Thiruvananthapuram, 4th December 2012.

Whereas, the Government are of opinion that an

industrial dispute exists between the Manager,

Commonwealth Tile Factory, Feroke, Kozhikode and the

workmen of the above referred establishment represented

by (1) The Secretary, The Tile Empolyees Union,

Cheruvannoor, P. O. Feroke, Kozhikode, (2) The Secretary,

Merchantine Employees Association (INTUC), I. G. Road,

Kozhikode-1, (3) The Secretary, City Tile Labour Union

Puthiyara, Kozhikode, (4) The Secretary Tile and Ceramics

Workers Union (AITUC), Feroke, Kozhikode, (5) The

Secretary, City Tile Workers Union (CITU), Puthiyara,

Kozhikode, (6) The Secretary, Tile Workers Union (CITUS),

Feroke, Kozhikode in respect of matters mentioned in the

annexure to this order;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication;

Now, therefore, in exercise of the powers conferred by

Section 10 (1) (d) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947), the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Industrial Tribunal, Kozhikode. The Industrial

Tribunal will pass the award within a period of three

months.

ANNEXURE

Whether the workers of the Commonwealth Tile

Factory, Feroke and Puthiyara, Kozhikode are

eligible to get the L. T. A. with effect from the

financial year 2006-07? If yes what is the

quantum ?

Whereas, the Government are of opinion that an

industrial dispute exists between the Secretary, Pulpally

Service Co-operative Bank Ltd., Pulpally and the workman

of the above referred establishment Sri P. J. Michael,

Padinjaredath House, Mullankolly P. O., Pulpally in respect

of matters mentioned in the annexure to this order ;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication;

Now, therefore, in exercise of the powers conferred by

Section 10 (1) (c) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947), the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Labour Court, Kannur.

The Labour Court will pass

the award within a period of three months.

ANNEXURE

Whether the dismissal of Sri P. J. Michael,

Head Clerk/Accountant from the Service of

Pulpally Service Co-operative Bank Ltd.,

Pulpally, Wayanad by

the management is

justifiable ? If not, what are the relief the worker

is entitled to ?

Whereas, the Government are of opinion that an

industrial dispute exists between (1) Dr. E. K. Ummar,

Managing Partner, Elamkulam House, Hospital Road,

Nilambur-679 329, (2) Smt. Khamarunnisa (Partner), w/o

Dr. E. K. Ummar, Elamkulam House, Hospital Road,

Nilambur-679 329 and the workman of the above

referred establishment Smt. Vijaya Lekshmi, Poorangatt

House, Ramamkuth P. O., Nilambur in respect of matters

mentioned in the annexure to this order ;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication;

Now, therefore, in exercise of the powers conferred by

Section 10 (1) (c) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947), the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Labour Court, Kozhikode. The Labour Court will

pass the award within a period of three months.

ANNEXURE

Whether there is the denial of employment to

Smt. Vijaya Lekshmi, Cleaner by the management

of Elamkulam Hospital, Nilambur ? If yes, what

the relief she is entitled to ?

Whereas, the Government are of opinion that an

industrial dispute exists between Smt. Remani w/o

Radhakrishnan, Rajitha Match Works, Mulanjoor P. O., Via.

Chunangad and the workman of the above referred

establishment Sri K. Ravindran s/o Balakrishnan,

Kalarikkal House, Near Puliyara Mahavishnu Temple,

Palappuram, Ottapalam in respect of matters mentioned in

the annexure to this order ;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication;

Now, therefore, in exercise of the powers conferred by

section 10 (1) (d) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947) the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Industrial Tribunal, Palakkad.

The Industrial

Tribunal will pass the award within a period of three

months.

ANNEXURE

Whether

the

Ottapalam by the management is justifiable ?

If not, what relief he is entitled to ?

Medical College Hospital, Anjarakandy, Anjarakandy P. O.,

Kannur and the workmen of the above referred

establishment represented by the Secretary Cannanore

District Private Hospital & Medical Shop Employees Union

(CITU), Kannur in respect of matters mentioned in the

annexure to this order ;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication;

Now, therefore, in exercise of the powers conferred by

section 10 (1) (d) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947) the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Industrial Tribunal, Kozhikode.

The Industrial

Tribunal will pass the award within a period of three

months.

ANNEXURE

Whether the workers of Kannur Medical College

Hospital, Anjarakandy are entitled to get Bonus

and Exgratia amount for the accounting year

2011-12 under the payment of Bonus Act, 1965 or

not ? If yes what is the eligible quantum of Bonus

and Exgratia ?

686 006 and the workman of the above referred

establishment Sri Mohan Kumar, K. K., Kadamkuni House,

Neeleswaram P. O., Koduvally (via), Kozhikode in respect

of matters mentioned in the annexure to this order ;

And whereas, in the opinion of Government it is

necessary to refer the said industrial dispute for

adjudication;

Now, therefore, in exercise of the powers conferred by

section 10 (1) (c) of the Industrial Disputes Act of 1947

(Central Act XIV of 1947) the Government hereby direct

that the said industrial dispute be referred for adjudication

to the Labour Court, Kozhikode.

The Labour Court will

pass the award within a period of three months.
