NOTIFICATION

No. 1769/2016/KAT.

Dated, Thiruvananthapuram, 20th July 2016.

Whereas, for the smooth functioning of Kerala

Administrative Tribunal, it is expedient in the interest of

justice to issue the following order:

In exercise of the powers conferred under

sub-section (6) of the section 5 of the Administrative

Tribunals Act 1985, the Chairman, Kerala Administrative

Tribunal hereby order that a Judicial Member shall

function as a Bench consisting of a single Member and

exercise all the jurisdiction, powers and authority of the

Tribunal, whenever the Member (Admn.) is unavailable to

function as a Bench.

Explanatory Note

(This does not form part of the notification, but is

intended to indicate its general purport.)

Whenever Member (Admn.) of the Tribunal becomes

unavailable (on account of retirement or availing leave),

on every such occasion notification under section 5 (6) of

the Administrative Tribunals Act is to be published. It

has been felt that it will be convenient if a general

notification is published specifying that whenever Member

(Admn.) is unavailable then a Judicial Member of Kerala

Administrative Tribunal will function as indicated in this

notification. Thus, it will not be necessary to publish

notifications each time when the Member (Admn.)

becomes unavailable.

The notification is intended to achieve the

above object.
