As per 1st paper read above, Smt. P. Sosamma,

formerly Agricultural Officer, Krishi Bhavan, Iverkala,

Kollam District had availed leave without allowance for

90 days from 6-4-1992 to 4-7-1992 [as per Order No. E (1)

7162/92 dated 2-4-1992 of Principal Agricultural Officer,

Kollam]. After that she had requested to cancel the leave

without Allowance for 90 days already sanctioned earlier

from 6-4-1992 to 4-7-1992 and requested to sanction five

years leave without allowance from 6-4-1992 and

submitted leave application. So also the above said

90 days Leave without allowance was cancelled vide Order

No. E (1) 13118/92 dated 10-11-1992 of Principal

Agricultural Officer, Kollam. Later on Principal Agriculture

Officer, Kollam reported that Smt. P. Sosamma, Agricultural

Officer had left India without getting the leave sanctioned.

That was reported to Government. Government have

directed

take

disciplinary

action

against

Smt. P. Sosamma, Agricultural Officer, who had left the

country without getting the leave sanctioned as per

Appendix XII-A. Part I KSR. Accordingly a memo of

charges with statement of allegations were issued to her

vide 1^st paper read above. Smt. P. Sosamma, Agricultural

Officer had submitted her defence statement vide 2^nd paper

read above. But the explanation was not satisfactory and

not acceptable. In this circumstances above, a

detailed

enquiry

was

found

necessary

and

Sri R. Sasidharan, the then Joint Director of Agriculture

(AR and T) who was subsequently promoted as Senior

Additional Director of Agriculture was appointed as the

Enquiry Officer vide 3^rd paper read above in this case as

per rule 15 of KCS (CC & A) Rules 1960. Accordingly, the

Enquiry Officer had decided to conduct the enquiry into

the charges issued to her on 26-6-1996 at 11 a. m. in his

chamber at Vikas Bhavan and directed her to attend the

enquiry with necessary defence statements. But she had

not attended the enquiry on 26-6-1995 and the intimation,

letter sent to her address in Australia was returned to this

office without acknoweldging the same vide 4^th paper read

above.

After that one more opportunity was given to her to

attend the enquiry on 5-10-1995 in the chamber of the

Enquiry Officer at Directorate of Agriculture, Vikas Bhavan

through Notice published in two reading dailies vide 5^th

paper read above. But she had not attended the enquiry

also. The Enquiry Officer had submitted the report vide 6^th

paper read above. In the enquiry the charges levelled

against her were stood proved.

In the above circumstances, a show cause notice has

been sent to her vide 7^th paper above with a copy of

Enquiry Report that it has been provisionally decided to

remove her from sevice with effect from 6-4-1992, ie, the

date in which she was unauthorisedly absenting from duty

as per Rule-15 of KCS (CC & A) Rules 1960, Rule 24 of

Part-1 KSRs and Appendix XII—A of Part-I—KSRs and a

show cause notice was sent to her vide 7^th paper read

above. She was allowed a period of 15 days to submit her

written explanation if any in the matter, which was sent to

her by Registered Post. But the same was also returned to

the Director of Agriculture due to non receipt of the

Registered letter. The above show cause notice was

published in two leading dailies ie Kerala Kaumudi and

Deshabhimani and awaited for further response if any from

her vide 8^th paper read above. No reply or any

communication has been received from her till date in

response to one show casuse notice.

In the above circumstances, and as per the

Rule-15, Smt. P. Sosamma, formerly, Agricultural Officer,

Krishi

KCS (CC & A) Rules 1960, Rule 24 of Part—1 KSRs and

Appendix XII-A of Part—1—KSRs is removed from

service with effect from 6-4-1992 ie, the date from which

she unauthorisedly absented from duty and order

accordingly.
