ORDER

WHEREAS, Ministry of Personnel, Public Grievances and Pension, DOP & T

vide O. M. No. 14014/14/2014-AIS.I dated 21-8-2017 intimated that in the wake of

Hon’ble High court of Punjab and Haryana order dated 1-2-2010 in

CWP No. 15798/2009 in the case of Praveen Kumar, a State Civil Service Officer

of Punjab cadre Vs Union of India as confirmed by Hon’ble Supreme Court

issued notification dated 18-4-2012 for making amendment in the respective

seniority regulations for IAS/IPS/IFoS. These amendments were however made

applicable to the Select Lists prepared as per the ratio laid down in the case of

Praveen Kumar and accordingly, seniority/year of allotment of the officers

included in the said Select Lists were determined as per the amended seniority

regulations.

2. WHEREAS, consequent upon dismissal of SLP No. 4930-4931 of 2016 and

Review Petition No. 001428- 001429/2017 filed by the DoP & T in case of

F. R. Jamadar and other connected court cases filed by this Ministry, it has now

been decided to apply the amended seniority regulations prospectively i.e. w.e.f.

18-4-2012. Accordingly, Seniority/year of allotment of the IPS officers appointed

during 1-2-2010 to 18-4-2012 from the Select Lists prepared as per ratio laid down

in the Praveen Kumar case would need to be re-determined as per the

pre-amended seniority Regulations.

3. AND WHEREAS, the DoP & T vide O.M. No. 14014/14/2014-AIS-I dated

3-11-2017 has decided that seniority/year of allotment of officer appointed after

18-4-2012 against the vacancies arisen between 1-2-2010 to 18-4-2012 may be

fixed as per pre-amended seniority rules through out the cadres.

4. AND WHEREAS, DoP & T vide OM No. 14014/14/2014-AIS.I dated

22-1-2018 has also decided to count the service of the officers rendered in the

rank of Deputy SP or equivalent upto the 31st December of the vacancy year

against which he has been appointed to the IPS.

5. AND WHEREAS, the matter regarding fixation of seniority as per DoP&T

O.M. dated 21-8-2017, 3-11-2017 & 22-1-2018 were examined thoroughly and with

the approval of the competent authority it has been decided to implement the

decisions conveyed by DoP&T vide their aforesaid O.Ms.

6. AND THEREFORE, the seniority/year of allotment of officers appointed by

promotion to IPS of Kerala Cadre from the Select Lists 2008A, 2009, 2010 & 2011

has been revised in terms of pre-amended seniority rules as follows in

supersession/modefication of this Ministry’s order No. I-15011/1/2013-IPS.I dated

25-9-2014 & dated 11-10-2017 and No. I-15011/13/2014-IPS. I dated 30-7-2014.

7. As per Rule 4 of the IPS (Regulation of Seniority) Rules, 1988, the

placement of above officers in the Select List will be as under as per

Civil List-2017:—

(i)

Shri S. Surendran & A V George, shall be placed enblock below

Shri K P Phillip (SPS:2004), the only SPS, IPS officer of 2004 batch

to the Kerala Cadre of IPS and above Shri Neeraj Kumar Gupta,

(RR:2005), the senior direct recruit IPS officer of 2005 batch of

Kerala Cadre.

(ii)

Shri Mohamed Iqbal, K K Jayamohan, M Mohammed Shabeer,

G Somasekhar, shall be placed enblock below Shri Kaliraj Mahesh

Kumar S., (RR:2005) the junior direct recruit IPS officer of 2005

batch to the Kerala Cadre of IPS and above Shri Debesh Kumar

Behra, (RR:2007), the senior direct recruit IPS officer of 2007 batch

of Kerala Cadre of IPS.

(iii) Shri V N Sasidhara, N Vijayakumar, N Ramachandran,

P N Unnirajan shall be placed enblock below Smt. Uma (RR:2007)

the junior direct recruit IPS officer of Kerala Cadre of IPS and

above Shri Putta Vimaladitya (RR:2008) the senior direct recruit IPS

officer of 2008 batch of Kerala Cadre of IPS.
