Sealed competitive tenders are invited by

the

Executive

Engineer,

Harbour

Engineering

Thiruvananthapuram Division for and on behalf of the

Governor of Kerala, for the right to remove 8000 m³of

Earth/Sand from the dumping site of Vizhinjam Fishing

Harbour Project area as per level measurements of the

collected materials, after remitting the cost of sand as per

the direction of the Departmental Officers subject to the

conditions stipulated by the Department. In addition to

the tender, auction would be conducted.

The tender/auction documents can be had from the

Office of the Executive Engineer, Harbour Engineering

Thiruvananthapuram Division, Vizhinjam on written request

with the documents in proof of name and address of the

tenderer and after remitting the cost of tender/auction from

` 7,400 + VAT from 15-7-2013 to 20-7-2013 up to 12 Noon.

Sealed tenders will be received in the Office of

Executive Engineer, Harbour Engineering Division,

Thiruvananthapuram up to 1 p.m. on 22-7-2013. Those who

wish to participate in the auction should buy the auction

document in the stipulated time as above and register their

name in the Office of the Assistant Executive Engineer

from 22-7-2013, 2 p.m. to 23-7-2013, 12 Noon along with

proof of nativity certificate obtained from Village Office.

Auction would be conducted at 2 p. m. on 23-7-2013.

Tender would be opened after the auction. If the due

date happens to be a holiday, tender will be opened on

the next working day at the same time. EMD in the form

of Demand Draft/Savings Bank deposit pledged in the

name of Executive Engineer and a preliminary agreement in

stamp paper worth ` 100 should be enclosed along with

the tender documents. Nativity certificate obtained from

the Village Officer should be submitted along with the

tender/auction for name and address proof. Tender will be

summarily rejected if it does not contain the required

preliminary agreement and the EMD. If a person who is

intended to participate both tender and auction separate

forms should be purchased and submitted separately with

sufficient documents. After auction the tender documents

will be opened by the Executive Engineer or his authorized

representatives in the presence of the tenderer or his

representatives at Office of the Assistant Executive

Engineer, Harbour Engineering Sub Division, Vizhinjam.

Those who wish to participating in the auction, should

buy the auction documents after remitting the required fee

and the same shall be signed on each paper after

understanding the terms and conditions and produced

along with the EMD of ` 50,000 in cash. The highest

offer received among in the tender or auction will be

sanctioned subject to the approval of Government.

After the scrutiny of the tender, and if the

Department is convinced and on approval of the tender

from Government, the selected tenderer has to execute an

agreement in stamp paper worth ` 100 after remitting 5% of

the quoted amount as Security Deposit in the form of

Treasury Saving Bank pledged in favour of the Executive

Engineer and 50% of the quoted amount in cash and 50%

as bank guarantee, which is valid up to five months from

the date of execution of agreement. 50% of the Bank

guarantee is to be remitted in cash when 25% of the

agreement quantity is removed and guarantee is to be

remitted in full in cash when 50% of the agreement

quantity is removed. If there is any failure to remit the

amount as per the above conditions, or any other failure

on conditions stated above, this right would be cancelled

and rearrange at his risk and cost, the same shall be

recovered from him or his heirs by way of initiating

Revenue Recovery. The entire quantity of sand/earth

should be removed within 3 (three) months from the date

of execution of agreement.

Persons intending to take part in the tender can

inspect the site with the prior permission of Departmental

Officers and understand the quantity and quality of sand.

No claims whatsoever will not be accepted after the

acceptance of tenders.

The tender/auction documents should not be used

for the person's other than the original purchaser. All the

terms and conditions prescribed in this Notice Inviting

Tender and the existing rules of tender/auction in

Government of Kerala are also applicable to this tender/

auction. The cost of tender documents will not be

refunded under any circumstances. The EMD of the

highest 3 bidders will be retained till the finalization of the

tender/auction and executing its agreement and no interest

will be paid to the EMD retained.

More details regarding the tender can be had from the

Office of the Executive Engineer, Harbour Engineering

Thiruvananthapuram Division, Vizhinjam and Office of the

Assistant Executive Engineer, Harbour Engineering

Vizhinjam Sub Division. The Executive Engineer reserves

the right to reject the tender without assigning any

reason. The rules and conditions pertaining to all the

tenders in Public Works Department/Harbour Engineering

Department will be applicable to this tender also.

SPECIAL CONDITIONS

Quantity of sand to be removed will be calculated

based on the initial level before commencement of

work and final levels after removal of sand. The

quantity of sand removed will be ascertained based

on interim levels and balance quantity should be

fixed accordingly.

The sand can be removed only after getting

sanction from the Department and after approval of

initial level.

After getting sanction for the tender from

Government, the selected tenderer has to execute an

agreement in stamp paper worth ` 100 by remitting

5% of the quoted amount as Security Deposit (in

the form of Treasury Saving Bank pledged in

favour of the Executive Engineer) 50% of the

quoted amount in cash and 50% as Bank

Guarantee, which is valid up to five months from

the date of execution of agreement. 50% of the

Bank Guarantee is to be remitted in cash when 25%

of the agreement quantity is removed. The balance

amount is to be remitted in cash when 50% of the

agreement quantity is removed. Any failure to

remit the amount as per the above conditions, or

any other failure on conditions stated above, this

right would be cancelled and rearranged at his own

risk and cost and in case if any loss the same shall

be recovered from him or his heirs by way of

initiating Revenue Recovery.

The agreement should be executed within 20 days

of receipt of Selection Notice after remitting cost of

sand and Security Deposit.

All expenses for removing sand should be met by

the contractor in addition to the cost of sand.

Sand should not be removed from outside the

approved area or beyond the approved level

specified by the Department.

After removal of sand, the site must be leveled by

the contractor at his own cost as per the direction

of the Departmental Officers.

Contractor should remit the royalty, taxes and other

charges if any imposed by the Government at the

rates prescribed from time to time.

The sand can be removed only from 8 a. m. to

5 p.m. on working days.

Sand shall not be removed on sundays and other

holidays.

11.

Sand shall be taken only after obtaining the

necessary pass noting the lorry number and the

number of trips each day.

12.

The pass issued by the Department should not be

misused. Alteration/over writing of lorry number,

time, date, place/route, etc. is not permitted.

13.

Each load of sand should be conveyed only with

pass bearing seal issued by the Departmental

Officials after recording lorry number, time, date and

route.

The sand cannot be conveyed without the required

documents.

15.

The quantity of sand removed should be as stipu-

lated by the Departmental Officers. In case of any

failure action will be taken as per the agreement

condition.

16.

No claim in account of the variation in quantity

from the tender is admissible.

17.

In need of any temporary measures for removing

sand from the site i.e. road, shed, check post etc.

are to be arranged only after getting the permission

from the Department and the same should be

removed after use by the contractor at his own

cost.

18.

No damages should be occurred to the

Departmental Properties/structures while removing

the Sand. In case of any damage to the present

structures, the contractor has to rectify the same at

his own cost.

19.

Authorized agent should be present at the site,

whose name, address and signature should be

intimated in written to the Department.

20.

Sand can be removed only by the contractor or his

authorized agents with the permission and presence

of Departmental Officers.

21.

Cost of the sand per cubic metre should be written

in the tender documents.

22.

Any disputes/obstructions arising at site or in way/

outside the site during removal of sand should be

settled by the contractor itself. No compensation in

this regard will paid by the Department.

23.

Any disputes or claims arising out of the contract

relating to the work shall not be settled by means

of arbitration.

24.

Tender should be enclosed with preliminary agree-

ment in ` 100 Stamp Paper or otherwise the tender

will be rejected.
