As required under Section 3(2) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands)

Act, 2003, it is hereby notified for the information of the public that as per section 3(1) of the Act, the ownership

and possession of the land as per the details shown in the schedule hereto, in the District of Thrissur has been vested

with the Government of Kerala free from all encumbrances and the right, title and interest of the owner or any other

person thereon shall stand extinguished from the date of commencement of the Act, i.e. 2nd June 2000.

Explanatory Note

An extent of 2.023 Ha. of land in Sy. No. 604 of Kondazhy Village of Vazhad locality of Wadakanchery Forest

Range in Thalappilly Taluk, Thrissur Forest Division in Thrissur District was notified as Ecologically Fragile Lands

under section 3(1) of Kerala Forest (Vesting and Management of EFL) Ordinance-2000 as per Notification

No. C4-21437/2000 dated 26-8-2000 and published in Kerala Gazette No. 37, Volume 45 dated 19-6-2000 as Sl. No. 66.

Following the procedure prescribed under section 10(A) of the Kerala Forest (Vesting & Management) Amendment

Act 2009, the Government as per letter No. 935/E2/F&WLD dated 7-2-2013 has accepted the recommendation of the

EFLCDR Committee, to denotify 4.30 (Acres) (1.74 Ha) of land from above survey number from the purview of the

Ecologically Fragile Lands. Above denotification is published to achieve the said purpose.

The materials collected from final felling Teak Plantations in Konni Range of Konni Forest Division and stacked at

dumping sites shown in the schedule hereto attached will be sold in Tender/Auction by the undersigned or by any other

officer authorized for the purpose on the date and time shown in the schedule. The sale condition published by

the Additional Principal Chief Conservator of Forests (Protection), Thiruvananthapuram vide Notification

No. Pro. (5)-26274/2012, dated 11-12-2012 in the Kerala Government Gazette Vol.1 (No. 29) dated 25-12-2012 and other sale

conditions prevalent in the Forest Department are applicable to this Tender/Auction sale. This Sale Notification is

available in the website of Forest Department www.forest.kerala.gov.in. Any further notification on the sale conditions that

may be ordered by the Government after the publication of this sale notification will also be applicable to the sale. If the

notified date of Tender/Auction is declared as a holiday, the sale will be conducted on the next working day. If the sale

is not conducted fully or partially on the notified date due to other reasons, the same will be conducted on the alternate

date shown in the Schedule at the same place and time without further notification. The intending bidders should satisfy

themselves about the quality and quantity of the materials put up for sale before the commencement of the auction and

any complaint whatsoever, will not be entertained after the sale proceedings are over. In case, any Government Department

requires any of the materials, the quantity remaining after their selection only will be auctioned. The quantity that may

become available for sale after the publication of this notification will also be included in this sale. The Tender/Auction will

commence at the time noted in the Schedule in the dumping site and will continue till the sale of materials lotted for

the day is over.

Tender form can be had from the concerned Range Offices till 1 p. m. on the day before the auction date on

payment of ` 200 + VAT. The last date and time of receipt of tender is at 9 a. m. on the auction date.

It is hereby noted for the information of the public

that tender-cum auction sale of Teak Poles and billets

collected from the final Thinning coup of Ayyappancoil

Range under this Division as mentioned in the schedule

below will be conducted by the Divisional Forest Officer,

Kottayam or any other Officer authorized by him on

23-10-2013 subject to the sale conditions published by the

Additional Principal, Chief Conservator of Forests,

(Protection), Thiruvananthapuram vide No. Pro.5-26274/12

dated 11-12-2012 and other sale conditions prevalent in

the Forest Department are applicable to the tender/

auction sale. If the date of auction happened to be a

public holiday or if the sale is not conducted due to

some unexpected reasons like Bandh, Harthal etc. the sale

will be conducted on the next working day at the same

place and time. If the sale cannot be conducted on the

above two days due to any unexpected reasons the sale

will be conducted on 2-11-2013 at the same place and time.

This Gazette Notification is available in the website of

Forest Department www.forest.kerala.gov.in. Any further

notification on sale conditions that may be ordered by

the Government after the publication of this notification

will also be applicable to this sale. The intending bidders

should satisfy themselves about the quantity and quality

of materials put up for sale before the commencement of

auction and any complaint whatsoever will not be

entertained after the commencement of auction. If any

Government Department requires any of the materials the

quantity remaining after their selection only will be

auctioned. Further details can be obtained from this

office (Ph. No. 0481 2562276) or the Range Officer,

Ayyappancoil (Ph. No. 04868 259210) during working

hours. The quantities mentioned are approximate. The

materials stacked until before the date of auction are to be

put up for auction.

The tender form can be had from the Ayyappancoil

Forest Range Office till 8.45 a.m. on the auction date on

payment of ` 200 +VAT. The last date and time of the

receipt of tender is at 9 a.m. on the auction date.

the undersigned on behalf of the Governor of Kerala in

the prescribed form from eligible contractors registered

with Kerala PWD for the following Civil Works in Peechi

Wildlife Division during 2013-14.

The tender is fixed to be conducted on 30-10-2013 at

the office of the Wildlife Warden, Peechi Wildlife Division,

Peechi. The tender forms can be purchased from the

Office of the undersigned during office hours upto 1 p. m.

on all working days till the tender date. Cost of tender

form is non refundable. The intending tenderer should

apply with proof of identity such as Electoral Identity

Card, Driving License, Indian Passport etc. along with the

Registration Certificate in original to get the tender form.

The tender form should be properly filled up and should

be submitted on or before 3 p.m. on the date of tender. It

should be accompanied by all necessary documents along

with Earnest Money Deposit by way of Bankers DD or

fixed deposit or National Savings Certificate pledged in

favour of the Wildlife Warden, Peechi Wildlife Division,

Peechi P. O. payable at Thrissur. The intending tenderers

should also furnish a preliminary agreement in stamp

paper worth ` 100 along with tender of each work.

Incomplete tender without necessary documents or

tenders not in accordance with tender conditions will not

be accepted. Tenders will be opened by the Wildlife

Warden or an Officer authorized by him at 3.30 p. m. on

the same day, in the presence of those tenderers who are

present at that time. The Wildlife Warden reserves the

right to reject any tender, either partly or wholly without

assigning any reason thereof. If the tender could not be

conducted on the notified date due to any reason, it will

be conducted at the same place and time on the next

working day as per the same conditions.

If the tender for all work or any of the work could

not be conducted on the said date the tender for such

work/works will be conducted at the same place and time

with same conditions on 6-11-2013 if the tender could not

be conducted on that day also, it will be conducted on

13-11-2013. All existing rules, regulations, directions,

conditions prevailing in Kerala PWD and Kerala Forest

Department and Store Purchase Department in respect

of civil works shall be applicable in these works and

tender also.

Tender form can be had from the office of the

undersigned on direct remittance of cost of tender form or

in through money order along with the Registration Cards.

Value of the forms once realized will not be refunded at

any cost. EMD for the work should be made through

Demand Draft drawn from any nationalized bank in favour

of the Divisional Forest Officer, South Wayanad Division,

Kalpetta and payable at Kalpetta. Tenders without

adequate EMD, incomplete, defective or belated tenders

will be summarily rejected. The undersigned reserves the

right to reject any tender without assigning any reason

thereof. The Co-operative societies, rendering the tenders

should produce true copies of relevant orders exempting

them from remittance of EMD/security along with the

tenders if any. Otherwise they will have to remit EMD/

security applicable. Each and every tender should

accompany preliminary agreement in Stamp Paper worth

` 100 (Rupees One hundred only) duly signed by the

tenderer. Tenders without this preliminary agreement in

Stamp Paper will also be rejected even at the time of

opening the tenders. All the relevant rules, regulations,

at the Office of the Deputy Conservator of Forests and

Wildlife Warden, Wayanad Wildlife Division, Sulthan

Bathery. The tender forms can be purchased from the

office of the undersigned during office hours upto

1 p. m. on all working days till the tender date. Cost of

tender form is non refundable. The intending tenderers

should apply with proof of identity such as Electoral

Identity Card, Driving License, Indian Passport etc. along

with the Registration Certificate in original to get the

tender form. The tender form should be properly filled up

and should be submitted on or before 2 p. m. on the

date of tender. It should be accompanied by all necessary

documents along with Earnest Money Deposit by way of

Bankers DD or Fixed Deposit or National Savings

Certificate pledged in favour of Deputy Conservator of

Forest and Wildlife Warden, Wayanad Wildlife Division,

Sulthan Bathery payable at Sulthan Bathery. The intending

tenderers should also furnish a preliminary agreement in

Stamp Paper worth ` 100 along with tender of each

work. Incomplete tender or tenders without necessary

documents or tenders not in accordance with tender

conditions will not be accepted. Tenders will be opened

by the Deputy Conservator of Forests and Wildlife

Warden or an Officer authorized by him at 3.30 p. m. on

the same day, in the presence of those tenderers who are

present at that time. The Deputy Conservator of Forests

and Wildlife Warden reserves the right to reject any

tender, either partly or wholly without assigning any

reason thereof. If the tender could not be conducted on

the notified date due to any reason, it will be conducted

at the same place and time on the next working day as

per the same conditions.

If the tender for all work or any of the work could

not be conducted on the said date/dates, the tender for

such work/works will be conducted at the same place and

time with same conditions on 1-11-2013. If the tender

could not be conducted on that day also, it will be

conducted on 8-11-2013. If it could not be conducted on

that day also, it will be conducted on 15-11-2013. All

existing rules, regulations, directions, conditions,

prevailing in Kerala PWD and Kerala Forest Department

and Store Purchase Department in respect of civil works

shall be applicable in these works and tender also.

TENDER-CUM-AUCTION NOTICE

[No. 4/2013-14]

It is hereby notified for the information of the public that the right of collection and removal of enumerated

standing Edala, Kambili, Cheru, Pala, Thali and other misc. species of trees and bamboos (Kottiyoor) in the 1952 Teak

Plantation, Kannoth (9.7 Ha.), Kannavam, Kannavam Section of Kannavam Range, 1952 Teak Plantation, Nedumpoyil,

Tholambra Section (8.30 Ha.) of Kottiyoor Range of this Division as specified in the schedule appended below will be

sold in tender-cum-auction by the Divisional Forest Officer, Kannur or any other officers authorized by him on 12-11-2013

at 11.30 a.m. at the Divisional Forest Office, Kannur, subject to the terms and conditions of sale of timber in Government

Timber Depots published in Government Gazette No. 29 dated 25-12-2012 in Part III of Page Nos. 456 to 461 of Forest

Sheet as per Pro. (5)-26274/12 dated 1-3-2013 of the Chief Conservator of Forests (P), Thiruvananthapuram. In case the

notified date happens to be public holiday, the tender cum auction will be conducted on the next working day at the

notified place and time. If there is a requirement of re-auction, it will be conducted on 19-11-2013 and 26-11-2013 at the

same place.

The auction will be on lump sum basis for the right of collection and removal of entire Edala, Kambili, Cheru,

Pala, Thali and other soft wood species of trees and bamboos (Kottiyoor) growth from the above plantations

mentioned in the schedule hereto, the area of which has been surveyed and demarked on the ground.

Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the

produce before participating in the Tender-cum -Auction. Complaints if any, regarding quality and quantity etc.

received after the Tender-cum-Auction will not be entertained.

Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another

person unless valid power of attorney is produced prior to the commencement of Tender-cum-Auction.

A supply contractor of Kannur Division or any adjacent divisions will not be allowed to bid in the

Tender-cum-Auction.

Intending tenderers/bidders should produce photo identity proof issued by Govt. Authority or a certificate from

the concerned Village Officer showing their permanent address and duly attesting their signature along with

Earnest Money Deposit.

The successful tenderers/bidders should give an undertaking that he is not related with any officer having

control over the work and that he is not a supply contractor of this or any adjacent division. If this is proved

otherwise, it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

No post offer received after 7 days of the conduct of the Tender cum Auction sale and post offer which is not

advantageous by more than 10% of the original offer where the bid amount is rupees one lakh and above

and more than 20% where the original bid amount is less than one lakh will ordinarily be considered. The post

offerer will comply with following terms.

(a)

Offer should be made within 7 days of Tender cum Auction failing to which the offer will not be

considered.

(b)

Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender cum

Auction date.

(c)

The remittance should be made by the chalan or bank deposit and the bank receipt should be

produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of

registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional

Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer

satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the

re-auction, the price fetched if does not come up to what has been offered by the post offerer, it will be awarded to the

post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to

Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to

the highest bidders/tenderers in the re-auction and the amount remitted by the post offerer will be released to him.

Further particulars about the Tender-cum-Auction can be had either from the Office of the Divisional Forest

Officer or from the Range Office, Kannavam/Kottiyoor.

Intending tenderers/bidders should deposit an Earnest Money Deposit of ` 10,000 (Rupees Ten Thousand

only) for each plantation/block for participating in the Tender/Auction.

If the bid amount is below or upto ` 20,000 the successful tenderer/bidder should remit the full sale

value on the sale day itself. If the bid amount is above ` 20,000 the tenderer/bidder should remit

the 35% of the sale value subject to a minimum of ` 20,000 and maximum of ` 1,00,000 either by ready cash or

by a Demand Draft payable at the prescribed branch of any Nationalized Bank on the sale

day itself. The EMD of the successful tenderer/bidder will also be included in the above 35% sale value.

The tenderer/bidder should bear the commission charge of the Demand Draft if the same

is being encashed from a Bank in which he/she has no account. If the Demand Draft is being rejected

under any circumstances the concerned tenderer/bidder will be treated as a defaulter and action will be taken against

him as per the tender/sale condition as well as criminally.

If the 35% sale value exceeds ` 1,00,000 the tender/bidder should remit the balance

amount exceeding ` 1,00,000 within 7 working days as a treasury as directed by the competent authority

and should produce the chalan receipt.

The successful tenderers/bidders have only the right for the collection and removal of marked Edala, Kambili,

Cheru, Pala, Thali and other softwood trees and bamboos (Kottiyoor) as mentioned in the Schedule appended

and will have no right over Teak, Rosewood or such other unmarked trees.

12.

The successful tenderers/bidders should execute a bounden agreement on a Stamp Paper worth ` 100 after the

completion of Tender-cum-Auction.

13.

The confirmation of the Tender-cum-Auction sale will be communicated to the party concerned as early as

possible. Within 15 days from the date of intimation of the confirmation, the successful tenderers/bidders shall

remit the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rates in force and

security deposit of 10% for the total sale value. The successful tenderers/bidders should execute an agreement

on a stamp paper worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted

by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. In case of failure

to remit the amount within the extended period further extension for 15 days by the Chief Conservator of

Forests, Northern Circle, Kannur subject to the realization of 24% penal interest. But all the above extension

period will be within the original contract period. Failure to remit any of the above instalment even during the

extended period will entail cancellation of the contract and forfeiture of all money paid till then and all produce

remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor.

In calculating interest, 15 days and below will be reckoned as 1/2 month and over 15 days as one month.

1f the successful tenderers/bidders fails to execute the agreement after remitting the amount even during the

extended period as per the above condition, entire amount paid till then will be forfeited to the Government and

all the produce left unremoved in the coupe will be confiscated to Government after cancelling the

Tender-cum-Auction. The coupe will be re-auctioned at the risk and loss of the tenderers/bidders. He will be

liable for all the loss sustained to the Government and will have no right over the profit derived out of the

re-auction of the coupe.

15.

Failure to remit any of the above instalment even during the extended period will entail the cancellation of the

contract and forfeiture of all the money paid till then and confiscation of all the produce remaining in the

coupe. The right thus cancelled will be resold at the risk and loss of the contractor. The contractor will have

no right over the profit derived out of the resale of the coupe.

16.

The period of contract will be allowed 30 days from the date of intimation of confirmation. No extension of

period of contract shall be granted on ordinary ground. Under special circumstances, for good and sufficient

reasons, the Divisional Forest Officer and the Chief Conservator of Forests, Northern Circle, Kannur concerned

may grant extension of time for 30 days, further 30 days respectively on realization of penalty or penalties for

completion of each work for each extension mentioned below:

(a)

For enumerated trees and balance unfelled per hectare or fraction thereof ` 750 per hectare.

(b)

Unremoved registered logs and unregistered logs and bamboo ` 100/M³/MT or fraction thereof.

(c)

Unremoved firewood ` 50/Tone or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or

unremoved during the original contract period. The penalty for the first 30 days shall be realized at the above rates,

double the rate for the second 30 days shall be realized.

If the tenderers/bidders fails to remove the entire produce within the above extended period, the whole timber and

firewood collected by the tenderers/bidders as per the agreement will be forfeited to Government and the tenderers/

bidders will not have any right on the produce confiscated to Government. In the above circumstances the balance work

to be executed by the tenderers/bidders shall be completed departmentally and all the loss sustained to Government in

this regard shall be realized from the tenderers/bidders.

17.

The contractor shall be allowed to remove the timber of Edala, Vengana, Kambili, Cheru, Thali, Sterculia and

other misc. species, bamboos and fire wood from the coupe subject to the law prevailing in the department

from time to time.

18.

The contractor or his persons shall be allowed to enter in the coupe only after getting the prior permission

either from the Divisional Forest Officer, Kannur or from the Forest Range Officer, Kannavam/Kottiyoor.

19.

The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a

width of 2 Meters and keep the cairns intact.

20.

He will be liable for the damages made to other trees in plantations or RF.

21.

The successful tenderers/bidders may allow to stack the timber in the forest area outside the coupe at the risk

of the tenderers/bidders up to the period of contract. An amount of ` 250 will be charged as ground rent for

the timber unremoved for 1 Ha. or fractions thereof.

22.

He will be liable for all illegal activities happened 400 Mtr. (2 Furlong) surrounding of the coupe. Such

incidents, if noticed by contractor, should be informed the officer concerned, otherwise will lead to the

cancellation of the contract.

23.

The security deposit will be released to the Contractor the work has completed in stipulated period if any

liability outstanding will be set off from the security deposit.

24.

for sale of the vehicle confiscated under section 61A of

Kerala Forest Act shown in the schedule below.

Sealed tenders should be submitted before the under

signed on or before 17-10-2013 at 3 p. m. at this office at

Kasaragod, Vehicles for Auction cum tender are shown

below in the table and after receiving the tenders the

vehicles will be auctioned among the tenderers and the

tender will be opened on the same day at 3.30 p.m. in their

presence by the undersigned or an officer authorized by

him at this office at Thayalangadi, Kasaragod. The

Auction/tender will temporarily be fixed in the name of the

highest tenderer/bidder. If any vehicle put up for auction/

reauction on 17-10-2013 is not sold, the same will be

re tendered/auctioned accepting tenders up to 3 p. m. on

23-10-2013 and 30-10-2013.
