituted by such copy. Amendment to Rule 71
and introduction of Form No. 46 are intended to achieve
the said objective. Amendment to Form No. 11 is
proposed, as it is found that an entry with respect to
previous posting date will be helpful to trace out the files.
