KERALA STATE LEGAL SERVICES AUTHORITY

NOTIFICATION

No. 2186/D/13/KELSA.

17th August 2013.

In exercise of the powers conferred by Section 29A

of the Legal Services Authorities Act, 1987 (Central Act

39 of 1987) Kerala State Legal Services Authority hereby

makes the following Regulations to amend Kerala State

Legal Services Authority Regulations 1998 as per

Notification No. 47/D/2010/KELSA dated 15th November

2010 published in Kerala Gazette dated 9th August 2011.

REGULATIONS

•

Short title and commencement.—(1) These

Regulations may be called Kerala State Legal Services

Authority (Amendment) Regulations, 2013.

•

They shall come into force w.e.f. 24-7-2013 the date

on which the meeting of the Authority resolved to pay

honorarium.

•

Amendment of Regulation 37—(1) In clause( 1) of

Regulation 37 “Rs. 500 and Rs. 400 per day shall be

deleted and in that place the words and figures”

Rs. 1,000 and Rs. 800 each per day” shall be inserted.

(2)

ln clause (2) of Regulation 37 “at the rate of

Rs. 500 per day” shall be deleted and in that place the

words and figures “Rs. 1000 per day” shall be inserted.

(3)

ln clause (3) of Regulation 37 “Rs. 600 per day”

shall be deleted and in that place words and figures

“Rs. 1000 per day and Actual Travelling Allowance” shall

be inserted.

Explanatory Note

(This does not form part of the Notification and is

intended to indicate its general purport.)

Regulation 37 deals with honorarium payable to

sitting and retired Presiding officers and members of

Lok Adalats. Since the honorarium of Rs. 500 per day fixed

for Presiding Officer both retired and Sitting judicial

Officer and Rs. 400 per day for other members in 2010 has

become too inadequate in the present day money value,

this amendment is effected. The sitting fee of retired

Presiding Officers coming from outside the District fixed

as “amount not exceeding Rs. 600” in the year 2010 also

may not be sufficient in the present day context. This

notification is intended to amend the existing provision to

the aforementioned sums to make them suitable for their

intended purpose in the present day context.

By order,

Niyama Sahaya Bhavan,

P. MOHANADAS,

High Court Compound, Kochi.

Member Secretary.
