It is hereby notified for the information of the
public that the right of collection and removal of 27
Acacia trees standing in the Medicinal Park at
Vazhappara in Naduvathumoozhy Range of Konni
division as specified in the schedule appended
below will be sold in Tender cum Auction by the
Divisional Forest Officer, Konni or any other officer
authorized by him on 13-11-2014 at 11 a.m. in the
Divisional Forest Office, Konni subject to the terms
and conditions of sale of Timber in Government
Timber Depots published in Government Gazette
No. 49, Vol. II dated 10-12-2013 vide Notification
No. Pro.(5) 43797/2013 dated 22-11-2013 of the
Addl. Principal Chief Conservator of Forests (P),
Thiruvananthapuram and also as per General
Conditions for the sale of tree growth prevailing in
the department. In case the notified date happens
to be a public holiday, the Tender/Auction will be
conducted on the next working day at the
notified place and time.
2.
The auction will be on lumpsum basis for the right
of collection and removal of 27 Acacia tree from
the
Medicinal
Park
at
Vazhappara
in
Naduvathumoozhy Range mentioned in the
schedule hereto, the marking number of which has
been specified on each tree.
3.
Intending tenderers/bidders may inspect the trees
and satisfy themselves of the quantity and quality
of the produce before participating in the Tender/
Auction. Complaints if any regarding quality and
quantity etc. received after the Tender/Auction will
not be entertained.
4.
Bidder should appear for the auction in person and
nobody will be permitted to bid on behalf of
another unless valid power of attorney is produced
prior to the commencement of Auction/Tender.
5.
A contractor of Konni Division or the adjacent
Divisions engaged in timber extraction will not be
allowed to participate in the Auction/Tender.
6.
Intending tenderers/bidders should produce a
certificate from the concerned Village Officer
showing their permanent address and duly attesting
their signature while remitting Earnest Money
Deposit.
7.
The successful Tenderers/Bidders should give an
undertaking that he is not related to any officer
having control of the trees and that he is not a
contractor engaged in timber extraction of this or
any adjacent divisions. If it is noticed that he has
violated this conditions, it shall result in
cancellation of the contract and resale of the trees
at his risk and loss.

8.
No petition or post offer received after seven days
of the conduct of the tender/auction sale and post
offer which is not advantageous by more than 10%
of the original offer where the bid amount is
One lakh and above, and more than 20% where the
original bid amount is less than One lakh will
ordinarily be considered. The post offerer will
comply with following terms.
(a)
Offer should be made within seven days of
Tender/Auction failing which the offer will not
be considered.
(b)
Offerer should remit double the amount paid
by the successful Tenderers/Bidders on the
Tender/Auction date.
(c)
The remittance should be made by the Chalan
or Bank Deposit and the bank receipt should
be produced before the Divisional Forest
Officer concerned within seven days from the
date of receipt of registered notice to that
effect.
The post offerer after satisfying the conditions
specified above should execute an agreement before the
Divisional Forest Officer concerned, pledging the security
deposit for the due fulfilment of the above terms. If the
post offerer satisfies the conditions, re-auction will be
conducted after giving usual publicity as per rules. In
the re-auction, if the price fetched, does not come up to
what has been offered by the post offerer, it will be
awarded to the post offerer at the amount offered by him.
If he backs out, the security amount remitted by him will
be forfeited to Government. If however, the bid amount is
above what has been offered by the post offerer, the right
will be awarded to the highest Bidder/Tenderer in the
re-auction and the amount remitted by the post offerer will
be released to him.

Further particulars can be had either from the Office
of the Divisional Forest Officer or from the Range
Officer concerned.
10.
Intending Tenderers/Bidders should deposit an
Earnest Money Deposit of ` 10,000 (Rupees Ten
thousand only) for participating in the Tender/
Auction.
11.
The successful Tenderer/Bidder has to remit 35%
sale value on the Tender/Auction date. If this 35%
value exceeds ` 1,00,000, ` 1,00,000 will be remitted
on auction date itself and balance part value has to
be remitted in the Sub Treasury, Konni within 7
working days through a countersigned chalan issued
from this office and the receipted chalan submitted to
this office. If he fails to remit this amount, the
amount remitted will be forfeited to Govt. and the
trees will be re-auctioned at his risk and loss.

If the value fetched in the resale/re-tender is less
than that was obtained in the original Tender/
Auction, the difference amount together with all
incidental expenditure for fixing up of the resale
including notification charges as assessed by the
Divisional Forest Officer concerned will be
recovered from the defaulting Tenderer/Bidder
through legal means the force including Revenue
Recovery Act.
13.
The participating Tenderer/Bidder have rights only
for collection and removal of enumerated 27 Acacia
trees and he will not have any right for removing
other trees.
14.
The successful Tenderers/Bidders have to pay VAT,
FDT, Income Tax etc. at the rate prevailing from
time to time.
15.
The successful Tenderers/Bidders should execute
an agreement on a Stamp Paper worth ` 100 after
the intimation of confirmation of sale.
16.
The confirmation of the Tender/Auction sale will
ordinarily be communicated to the party concerned
as early as possible. Within 15 days from the date
of intimation of the confirmation the successful
Tenderers/Bidders shall remit the balance sale value
and Forest Development Tax (5%), VAT (14.5%) and
Income Tax (3%) at the rate in force and security
deposit of 10% for the total sale value. The
successful Tenderers/Bidders should also execute an
agreement on a Stamp Paper worth ` 100. In case
of failure to remit the amount within 15 days,
extension shall be granted by the Divisional
Forest Officer for 15 days subject to the realization
of 12% annual penal interest. Further extension
for 15 days shall be granted by the Divisional
Forest Officer subject to the realization of 24%
annual penal interest. In case of failure to remit the
amount within the extended period further extension
for 15 days by the Chief Conservator of Forests
and 15 days by the Additional Principal Chief
Conservator of Forests shall be granted subject to
the realization of penal interest at 24% and 48%
per annuam respectively.
17.
The period of contract will be 60 days from the
date of intimation of confirmation. No extension of
period of contract shall be ordinary granted. Under
very special circumstances, for good and sufficient
reasons, the Divisional Forest Officer and the Chief
Conservator of Forests concerned may grant
extension of time for one month and two months
respectively on realization of penalty of ` 500
per tree each month for completion of the work.

If the Tenderers/Bidders fail to remove the entire
produce within the above extended period, the remaining
trees as per the agreement will be forfeited to Government
and disposed off seperately and the Tenderers/Bidders
shall not have any right on the produce confiscated to
Government.
18.
The license for removal of Acacia, tree shall be
issued only on the basis of the prevailing norms.
19.
The contractor/his agent shall enter the forest area
only after getting the written permission from the
Divisional Forest Officer, Konni/Forest Range
Officer, Naduvathumoozhy.
20.
The contractor will be liable for any damage or loss
caused to other trees in the plantation or reserve.
21.
The contractor will be liable for all the illegal
activities occurred within 0.4 Km. perimeter of the
coupe. Any such activities noticed shall be reported
to the forest officials by the contractor or otherwise
the contract will be cancelled.
22.
The security deposit will be refunded only after the
successful completion of contract after producing
the clearance certificates of VAT, Income Tax, etc. If
there is any liabilities outstanding in this respect to
the Government, that will be adjusted from the
security deposit of the contractor.
23.
All common conditions regarding sale of trees are
also applicable to this Tender/Auction.
