CORRIGENDUM

No. DC/DIST & Sale of Vessels/2014.

31st August 2015.

The following Corrigendum to The Cochin Port Trust

(Distraint or Arrest and Sale of Vessels) Regulations 2014

is issued to the Notification No. DC/DIST & Sale of

Vessels/2014 dt. 17th July, 2014 published on 26-8-2014

and 2-9-2014 in the Kerala Gazette.

1.

In the first paragraph of the Notification the

words “Port of ” shall be inserted after the words

“Trustees of” and the words “by Section” shall be

substituted by the words “under Section”.

2.

In Regulation 3, clause (ii), the word “Cochin”

shall be inserted before the word “Port”.

In clause (iv), the word “due” shall be

substituted by the word “dues” and

Insert clause (vi), “the Board” or “the Board of

Trustees” means “the Board of Trustees of Port of

Cochin”

3.

In Regulation 4, Sub regulation (1) , the word

“Finance” shall be substituted by the word

“Financial”.

In Sub-regulation (4), the word “distrain”

shall be substituted by the word “distraint”.

In Sub-regulation (7), the word “distress” shall be

substituted by the word “distraint” and

In Sub-regulation (8), the words “Surface

Transport” shall be substituted by the word

“Shipping”

In Regulation 5, Sub regulation (4), the words

“The Advocate Commissioner appointed by

Hon’ble

High Court of Kerala or Board

of

Trustees, Cochin Port Trust” shall be

substituted by the words “the Deputy Conservator

or any person duly appointed by any competent

court”.

In Sub-regulation (6), the words “to paid by the”

shall be omitted and the words “payable by a”

shall be substituted.

In Sub-regulation (9), the words “the Registrar of

the Hon’ble High Court or Advocate Commissioner

appointed by Board of Trustees, Cochin Port

Trust” shall be substituted by the words “any

person duly appointed by any competent court”

In Sub-regulation (10), 2^nd line, the words “of

sale order” shall be inserted after the words “the

date” and the words “of work” shall be inserted

after the word “completion” and the words

“Hon’ble High Court” shall be deleted.

In Regulation 6, Sub-regulation (1), the word “to”

shall be substituted with the word “on”.

In Sub-regulation (3), the words “an account”

shall be substituted by the words “on account”.

In Form No. I, Paragraph 2, the word “Trust”

shall be substituted as “Trusts” and the word

“Distrain” shall be substituted by the word

“Distraint”.

7.

In Form No. II, Paragraph 2, the word “conformed”

shall be substituted by the word “conferred” and

the word “distrained” in the 3^rd line and in the

4th line shall be substituted by the word “distraint”

In Paragraph 3, in 3^rd line, the word “said” shall be

inserted before the word “vessel” and “the

Advocate Commissioner appointed by Hon’ble

High Court or Board of Trustee” shall be

substituted by the words “any person duly

appointed by any Competent Court or the

Deputy Conservator,” and in 5th line, the word

“vested” shall be substituted by the word

“conferred”.

In Form III-A, Paragraph 1, the words “by

section” and “invite” shall be substituted by the

words “under section”, and “invites” respectively.

In paragraph 2, in the 3^rd line the word “build”

shall be substituted by the word “built”.

In paragraph 6, in the 2^nd line, the word ‘that’

shall be substituted by the word ‘the’. In 5^th line

the words “will be” shall be inserted before the

word ‘forfeited’ and the words “risk of” shall be

substituted by the words “risk and” and in 8th

line, the word “will” shall be inserted before the

word “be”

In Paragraph 10, in 2^nd line, the word “Major”;

shall be substituted by the word “Cochin” and

In Paragraph 13, in the 1^st line the word “by”

shall be substituted by the word “with”.

9.

In Form No. III-B, Paragraph 1, the word “laying”

shall be substituted by the word “lying”.

In Paragraph 2, in the 3^rd line the word “build”

shall be substituted by the word “built” and

In Paragraph 9, in the 3^rd line the word “of”

shall be inserted before the word “Kerala”.
