It is hereby notified for the information of the public that the right of collection and removal of standing Elavu
and Vatta trees in the 1970 Match Wood Plantation at Valayam in Thulumala Section of Kallar Range and 1968 Match
Wood Plantation at Harijan Colony (17.009 Ha) in Achencovil Range of Achencovil division as specified in the schedule
appended below will be sold in Tender cum Auction by the Divisional Forest Officer, Achencovil or any other officer
authorized by him on 18-7-2014 at 3 p.m. in the Divisional Forest Office, Achencovil subject to the terms and conditions
of sale of Timber in Government Timber Depots published in Government Gazette No. 49, Vol. II dated 10-12-2013 vide
Notification No. Pro.(5) 26274/12 dated 22-11-2013 of the Addl. Principal Chief Conservator of Forests (P),
Thiruvananthapuram and as per General Conditions of the sale of tree growth prevailing in the department. In case the
notified date happens to be a public holiday the Tender/Auction will be conducted on the next working day at the
notified place and time.

2. The auction will be on lump sum basis for the right of collection and removal of entire Elavu and Vatta tree
growth from the above Plantation mentioned in the schedule here to the area of which has been surveyed and demarcated
on the ground.
3. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the
produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the
Tender/Auction will not be entertained.
4. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless
valid power of attorney is produced prior to commencement of Auction/Tender.
5. A supply contractor of Achencovil Division or the adjacent Divisions will not be allowed to bid in the Auction/
Tender.
6. Intending tenderers/bidders should produce a certificate from the concerned Village Officer showing their
permanent address and duly attesting their signature along with Earnest Money Deposit.
7. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control
of the work and that he is not supply contractor of this or any adjacent divisions. If this is proved otherwise it shall
result in cancellation of the contract and resale of the coupe at his risk and loss.
8. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer which
is not advantageous by more than 10% of the original offer where the bid amount is One lakh and above, and more than
20% where the original bid amount is less than One lakh will ordinarily be considered. The post offerer will comply with
following terms.
(a)
Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.
(b)
Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.
(c)
The remittance should be made by the Chalan or Bank Deposit and the bank receipt should be produced
before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice
to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional
Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms. If the post offerer
satisfied the conditions, a re-auction will be conducted after giving the usual publicity as per rules. In the
re-auction the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the post
offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to
Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to
the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.
9. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Officer
concerned.
10. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of ` 10,000 (Rupees Ten thousand only)
for participating in the Tender/Auction for each plantation/block.
11. The successful tenderers/bidders have to remit 35% sale value on the tender/auction date. If this 35% value
exceeds ` 1,00,000, ` 1,00,000 will be remitted on auction date itself and balance value have to be remitted in the
Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and the receipted chalan
submitted to this office. If he fails to remit this amount, the EMD will be forfeited to Govt. and the coupe will be
re-auctioned at his risk and loss.
12. If the value fetched in the resale/re-tender is less than that obtained in the original tender/auction the difference
between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed
by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/Bidders through legal means
including Revenue Recovery Act in force.
13. The participating Tenderers/Bidders have rights only for collection and removal of enumerated standing Elavu and
Vatta trees and has no right for removing trees like Teak, Rose Wood, etc.
14. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax etc. at the rate prevailing from
time to time.
15. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth ` 100 after the
completion of the Tender/Auction.

16. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as
possible. Within 15 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit
rd of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security
deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a Stamp Paper
worth ` 100. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest
Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the
Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the
extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the Additional Principal
Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But
all the extension periods mentioned above will be within the original contract period.
17. The balance 2/3rd sale value should be remitted in two equal installments by the successful Tenderers/Bidders.
The first installment should be remitted within 15 days from the date of agreement and the second installment within
30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders
fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at
12% by Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief
Conservator of Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of
Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will
be within the original contract period.
18. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of
contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons,
the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month
and two months respectively on realization of penalty or penalties for completion of each work for each month
mentioned below:
(a) For enumerated trees and balance unfelled per hectare or fraction thereof —` 750 per hectare.
(b) Unremoved registered logs and unregistered logs—` 100/m3 or fraction thereof.
(c) Unremoved firewood—` 50/Tone or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or
unremoved during the original contract period. The penalty for the first month shall be realized as the above rates; double
the rate for the second month and three times of the original rate for the third month shall be realized. If the Tenderers/
Bidders fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the
tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders shall not have any right on the
produce confiscated to Government.
In the above circumstances the balance work to be executed by the Tenderer shall be completed departmentally and
all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.
19.
The license for removal of Elavu and Vatta Timber and Firewood collected in the coupe should be issued only
on the basis of the prevailing norms.
20.
The contractor/his agent shall enter the coupe only after getting the written permission from the Divisional
Forest Officer, Achencovil/Forest Range Officer, Kallar.
21.
The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width
of 2 meters and keep the cairns intact.
22.
The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.
23.
The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if
requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period
due to
unforeseen situation/climate, a ground rent @ ` 250/Ha. will be recovered from the contractor.
24.
The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such
activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.
25.
The security deposit will be refunded only after the successful completion of contract after producing the
clearance certificates of VAT, Income Tax, etc. If there is any liabilities outstanding in this respect to the Govt. that will be
adjusted from the security deposit of the contractor.

Remarks:— If the Tender/Auction could not be conducted on the notified date due to any other reason the Tender/
Auction shall be conducted on 24-7-2014 at 3 p.m. at the same place. In that case tender forms will be
issued till 1 p. m. on 24-7-2014 and the sealed tenders will be accepted till 2 p. m. on 18-7-2014.

Incomplete tenders/re-tenders, or tenders/re-tenders

re-tenders will be opened at 3.30 p. m. on the same day in
the presence of those tenderers/re-tenderers or their

the Divisional Forest Officer, Timber Sales Kozhikode or
an officer authorized by him. The Divisional Forest Officer,
Timber Sales, Kozhikode reserves the right to exclude any
work postponed to another notified date and also to reject
any tender/re-tender without assigning any reason
thereof. If the tender/re-tender date happens to be a
holiday, or the tender/re-tender could not be conducted
on the notified date, due to any reason, the tender/
re-tender will be conducted at the same place and time on
the next working day, as per the same conditions.
If the tender/re-tender could not be conducted on
the said date/dates, tender/re-tender for the works will be
conducted at the above place and time with same
conditions on 23-7-2014. If tender/re-tender could not be
conducted even on this date necessary tender/re-tender
for such works will be conducted with same condition at
same place and time on 29-7-2014. Tender/re-tender for
balance works, if any will be conducted on 6-8-2014 and
tender/re-tender for remaining works, if any, will be
conducted on 13-8-2014 and tender/re-tender for remaining
works if any will be conducted on 19-8-2014 at the same
place and time as per same conditions.
Cost of tender/re-tender forms in respect of works
with PAC from ` 5,000 to ` 50,000 shall be ` 300+ VAT
and in respect of works with PAC of ` 50,001 to 10 lakhs
shall be ` 0.20%+ VAT of the cost of the work rounded
to the nearest multiple of 100 subject to a minimum of
` 400+ VAT and maximum of ` 2,500+ VAT. All existing
rules, regulations, directions etc. prescribed by Kerala
PWD and Kerala Forest Department in respect of civil
works shall be applicable for this tender/re-tender also.
Before commencing work or within a week after the
date when acceptance of the tender has been intimated
to him, the tenderer shall deposit a sum sufficient to make
up the balance of 5 (five) per cent. of the probable value
of contract which together with the Earnest Money
Deposited shall be treated as security for the proper
fulfillment of the same and shall execute an agreement for
the work in the PWD schedule form. If he falls to do this
or in the case of PWD contracts not maintain as specified
progress (to be specified in each case in the tender
schedule) the Earnest Money Deposit and security
deposit shall be forfeited to Government and fresh tenders
shall be called for or the matter otherwise disposed off. If
as a result of such measures, due to the default of the
tenderer to pay the requisite deposit, sign the contracts
or take the possession of the work, any loss to
Government due to the same will recovered from him as
arrears of revenue, but should it be saving to
Government, the original contract or shall have no claim
whatever to the difference. Recoveries on this or any
other account will be made from the sum that may be due
to the contract or on this or any other subsisting
Contracts under the Revenue Recovery Act, or otherwise
the Government may decide.

It is hereby notified for the information of the public
that the department vehicles that were used in Muthanga
Range and condemned and shown in the table below will
be sold in tender-cum-auction sale on 30-7-2014 by the
Deputy Conservator of Forests & Wildlife Warden,
Wayanad Wildlife Division, Sulthanbathery or an officer
authorized by him. The tender form will be issued from
the officer of the Wildlife Warden, Wildlife Division,
Sulthanbathery upto 12.30 p. m. on all working days from
22-7-2014 to 30-7-2014 on remitting the Cost + VAT.
Separate tenders should be submitted for each vehicle.
The filled up and sealed tender with sufficient EMD can
be submitted upto 1 p. m. on 30-7-2014. Subsequently, the
auction sale of the vehicles will be conducted at 3 p. m.
on the same day at the office of the Wayanad Wildlife
Warden, Sulthanbathery and the tenders will be opened
after completion of the aution sale. The sale of vehicle
will be knocked down in the name of those who offers
highest amount in the auction/tender. The successful
bidders/tenderers have to remit 50% of the highest amount
offered on the day.
In case, the notified date ie, 30-7-2014 happens to be
public holiday, the tender-cum-auction sale will be
conducted on the next working day at the notified place
and time, as per the same conditions. If this sale of all or
any of the vehicle could not be conducted on the day,
the tender-cum-auction sale of such vehicle will be
conducted on 6-8-2014 at the same place and time, as per
the same conditions mentioned above. If the sale could
not be conducted on this day also, it will be again
conducted on 13-8-2014, if the sale could not be
conducted on this day also, it will be conducted on
20-8-2014, if the sale could not be conducted on this day,
it will be again conducted on 27-8-2014 at the same place
and time as per the same conditions. The Deputy
Conservator of Forests & Wildlife Warden, Wayanad
Wildlife Division, Sulthanbathery have the powers to
exclude or postpone tender-cum-auction sale of any of the
vehicle in the list.

CONDITIONS
1.
Before participating in the tender Cum/Auction

themselves of the quality of each vehicle after

Asisstant Wildlife Warden concerned. Complaints,
if any, raised after the sale regarding the quality of
the vehicle will not be entertained.

The intending tenderers/bidders should produce
either the Electoral Identity Card, Indian Passport, a
certificate from the concerned Village Officer
showing the permanent address and also signature
attested by him or any legally valid Identity Card
for getting tender form and for remitting EMD.
3.
Intending tenderers/bidders should deposit the
EMD by cash in the office of the undersigned for
participation in tender/auction.
4.
Tenderers received after the due date and time will
not be entertained.
5.
Incomplete or defective tenders will not be
considered.
6.
EMD of successful bidders will be adjusted
towards the sale value and EMD of the
unsuccessful bidders/tenderers shall be returned
after auction sale.
7.
Successful tenders/bidders have to remit 50% of
the sale value (including EMD) on the tender/
auction date. If the sale value more than EMD.
8.
If the amount offered is less than the EMD,
balance EMD will be returned on the day.
9.
Information will be sent to successful bidders/
tenders, soon on confirmation of the sale by the
competent authority.

The successful bidder/tenders should remit the

within 15 days from the date of receipt of

rent of ` 20. Further extension of time will not be
allowed. If the vehicle is not removed even within
the period, the vehicle will be sold in re-auction-
cum retender at the risk and lose of the original
tenderer/bidder. Loss including the cost of re-
auction cum retender, if any, shall be recovered
from the defaulter. He shall not have any claim on
profit, it any.
12.
Only those who submit tenders will be eligible for
participating in the auction sale.
13.
The right for accepting or rejecting any tender/bid
amount shall be vested with competent authority.
14.
If the date of auction/tender happenes to be a
public holiday, it will be conducted on the next
working day at the same place and the same time,
as per same conditions.
Post Offer
Post offers received within three days of the auction/
tender date shall only be accepted subject to the
following conditions.
(a) Post offers is entertainable only if the post
offer amount is above 10% in the case of
amount of tender/auction is more than one lakh
and only if the post offer amount is more than
20% where the bid/tender amount is less than
Rupees one lakh.
(b) Post offer with Demand Draft drawn in favour
of Wildlife Warden, Wayanad Wildlife Division,
Sulthanbathery and payable at Sulthanbathery
for the full amount offered alone shall be
entertained.
(c) A Separate agreement to the above effect
should be executed along with the post offer
on that day of submission of the post offer.
(d) Re-auction/re-tender will be conducted after
retaining the full amount deposited as per the
above condition as security deposit. The sale
shall be confirmed in the name of person who
offers highest amount in the post offer. If the
amount fetches in the re-auction/re-tender sale
is less than the amount in the post offer. The
amount deposited as per Demand Draft by the
post offerer shall be adjusted towards the sale
value, if the amount offered in the re-auction/re-
tender is more, the re-auction/re-tender shall be
confirmed in the name of such tender/bidder
and the full amount deposited to the post offer
shall be returned.
(e) All conditions of tender/auction shall be
applicable in the post offer also.
