Whereas you Sri N. J. Raju, while holding the post

of First Grade D’man was sanctioned Leave Without

Allowance for 5 years w.e.f. 18-8-1992 for taking up

employment abroad and subsequently sanctioned

extension of LWA for 14 years on different spells up to

17-8-2011. As you Sri N. J. Raju did not rejoin duty on

expiry of the sanctioned term of leave disciplinary action

was initiated against you by issuing Memo of charges

and Statement of allegations vide reference cited 1st

above.

Therefore as per Rule 15 of the KCS (CCA) Rules

1960 a Formal enquiry was conducted by appointing

Sri Joseph Johny, Executive Engineer, Kottayam Division

as Inquiring Authority and Sri Varadarajan, Assistant

Secretary, Pathanamthitta as Presenting Officer.

Sri Joseph Johny the Inquiring Authority vide Registered

letter dated 15-3-2013 had reported that you did not

attend the formal enquiry hearing on 27-3-2013 at the

Division Office, Ernakulam. Instead you had requested to

postpone the enquiry on 19-4-2013 and accordingly the

second sitting was fixed on 19-4-2013 and the same was

informed to you vide Registered letter dated 27-3-2013.

But you have not turned up for the hearing on

19-4-2013. The Inquiring Officer after thorough enquiry

has recommended for the termination from service as per

KCS (CCA) Rules 1960.

In the circumstances, the undersigned have decided

to conclude the disciplinary action initiated against you

by imposing the punishment of removal from the Service

of the Board as contemplated under KCS (CC&A)

Rules 1960.

Therefore the undersigned hereby give notice to you,

Sri N. J. Raju to show cause as to why the said

punishment of removal from service should not be

imposed upon you as contemplated in Para (9) of

Appendix XII A of KSR Part I, Rule II (i) (vii) of KCS

(CC& A) Rules 1960 and as per Rule 18 (2) (f) of the

KSHB Act 1971. Your written explanation should reach

the undersigned within 14 days from the date of receipt of

this notice. If your explanation is not received within the

stipulated period, the matter will be proceeded with on the

presumption that you have no explanation to offer in the

matter and you will be removed from the services of the

Board without any further notice.

30-4-2013 of the Enquiry Officer.

Whereas you Sri Muhammed Sherif. M. A., while

holding the post of Assistant Engineer was sanctioned

Leave Without Allowance for 6 months w.e.f. 1-6-1995 for

taking up employment abroad and subsequently

sanctioned extension of LWA for 14½ years up to

12-6-2010. As you Sri Muhammed Sherif. M. A., did not

rejoined duty on expiry of the sanctioned term of

leave, disciplinary action was initiated against you by

issuing memo of charges and Statement of allegations

vide reference cited 1st above. But there was no

response from your side.

Therefore as per Rule 15 of the KCS (CCA) Rules

1960 a formal enquiry was conducted by appointing

Smt. Sheena Nancy, Executive Engineer, Ernakulam

Division as Enquiry authority and Sri N. V. Jose,

Accounts Officer, Housing Unit, Kochi as Presenting

Officer Smt. Sheena Nancy the Enquiry Authority vide

Registered letter dated 12-4-2013 had directed you to

attend the hearing before him at the Ernakulam Division

Office on 18-4-2013. The delinquent Officer could not

give convincing reasons for his unauthorized absence.

The Enquiry Officer after thorough enquiry has

recommended for the termination from service as per KCS

(CCA) Rules 1960.

In the circumstances, the undersigned have

provisionally decided to conclude the disciplinary action

initiated against you by imposing the punishment of

removal from the service of the Board as contemplated

under KCS (CC&A) Rules 1960.

Therefore the undersigned hereby give notice to you,

Sri Muhammed Sherif. M. A., to show cause as to why

the said punishment of removal from service should not

be imposed upon you as contemplated in para (9) of

Appendix XII A of KSR Part I, Rule II (i) (vii) of KCS

(CC& A) Rules 1960 and as per Rule 18 (2) (F) of the

KSHB Act 1971. Your written explanation should reach

the undersigned within 14 days from the date of receipt of

this notice. If your explanation is not received within the

stipulated period, the matter will be proceeded with on the

presumption that you have no explanation to offer in the

matter and you will be removed from the services of the

Board without any further notice.
