Section, 2006 Kaithakkapparappu Acacia Plantation in Aryanadu-Palode Section of Paruthipally Range, 2007 Ozhukupara

Acacia Plantation in Pachamala Section of Palode Range and Teak billets collected from 1950 Teak Plantation

Punnamanvayal in Chittar North Section of Kulathupuzha Range of Thiruvananthapuram Division will be sold through

e-Auction shown in the schedule, by M/s. MSTC Ltd., Bangalore, subject to the conditions published by the M/s. MSTC

Ltd. and in the Kerala Gazette No. 49 Vol. IV dated 15-12-2015 vide Notification No. Pro.(4) 29243/13, dated 21-11-2015 of

the Additional Principal Chief Conservator of Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest

Department. Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date

of e-Auction and that could be lotted immediately before the e-auction will also be placed in the e-auction. Those who

wish to participate have to remit an amount of ` 20,000 for billets as EMD as e-payment before the e-auction through

MSTC limited. Registration number of the bidder should be entered while remitting the EMD amount. Successful bidders

will have to remit 35% of the bid amount within 7 days after obtaining the conformation of e-auction sale. If any

successful bidder fails to remit the 35% amount within the stipulated time, the EMD will be forfeited to Govt. and which

is non-refundable under any circumstances. If any of the banks demands a commission for converting the Demand Draft

to cash, the bidder will have to suffer the commission charges. Successful bidders will have to remit the balance value,

Forest Development Tax, GST, Income Tax and such other taxes that are prevailing at the time of e-auction within the

stipulated time limit.

e-Auction documents and connected records are available in the website: www.mstcecommerce.com. The Earnest

Money Deposit should be submitted on e-payment/e-treasury/Demand Draft/MSTC through the internet online banking of

SBI or through NEFT for other banks. For submission of e-auction visit the website: www.mstcecommerce.com.

All bids/e-auction documents are to be submitted online only and in the designated online cover(s)/envelope(s) on the

www.mstcecommerce.com website and e-auction documents submitted manually/through post will not be entertained.

Online e-Auction/bids are to be accompanied with relevant documents. e-Auction/bids received online without the

scanned copies of relevant documents will not be considered and shall be summarily rejected. Any further clarification

on this e-Auction can be obtained from NIC/the e-Auction Helpdesk number available in the www.mstcecommerce.com

website and from the office of the Divisional Forest Officer, Thiruvananthapuram during the office hours. The details

The bidders who wish to participate in the e-auction should produce a certificate showing the permanent address

and signature of the bidders duly attested by the concerned Village Officer or any other approved identity documents

along with the EMD through online. Those who do not produce any approved Identity Card or certificate will not be

eligible to participate in the e-auction.

Intending persons may ensure the quantity and quality of materials put up for e-auction before the commencement

of the same and no complaints will be entertained after the e-auction. In case any Govt. Department requires any of the

materials put up for the e-auction, the quantity remaining after their selection only will be

re-auctioned. The quantity that may become ready for sale after the publication of this notification will also be included

in the e-auction. Any further notification to the sale conditions that may be issued by the Government after the issuance

of this notification will also be applicable to this e-auction. The unsold materials in the e-auction will be

re-auctioned.

Vatta Trees in the 1968 Match Wood Plantation at Savacotta (46 Ha.) Bit-I and 1969 Match Wood Plantation at

Koorampara in North and South Section of Achencovil Range under Achencovil Division as specified in the schedule

appended below will be sold in Tender/Auction by the Divisional Forest Officer, Achencovil or any other officer authorized

by him on 7-3-2018 at 3 p.m. in the Divisional Forest Office, Achencovil subject to the terms and conditions of sale of

Timber in Government Timber Depots published in Government Gazette No. 43, Vol. V dated

1-11-2016 vide Notification No. Pro.(4) 26243/13 dated 26-9-2016 of the Addl. Principal Chief Conservator of Forests (P),

Thiruvananthapuram and as per General Conditions of the sale of tree growth prevailing in the Department and also

subject to the following conditions. The successful tenderer/bidder should remit 35% of the sale value on the auction date

itself and has to remit GST, FDT, Income Tax and other taxes and fees prevailing as per law.

1. The tender/auction will be conducted on a lumpsum basis for the right of collection and removal of entire Elavu

and Vatta Tree growth from the above Plantation mentioned in the schedule here to the area of which has been surveyed

and demarcated on the ground.

2. Intending bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before

participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction

will not be entertained.

3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless

valid power of attorney is produced prior to commencement of Auction/Tender.

4. A supply contractor of Achencovil Division or the adjacent Divisions will not be allowed to bid in the

Auction/Tender.

5. Intending tenderers/bidders should produce a certificate from the concerned Village Officer showing their

permanent address and duly attesting their signature along with Earnest Money Deposit through online.

6. The successful Tenderers/Bidders should give an undertaking that he is not related to any officer having control

of the work and that he is not a supply contractor of this or any adjacent divisions. If this is proved otherwise it shall

result in cancellation of the contract and resale of the coupe at his risk and loss.

7. No petition or post offer received after seven days of the conduct of the tender/auction sale and post offer

which is not advantageous by more than 10% of the original offer where the bid amount is Rupees One lakh and above

and more than 20% where the original bid amount is less than One lakh will ordinarily be considered. The post offerer will

comply with following terms.

(a)

Offer should be made within seven days of Tender/Auction failing which the offer will not be considered.

(b)

Offerer should remit double the amount paid by the successful Tenderers/Bidders on the Tender/Auction date.

(c)

The remittance should be made by Chalan or Bank Deposit and the Bank receipt should be produced

before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice

to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional

Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms. If the post offerer

satisfied the conditions, a re-auction will be conducted after giving the usual publicity as per rules. In the

re-auction of the price fetched, does not come up to what has been offered by the post offerer, it will be awarded to the

post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forefeited to

Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to

the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

8. Further particulars can be had either from the Office of the Divisional Forest Officer or from the Range Forest

Officer, Achencovil.

9. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of ` 50,000 (Rupees Fifty thousand only)

for each plantation for participating in the Tender/Auction.

10. The successful bidder have to remit 35% sale value on the tender/auction date. If this 35% value exceeds

` 1,00,000, ` 1,00,000 should be remitted on the tender/auction date itself and balance value have to be remitted within 7

working days on through the countersigned chalan issued from this office and submit the chalan receipt in time. If he fails

to remit this amount, the EMD will be forfeited to Govt. and the standing tress in the plantations will be

re-auctioned at his risk and loss.

11. The participating Tenderers/Bidders have rights only for collection and removal of enumerated standing Elavu and

Vatta trees only and will not have right for removing trees like Teak, Rose Wood, Hard Wood etc.

12. The successful Tenderers/Bidders should execute a bounded agreement on a Stamp Paper worth ` 200 after the

completion of the Tender/Auction.

13. The successful Tenderers/Bidders have to pay GST, FDT, Income Tax etc. at the rate prevailing from

time to time.

14. The confirmation of the Tender/Auction will ordinarily be communicated to the party concerned as early as

possible. Within 15 days from the date of intimation of the confirmation the successful bidder shall remit

rd of the balance sale value and 5% Forest Development Tax, GST and Income Tax at the rate in force on e-payment.

The successful bidder should execute an agreement on a Stamp Paper worth ` 200 after remitting security deposit of 10%

for the total sale value. In case of failure to remit balance  amount within 15 days extension shall be granted by the

Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall

be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the

amount within the extended period further extension for 15 days by the Chief Conservator of Forests and 15 days by the

Additional Principal Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and

48% respectively. But all the extension periods mentioned above will be within the original contract period.

15. The balance 2/3rd sale value should be remitted in two equal installments by the successful bidder. The first

installment should be remitted on e-payment within 15 days from the date of agreement and the second installment within

30 days from the date of agreement or within the contract period whichever is earlier. If the successful bidder fails to remit

the above  rd amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by

Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of

Forests concerned and further extension for 30 days by the Additional Principal Chief Conservator of Forests concerned

by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the

original contract period.

16.

If the successful tenderer/bidder fails to remit the dues and execute agreement within the extended period as

mentioned above, all the amount remitted by the tenderer/bidder will be forfeited to Govt. and cancel the said tender/

auction and the trees will be sold through re-tender/re-auction at the risk and loss of the first bidder.

17.

If the value fetched in the resale tender/auction is less than that obtained in the original tender/auction the

difference between them together with all incidental expenditure to fixing up of the tender/auction including notification

charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting bidder through legal

means including Revenue Recovery Act in force.

18. The period of contract will be 60 days from the date of intimation of confirmation. No extension of period of

contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons,

the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month

and two months respectively on realization of penalty or penalties for completion of each work for each month

mentioned below:

(a) For enumerated trees and balance unfelled per hectare or fraction thereof —` 750 per hectare.

(b) Unremoved registered logs and unregistered logs—` 100/m³ or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or

unremoved during the original contract period. The penalty for the first month shall be realized as the above rates; double

the rate for the second month and three times of the original rate for the third month shall be realized. If the bidder fail to

remove the entire produce within the above extended period, the whole timber and firewood collected by the bidder as per

the agreement will be forfeited to Government and the bidder shall not have any right on the produce confiscated to

Government.

In the above circumstances the balance work to be executed by the bidder shall be completed departmentally and

all the loss sustained to Government in this regard shall be realized from the bidder.

19.

The license for removal of Elavu and Vatta Timber and Firewood collected in the coupe should be issued only

on the basis of the prevailing norms.

20.

The contractor/his agent shall enter the coupe only after getting the written permission from the Divisional

Forest Officer, Achencovil/Range Forest Officer, Achencovil.

21.

The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a

width of 2 meters and keep the cairns intact.

22.

The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

23.

The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe if

requested by the contractor at his risk. But if the collected timber/firewood are not removed within the agreement period

due to

unforeseen situation/climate, a ground rent @ ` 250/Ha. will be recovered from the contractor.

24.

The contractor will be liable for all the illegal activities occurred within 0.4 km. perimeter of the coupe. Any such

activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.

25.

The security deposit will be refunded only after the successful completion of contract after producing the

clearance certificates of GST, Income Tax, etc. If there is any liabilities outstanding in this respect to the Govt. that will be

adjusted from the security deposit of the contractor.

26.

All the amount as per the tender/auction conditions due to Govt. should be remitted by the successful tenderer/

bidder as and when required by the Divisional Forest Officer. If the bidder fails to remit the Govt. dues as demanded by

the concerned officers, such dues will be realized from the bidders as arrear of land tax as per the existing Revenue

Recovery Act, or by any other suitable means taken by the Divisional Forest Officer, Achencovil.

CONDITIONS

1. Transplant teak seedlings into polythene cover of

size 20x40cm are to be filled with top soil, sand &

cow dung in ratio 3:1:1. These seedlings should

be maintained properly to attain minimum, 30cm

height and kept ready for distribution from

1st June 2019.

2. It is the responsibility of the successful tenderer

to select the ideal site with appropriate facilities

for irrigation and other maintenance facilities to

the seedlings in consultation with forest officials.

3. Distribution of seedlings must be carried out from

1st June to 31st July 2019 and tenderer is liable

for the protection of nursery till the completion of

the seedling distribution.

4. All conditions in the G.O. (M.s.) No.26/17/F&WLD

dtd. 20-5-2017 will be applicable to this tender.

5. Before submitting tender, tenderer should inspect

the area of concerned nursery and quote rate in

DD or drawn at SBI, Konni Branch or fixed

7. SSI units are exempted from remitting EMD. Such

units should produce necessary eligibility

certificates obtained from the Manager, District

Industries Centre concerned.

8. The successful tenderer should remit l0%

amount of the PAC including the EMD as

security deposit for the contract; and enter into

an agreement with the Forest Department within

7 days from the date of intimation regarding the

acceptance of the tender.

9. After completing the work satisfactorily the

security deposit shall be released to the tenderer

on production of necessary tax clearance

certificate.

10. The tenderer is liable to follow Kerala Store

Purchase Rules.

11. All conditions stipulated as per PWD, Kerala

from the office of the undersigned on application in

writing and on payment of the cost of tender form either

in cash or by money order (not refundable) up to 1 p. m.

on 8-3-2018. The filled up and sealed tenders will be

recieved at the office of the undersigned up to

3 p. m. on 8-3-2018 and will be opened by the

undersigned or an officer authorized by him, on the same

Tender Conditions

Tender form and other details can be obtained from Assistant Conservator of Forests, Social Forestry Division,

Thrissur on payment of cash or by Demand Draft drawn in favour of Assistant Conservator of Forests, Social

Forestry Division, Thrissur payable on any Scheduled/Nationalized Bank towards cost of tender Form. The

cost of tender form can also be downloaded from the official website of Kerala forest Department and if the

forms are downloaded from the website the cost of tender documents should be attached as DD from a

Nationalized/Scheduled bank as mentioned above, along with Part 2 tender. The cost of tender

forms once paid is not refundable on any account, nor will the amount be adjusted towards cost of

any other tender forms.

The tender form shall be used only by the person in whose name it is issued and for the work specified in

the schedule attached to the tender form.

Before submitting the tender, the tenderer is expected to study and scrutinize all the conditions in the

agreement to be executed, the draft of which can be had for perusal at the Divisional Forest Office on any

working day during office hours. They are also requested to study the detailed tender conditions attached to

the tender document. No plea of ignorance of the agreement conditions received after putting in the tender

will be entertained.

Before submitting the tender the tenderer shall visit the area of work to study all the field conditions and

nature of work and quote his rate accordingly. No enhancement in rate due to any reason will be entertained

thereafter.

The tenderer shall quote in the appropriate column in the tender a firm percentage of the basic rate per

Ha./Nos. in figures as well as in words also. Lower of the same only be considered valid and shall be binding

on him/her. If the Kerala Forest Department feels that the total amount quoted or item wise rate of any of the

item quoted is unworkable due to variance to the lower side to an abnormal level with Kerala Forest

Department estimated rates, the tenderer may be required to furnish satisfactory explanation on the above

respect. In such an event, the Kerala Forest Department has the option to collect a special/extra security

deposit to the tune of 10% of the quoted amount subject to a maximum of ` 30,000 from the tenderer before

issuance of confirmation orders. If the explanation furnished is not found satisfactory or no explanation is

furnished, the Kerala Forest Department has the right to deny the offer of work to the tenderer even though

he/she is the lowest tenderer.

The tenderer shall submit the filled up tender form together with all the pages in tact in sealed cover

addressed to “The Assistant Conservator of Forests, Social Forestry Division, Thrissur” and superscribed

“Tender for Name of work.....................in .............Range so as to reach him in his office at specified date and

time. If the date fixed for acceptance of tender happens to be holiday the tenders will be accepted on the next

working day at the same hour.

Tender received after the specified date and time or received without the requisite enclosures or tenders not

written up proper order or form will not be honored.

Each tender shall be accompanied by a demand draft of a Nationalized/Scheduled Bank for

Rs..................(rupees.................) in favour of Assistant Conservator of Forests, Social Forestry Division, Thrissur

as Earnest Money Depost for the work.

All the corrections in the tender form shall be initialed by the tenderer himself.

10.

The tenders received in due time will be opened by the Assistant Conservator of Forests or his deputy at his

office in the presence of such of the tenderers present on that occasion.

11.

The lowest tender ordinarily be accepted, but the authority competent to accept the tender reserves to himself

the power of accepting or rejecting any tender without assigning any reason thereof.

12.

No tenderer will be permitted to withdraw his offer within three months from the date of opening of the

financial bid.

13.

The tenderer whose tender is accepted will be informed regarding acceptance of his tender by a confirmation

order issued by the registered letter bearing the address mentioned in the tender. The successful tenderer,

within three days of receipt of confirmation of his tender, shall have to execute an agreement in the prescribe

form on a proper non Judicial Stamp Paper (worth ` 200) to be supplied by him at his cost.

If the contractor fails to execute the agreement the tender will be cancelled and the Earnest Money Deposit

submitted by the tenderer shall stand forfeited to the Kerala Forest Department. The work will be retendered

at the risk and cost of the tenderer or through any other manner (Including through the next higher tenderer).

The loss if any, to the Govt. consequent to the default, if not paid by the defaulter within a reasonable time

specified by the Assistant Conservator of Forests, shall be treated as arrears on public revenue to be

recovered from the defaulter under the provisions of the Kerala Revenue Recovery Act 1968 and in such

other manner as the Govt. may deem fit. The defaulter however will not be entitled for gain, if any.

14.

The successful tenderer while signing the agreement shall furnish a security deposit for an amount equal to 10

percent of the total probable amount of contract, limited to a maximum of ` 5,00,000. The security deposit will

be released only after the successful competition of the contract work and after producing the Non Liability

Certificate from the concerned officers.

15.

The successful tenderer shall give an undertaking at the time of execution of agreement that he shall not sell,

mortgage or otherwise alienate the properties covered by the solvency certificate during the currency of the

contract.

16.

The post offers and representations sent, after receipt of tender in respect of the work shall at no account be

considered.

17.

The EMD of the unsuccessful tenderers will be returned as soon as possible after the tenders are finalized.

18.

The quantities of work shown in the schedule are approximate and it may vary on actual execution of work.

19.

The quantity shown in the tender schedule are approximate. The actual extend of the contract area may vary

as per the final survey report, which will be binding on the successful tenderer.

20.

The payment shall be made after completion of the work.

21.

The works mentioned in the schedule should be started on 5th March 2018 and completed before

31st May 2020. No extension of time will be allowed. The undersigned has the power to change the starting

date of the work.
