(This does not form part of the notification, but is

intended to indicate the general Purport)

As per notification issued under EFL.10-334/2013

dated 28th May 2013 and published in the Kerala Gazette

No. 27, volume II, published by Authority dated 2nd July

2013, the land measuring 5.03 area (2.0364 Ha.) comprised

in Survey Nos. 134/3pt, 134/4pt in Keralassery Village,

Palakkad Taluk, Palakkad District and described in the

schedule attached to the said notification, was notified as

Ecologically Fragile land. Subsequently it was noticed that

the heading of the notification is wrongly mentioned as

“Draft Notification” instead of “Notification”. Therefore it

has been decided to rectify the mistake through

an erratum.

It is hereby notified for the information of the public that the right of collection and removal of standing Elavu

and Vatta trees in the 1968 Match Wood Plantation at Harijan Colony in Achencovil Range and 1970 MW Plantation at

Valayam in Thulumala Section of Kallar Range of this division as specified in the schedule appended below will be sold

in Tender cum Auction by the Divisional Forest Officer, Achencovil or any other officer authorized by him on 30-1-2014

at 3 p.m. in the Divisional Forest Office, Achencovil subject to the terms and conditions of sale of Timber in Government

Timber Depots published in Government Gazette No. 49, Vol. II dated 10-12-2013 vide Notification No. Pro.(5) 26274/12

dated 22-11-2013 of the Addl. Principal Chief Conservator of Forests (P), Thiruvananthapuram and as per General

Conditions of the sale of tree growth prevailing in the department. In case the notified date happens to be a public

holiday the Tender/Auction will be conducted on the next working day at the notified place and time.

2. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu and Vatta tree

growth from the above Plantation mentioned in the schedule here to the area of which has been surveyed and demarcated

on the ground.

3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the

produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the

Tender/Auction will not be entertained.

4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless

valid power of attorney is produced prior to commencement of Auction/Tender.

5. A supply contractor of Achencovil Division or the adjacent Divisions will not be allowed to bid in the Auction/

Tender.

6. Intending tenderers/bidders should produce a certificate from the concerned Village Officer showing their

permanent address and duly attesting their signature along with Earnest Money Deposit.

7. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control

of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall

result in cancellation of the contract and resale of the coupe at his risk and loss.

8. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer which

is not advantageous by more than 10% of the original offer where the bid amount is Rupees One lakh and above, and

more than 20% where the original bid amount is less than One lakh will ordinarily be considered. The post offerer will

comply with following terms.

(a)

Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.

(b)

Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.

(c)

The remittance should be made by the Chalan or Bank Deposit and the bank receipt should be produced

before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice

to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional

Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms. If the post offerer

satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the

re-auction of the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the

post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forefeited to

Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to

the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

9. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer

concerned.

10. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of 10,000 (Rupees Ten thousand only)

for participating in the Tender/Auction for each plantation/block.

11. The successful tenderers/bidders have to remit 35% sale value on the tender/auction date. If this 35% value

exceeds 1,00,000, 1,00,000 will be remitted on auction date itself and balance value have to be remitted in the

Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and the receipted chalan

submitted to this office. If he fails to remit this amount, the EMD will be forfeited to Govt. and the coupe will be

re-auctioned at his risk and loss.

12. If the value fetched in the resale/re-tender is less than that obtained in the original tender/auction the difference

between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed

by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through legal means

including Revenue Recovery Act in force.

13. The participating Tenderers/Bidders have rights only for collection and removal of enumerated standing Elavu and

Vatta trees and has no right for removing trees like Teak, Rose Wood, etc.

14. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from

time to time.

15. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth 100 after the

completion of the Tender/Auction.

16. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as

possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit

rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security

deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper

worth 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest

Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the

Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the

extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Additional Principal

Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But

all the extension periods mentioned above will be within the original contract period.

17. The balance 2/3rd sale value should be remitted in two equal instalments by the successful Tenderers/Bidders.

The first instalment should be remitted within 15 days from the date of agreement and the second instalment within

30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders

fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at

12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief

Conservator of Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of

Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will

be within the original contract period.

18. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of

contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons,

the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month

and two months respectively on realization of penalty or penalties for completion of each work for each month

mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof — 750 per hectare.

(b) Unremoved registered logs and unregistered logs— 100/m³ or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or

unremoved during the original contract period. The penalty for the first month shall be realized as the above rates; double

the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/

Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the

tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders shall not have any right on the

produce confiscated to Government.

In the above circumstances the balance work to be executed by the Tenderer shall be completed departmentally and

all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.

19.

The license for removal of Elavu and Vatta Timber and Firewood collected in the coupe should be issued only

on the basis of the prevailing norms.

20.

The contractor/his agent shall enter the coupe only after getting the written permission from the Divisional

Forest Officer, Achencovil/Forest Range Officer, Achencovil/Kallar.

21.

The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width

of 2 meters and keep the cairns intact.

22.

The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

23.

The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if

requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period

due to

unforeseen situation/climate, a ground rent @ 250/Ha. will be recovered from the contractor.

24.

The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such

activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.

25.

The security deposit will be refunded only after the successful completion of contract after producing the

clearance certificates of VAT, Income Tax, etc. If there is any liabilities outstanding in this respect to the Govt. that will be

adjusted from the security deposit of the contractor.

26.

All common conditions regarding sale coupe are also applicable to this Tender/Auction.

Further details can be had from the office of the undersigned or from the Office of the Range Forest Officer,

Achencovil/Kallar on all working days.

Remarks:— If the Tender/Auction could not be conducted on the notified date due to any other reason the Tender/

Auction shall be conducted on 5-2-2014 at 3 p.m. at the same place. In that case tender forms will be

issued till 1 p. m. on 5-2-2014 and the sealed tenders will be accepted till 2 p. m. on 5-2-2014.

It is hereby notified for the general information of the public that Teak Poles and Teak firewood collected from

1960 Punnamattam Teak Plantation and Jungle wood fire wood collected from 1937 Kuttanchira Teak Plantation of

Palappilly Range of Chalakudy Forest Division will be sold in Tender/Auction sale subject to detailed Tender/Auction

sale conditions published in Kerala Gazette No. 29 dated 25-12-2012 vide notification No. Pro.(5) 26274/12 dated 11-12-

2012 of Chief Conservator of Forests (Protection), Thiruvananthapuram and other rules in force, as per schedule furnished

below. Tender forms will be available in Divisional Forest Office, Chalakudy Division, Chalakudy on payment of 200

plus VAT. Sealed tenders will be received at Divisional Forest Office, Chalakudy Division, upto 3 p. m. on the working

day prior to the auction date and tenders received after the stipulated date and time will not be entertained. If the date

fixed for Tender/Auction happens to be a public holiday, harthal or strike, the Auction sale will be held on the next

working day at the scheduled time and place. Tender will be opened immediately after auction sale and further action will

be taken as per sale conditions. The intending bidders should satisfy themselves about the quality and quantity of the

thinned materials put up for Tender/Auction sale and no complaints will be entertained later regarding the same. Further

the Wildlife Warden, Silent Valley Division before 3 p.m.

on 21-1-2014. The tenders received will be opened by the

Wildlife Warden or any other officer authorized by him

at 3.30 p.m. on the same day in the Office of the Wildlife

Warden, Silent Valley Division, Mannarkkad. Tender form

can be purchased from the Office of the Wildlife Warden,

Mannarkkad on any of the working days till 1 p.m. on

21-1-2014. The registered contractors will be supplied with

the tender forms only on the production of their

registration cards. The price of the tender form is non-

refundable under any circumstances. Tenders received after

the due time and date and not accompanied by proper

Earnest Money Deposit will not normally be entertained.

The tenders not containing the prescribed preliminary

agreement in Kerala Government stamp paper worth 100

will be rejected. If the tender date happens to be a public

holiday, tender will be conducted and opened on the next

working day at the same time and venue.

If the tender cannot be conducted on 21-1-2014 the

same will be conducted on 24-1-2014 and 28-1-2014

respectively as per same condition mentioned above. All

Separate sealed tenders are invited for the following

works indicated in the Schedule given below from

Registered PWD Contractors so as to reach the Office of

the Wildlife Warden, Silent Valley Division before 3 p.m.

on 21-1-2014. The tenders received will be opened by the

Wildlife Warden, or any other officer authorized by him at

3.30 p.m. on the same day in the Office of the Wildlife

Warden, Silent Valley Division, Mannarkkad. Tender form

can be purchased from the Office of the Wildlife Warden,

Mannarkkad on any of the working days till 1 p.m. on

21-1-2014. The registered contractors will be supplied with

the tender forms only on the production of their

registration cards. The price of the tender form is non-

refundable under any circumstances. Tenders received after

the due time and date and not accompanied by proper

Earnest Money Deposit will not normally be entertained.

The tenders not containing the prescribed, preliminary

agreement in Kerala Government stamp paper worth 100

will be rejected. If the tender date happens to be a public

holiday, tender will be conducted and opened on the next

working day at the same time and venue.

If the tender can not be conducted on 21-1-2014 the

same will be conducted on 24-1-2014 and 28-1-2014

respectively as per same condition mentioned above. All

existing rules, regulations, directions, conditions prevalling

in Kerala PWD and Kerala Forest Department and Store

Purchase Department in respect of civil works shall be

applicable in this works and tender also.

The Wildlife Warden reserves the rights to accept or

reject the tenders without assigning any reason thereof.

during 2013-14. The tender is fixed to be conducted on

Period of completion—Upto 3 months.

The tender is fixed to be conducted on 28-1-2014 at

the Office of the Deputy Conservator of forests & Wildlife

Warden, Wayanad Wildlife Division, Sulthan Bathery.

The tender forms can be purchased from the office of the

undersigned during office hours upto 1 p. m. on all

working days till the tender date. Cost of tender form is

non refundable. The intending tenderer should apply

with proof of identity such as Electoral Identity Card,

Driving License, Indian Passport etc. along with the

Registration Certificate in original to get the tender form.

The tender form should be properly filled up and should

be submitted on or before 2 p. m. on the date of tender.

It should be accompanied by all necessary documents

along with Earnest Money Deposit. by way of Bankers

DD or Fixed Deposit or National Savings Certificate

pledged in favour of Deputy Conservator of Forest and

Wildlife Warden, Wayanad Wildlife Division, Sulthan

Bathery payable at Sulthan Bathery. The intending

tenderers should also furnish a preliminary agreement in

stamp paper worth 100 along with tender of each

work.

Incomplete tender or tenders without necessary

documents or tenders not in accordance with tender

conditions will not be accepted.

Tenders will be opened

by the Deputy Conservator of Forest and Wildlife Warden

or an Officer authorized by him at 3.30 p.m. on the same

day, in the presence of those tenderers who are present

at that time.

The Deputy Conservator of Forest and

Wildlife Warden reserves the right to reject any tender,

either partly or wholly without assigning any reason

thereof.

If the tender could not be conducted on the

notified date due to any reason, it will be conducted at

the same place and time on the next working day as per

the same conditions.

If the tender for all works or any of the work could

not be conducted on the said date/dates, the tender for

such work/works will be conducted at the same place

and time with same conditions on 5-2-2014. If the tender

could not be conducted on that day, also it will be

conducted on 11-2-2014. If it could not be conducted on

that day also, it will be conducted on 18-2-2014. All

existing rules, regulations, directions, conditions,

prevailing in Kerala PWD and Kerala Forest Department

and Store Purchase Department in respect of civil works

shall be applicable in these works and tender also.
