It is hereby notified that Teak Poles and Teak Billets extracted from 1966 Chittar-I Teak-Elavu

Plantation in Peringammala Section of Palode Range under Thiruvananthapuram Division will be sold through

e-auction shown in the schedule, by the Divisional Forest Officer, Thiruvananthapuram or any officer authorized by him,

subject to the conditions of e-auction published in Kerala Gazette No. 36 Vol. III dated 16-9-2014 vide

Notification No. Pro.(4) 29243/13 dated 21-8-2014 of the Additional Principal Chief Conservator of Forests (P)

the schedule, the quantity if any delivered to dumping sites before the date of e-auction and that could be lotted

immediately before the e-auction will also be placed in the e-auction. Those who wish to participate have to

remit an amount of ` 50,000 for Teak wood as EMD as e-payment before the e-auction through MSTC limited.

Registration number of the bidder should be entered while remitting the EMD amount. Successful bidders will have to remit

35% of the bid amount within 7 (Seven) days after obtaining the conformation of e-auction sale.

If any successful bidder fails to remit the 35% amount within the stipulated time, the EMD will be forfeited to Govt. and

which is non-refundable under any circumstances. If any of the banks demands a commission for converting the Demand

Draft to cash, the bidder will have to suffer the commission charges. Successful bidders will have to remit the balance

value, Forest Development Tax, GST and Income Tax such other taxes that are prevailing at the time of e-auction within the

stipulated time limit.

The Earnest Money Deposit should be submitted on e-payment/e-treasury/demand draft/MSTC through the internet online

banking of SBI or through NEFT for other banks. For submission of e-auction visit the website www.mstcecommerce.com.

All bids/e-auction documents are to be submitted online only and in the designated online cover (s)/envelope (s) on the

www.mstcecommerce.com Website and e-auction documents submitted manually/through post will not be entertained.

Online e-Auction/bids are to be accompanied with relevant documents. e-Auction/bids received online

without the scanned copies of relevant documents will not be considered and shall be summarily rejected. Any further

clarification on this e-Auction can be obtained from NIC/the e-Auction Helpdesk number available in the

www.mstcecommerce.com. Website and from the office of the Divisional Forest Officer, Thiruvananthapuram

during the office hours. The details regarding e-Payment (Bidder’s Bank Account No. where he/she is having core

banking facility and email ID) should be submitted along with the e-Auction documents. E-Auction documents

without these details will not be accepted. Technical bid and financial bid shall be submitted in their respective

designated online covers. The Forest Department will not be responsible for any inconvenience or loss to the

Bidder while uploading/downloading the bid.

The bidders who wish to participate in the e-auction should produce a certificate showing the permanent

address and signature of the bidders duly attested by the concerned Village Officer, or any other approved identity

documents along with the EMD through online. Those who do not produce any approved identity card or

certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity and quality of materials put up for e-auction before the commencement

of the same and no complaints will be entertained after the e-auction. In case any Govt. Department requires any of the

materials put up for the e-auction, the quantity remaining after their selection only will be re-auctioned. The quantity that

may become ready for sale after the publication of this notification will also be included in the e-auction. Any further

notification to the sale conditions that may be issued by the Government after the issuance of this notification will also be

applicable to this e-auction. The unsold materials in the e-auction will be re-auctioned.

and Pathanapuram Ranges of Punalur Division specified in the schedule appended below will be sold in e-auction by the

Divisional Forest Officer, Punalur or any other officer authorized by him on 15-10-2019 at 11 a. m. in the Divisional Forest

Office, Punalur subject to the terms and conditions of sale of Timber in Government Timber Depots published in

Government Gazette No. 43, Vol. V dated 1-11-2016 vide Notification No. Pro(4) 26243/13 dated 26-9-2016 of the Addl.

Conditions

1.

The e-auctions will be conducted on the basis of rate quoted for stacked volume on harvest ie., stacked ton with

bark. If the bidder wants stacked tonne without bark, the rate will be 122% of the rate quoted. The bid shall be

fixed for the bidder who quotes higher rate per stacked tonne with bark. The felling, conversion, transportation

and stacking shall be borne by the bidder. One stacked tonne means a stack with volume of 2 m³.

2.

The butt end having 70 cm middle girth (under bark) for Acacia auriculiformis and 80 cm middle girth (under bark)

for Acacia mangium for a minimum length of 2.50 m (for both species) shall be kept by the bidder in the

plantation itself which are to be transported by the department for sale.

3.

Intending bidders may inspect the plantations and satisfy themselves with the area of plantation, quantity and

quality of the produce before participating in the e-auction. Complaints if any regarding quality and quantity etc.

received after the e-auction will not be entertained.

4.

Intending bidders should produce a certified copy of Adhar or a certificate from the concerned Village Officer

showing their permanent address and duly attesting their signature for individual and a certified copy of

registration or license for firms along with Earnest Money Deposit through online.

5.

The successful bidders should give an undertaking that he is not related to any officer having control of the

work. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at the risk

and loss of bidder.

6.

No post offer is permitted in the e-auctions.

7.

Intending Bidders should deposit an Earnest Money Deposit (EMD) of ` 50,000 (Rupees Fifty Thousand only) for

each plantation for participating in the e-auction.

8.

The participating bidders have the rights only for collection and removal of standing Acacia auriculiformis and

Acacia mangium trees with in the specified area handed over by the Forest Department officials, except the butt

ends kept in the plantations it self for transporting to nearest depots and will not have any right for removal of

any other tree species like Teak, Rosewood and other Hardwoods etc. standing in the plantation.

9.

The successful bidders should execute a preliminary agreement on a stamp paper worth ` 200 at the time of

auction.

10.

The successful bidders have to pay FDT (Forest Development Tax), GST, Income Tax, etc. at the rate prevailing

from time to time.

11.

The successful bidder shall execute an agreement on a stamp paper worth 0.1% of the total value after remitting

the 50% sale value and 10% of security deposit within 15 days from the date of intimation of confirmation.

The security deposit shall be in the form of fixed deposit pledged in favour of the Divisional Forest Officer,

Punalur from any Nationalized bank. The bidder will be permitted to commence the work and transport the yield

collected from the plantations only after the above payment and execution of agreement. Sale value will be

calculated on the basis of the assessed and expected volume of yield of the plantation.

12.

The successful bidder have to pay 50% of the total sale value, 5% FDT, GST and Income Tax (calculated on the

basis of the assessed and expected volume and quoted rate by the successful bidder) within 15 days from the

date of intimation of confirmation of the e-auction. In the case of failure to remit the 50% of sale value within

15 days, extension for 15 days shall be granted by the DFO subject to the realization of the 12% penal interest

(for 50% of sale value). Further extension for 15 days shall be granted by the DFO subject the realization of

24% penal interest (for 50% of sale value). In the case of failure to remit the amount within the extended period,

further extension of 15 days shall be granted by the Chief Conservator of Forests, Southern Circle, Kollam subject

to the realization of 36% penal interest (for 50% of sale value). Further extension for 15 days shall be granted by

Chief Conservator of Forests, Southern Circle, Kollam subject the realization of 48% penal interest (for 50% of sale

value). Failing this the bid shall be cancelled and all the money including the EMD remitted by the bidder will be

forfeited to the Government.

13.

The remaining 50% of the sale Value based on the assessed quantity shall be remitted before transporting 50% of

the estimated yield. If the successful bidder fails to remit the balance 50% of sale value, all the coupe work shall

be stopped at once and action shall be initiated to cease the contract and forfeit security deposits to Government.

However, the successful bidder shall be given an extension for remitting the amount for 15 days by the DFO on

request subject to the realization of 12% penal interest and 30 days by realizing penal interest of 24% by the

Chief Conservator of Forest Southern Circle, Kollam. But all the above extension periods will be within the original

contract period.

14.

If the successful bidder fails to remit the dues within the extended period as mentioned above, all the amount

remitted by the bidder including the EMD will be forfeited to Government and the said auction will be cancelled

and the collected materials/trees will be sold through re-auction at the risk and loss of the Bidder.

15.

If the value fetched in the re-auction is less than that obtained in the original auction the difference between

them together with all incidental expenditure for fixing up of the auction including notification charges as assessed

by the Divisional Forest Officer concerned will be recovered from the defaulting bidder through legal means

including Revenue Recovery Act in force. If the value fetched in the re-auction is more than that obtained in the

original auction, the first bidder will not be eligible for any claim due to this.

16.

The total quantity arrived and collected at the end of extraction will be calculated and intimated to the bidder

immediately on completion of the work. In case the arrived quantity is higher than that of original estimated

quantity the balance amount for the additional quantity shall be paid by the bidder within 7 days of intimation

from the Divisional Forest Officer, Punalur. The removal of the excess quantity will be allowed only after remitting

the full value of the quantity collected at the original quoted rate. However, the successful bidder shall be given

an extension for remitting the additional amount for 7 days by the DFO on request subject to the realization of

12% penal interest and 7 days by the Chief Conservator of Forests Southern Circle, Kollam on realization of 24%

penal interest.

17.

In case the arrived quantity is less than the original estimated quantity the balance amount will be returned to the

bidder or adjusted on receipt of his request. The estimated quantity is based on the field assessment and may

not be accurate. In case if contractor already extracted billets to the estimated quantity and the area handed over

is having more standing trees beyond the estimate quantity, the contractor should extract the same after making

necessary supplementary agreement with in the contract period and non removal of such trees will attract

forfeiture of security deposit along with recovery of loss sustained by the Government as a result of the non

removal of such trees.

18.

The period of contract will be 150 days from the date of intimation of confirmation or 31-3-2020 whichever is

earlier. No extension of period of contract shall be granted on ordinary ground. Under very special circumstances,

for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned

may grant extension of time for 15 days each on realization of penalty or penalties for completion of each work

for each month mentioned below:

(a) The balance unfelled area per hectare or fraction there of ` 5,000 per hectare.

(b) Unremoved billets ` 100/m³ or fraction thereof.

Penalty will be assessed and realized on billets which are either uncollected or unremoved during the original

contract period. The Penalty for the first extension period shall be realized at the above rates; double the rate for

the second extension period shall be realized. If the bidder fails to remove the entire produce within the above

extended period, the whole timber and firewood collected by the bidder as per the agreement will be forfeited to

Government and the bidder shall not have any right on the produce confiscated to Government.

In the above circumstances the balance work to be executed by the bidder shall be completed departmentally

and all the loss sustained to Government in this regard shall be realized from the bidder through legal means

including Revenue Recovery Act in force.

19.

The license for removal of Acacia/Mangium billets collected in the coupe shall be issued only on the basis of the

prevailing norms.

20.

The contractor/his agent shall enter the coupe only after getting the written permission from the Divisional Forest

Officer, Punalur/Range Forest Officer Anchal/Pathanapuram.

21.

The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width

of 2 meters and keep the cairns intact.

22.

The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

23.

The Divisional Forest Officer will give permission to keep the billets outside the coupe if requested by the

contractor at his risk. But if the collected billets are not removed within the agreement period due to unforeseen

situation/climate, a ground rent @ ` 250/Ha/day will be recovered from the contractor.

24.

The contractor will be liable for all the illegal activities occurred within 500 meter perimeter of the coupe.

Any such activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be

cancelled.

25.

The security deposit will be refunded only after the successful completion of contract after producing the

clearance certificates of GST, Income Tax etc. If there is any liabilities outstanding in this respect to the

Government that will be adjusted from the security deposit of the contractor.

26.

All the amount as per the auction conditions due to Government should be remitted by the successful bidder as

and when required by the Divisional Forest Officer. If the bidder fails to remit the Government dues as demanded

by the concerned officers, such dues will be realized from the bidder as arrear of land tax as per the existing

Revenue Recovery Act or by any other suitable means taken by the Divisional Forest Officer, Punalur.

Bidders are requested to submit scanned copy of Registration certificate duly attested, EMD exemption certificate

(if any), preliminary agreement executed in Kerala Stamp Paper worth ` 200, Notice Inviting tender, duly filled up proforma

for availing e-payment by Online. Subsequently the hard copy of attested copy of Registration certificate, EMD exemption

certificate (if any), preliminary agreement in original along with duly signed BOQ and Notice inviting tender would be

submitted offline in a sealed cover superscribing the name of work and tender number to the O/o Assistant Conservator of

Forests, Social Forestry Division, Alappuzha North P. O., Kommady, Alappuzha Pin-688 007 through speed post/registered

post as prescribed in the schedule, failing which such tenders will be rejected. Bidders opting for NEFT facility of online

payment are advised to exercise this option at least 48 hours before the closing date of bid to ensure that payment

towards tender document fees and EMD are credited and a confirmation is reflected in the

e-procurement system. The online NEFT remittance form provided by e-procurement system for making a NEFT transaction

is not a payment confirmation. Kerala Forest Department/NIC/SBI shall not be responsible for any kind of delay in payment

status confirmation.

Any further clarifications of e-tender can be obtained from NIC/the e-tender Helpdesk number available in the

www.etenders.kerala.gov.in website and from this office (0477-2246034) during the office hours. The details regarding

e-payment (Bidder’s bank account number where he/she is having core banking facility, email ID and mobile number)

bid shall be submitted in their respective designated online covers.

The bidding authority deserves all the right to modify/cancel any/all bids without assigning any reason. The bidding

Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non

receipt of documents and any inconveniences or loss to the bidder while downloading/uploading the bid.

The tender/bids shall be opened online at the office of the Assistant Conservator of Forests, Social Forestry

Division, Alappuzha North P. O., Kommady, Alappuzha in the presence of bidders/their representatives who wish to attend.

If the tender opening date happens to be on a holiday or non working day due to any other valid reason, the tender

opening process will be done on the next working day at same time and place.

All other existing conditions related to e-tendering of Kerala Forest Department, PWD and Store Purchase

Department will be applicable in this tender also. The conditions stipulated in G. O. (Ms) No. 26/2017/F&WLD dated

20-5-2017 will also be applicable in this tender.

SPECIAL TENDER CONDITIONS

1.

The cost of tender forms once paid is not refundable on any account, nor will the amount be adjusted towards

cost of any other tender forms.

2.

The tender form shall be used only by the person in whose name it is issued and for the work specified in the

schedule attached to the tender form.

3.

Before submitting the tender, the tenderer is expected to study and scrutinize all the conditions in the agreement

to be executed, the draft of which can be had for perusal at the Divisional Forest Office on any working day

during office hours. They are also requested to study the detailed tender conditions attached to the tender

document. No plea of ignorance of the agreement conditions received after putting in the tender will be

entertained.

4.

Before submitting the tender, the tenderer shall visit the area of work to study all the field conditions and nature

of work and quote his rate accordingly. No enhancement in rate due to any reason will be entertained thereafter.

5.

The tenderer shall quote in the appropriate column in the online tender schedule (BOQ) in figures as well as in

words also. Lower of the same only be considered valid and shall be binding on him/her. If the Kerala Forest

Department feels that the total amount quoted is unworkable due to variance to the lower side to an abnormal

level with Kerala Forest Department basic rate, the tenderer may be required to furnish satisfactory explanation on

the above respect. In such an event, the Kerala Forest Department has the option to collect a special/extra

security deposit to the tune of 10% of the quoted amount subject to a maximum of ` 30,000 (Rupees thirty

thousand only) from the tenderer before issuance of confirmation orders. If the explanation furnished is not found

satisfactory or no explanation is furnished, the Assistant Conservator of Forest, Social Forestry, Alappuzha has the

right to deny the offer of work to the tenderer even though he/she is the lowest tenderer.

The tenderer shall submit the original tender documents in tact in sealed cover addressed to “The Assistant

Conservator of Forests, Social Forestry Division, Alappuzha” and superscribed “Tender for (Name of work)..............

in ......................... Range so as to reach him in his office at specified date and time.

7.

Tenders

received after the specified date and time or received without the requisite enclosures or tenders not

written up proper order or form will not be honoured.

8.

The lowest tender ordinarily be accepted, but the authority competent to accept the tender reserves to himself the

power of accepting or rejecting any tender without assigning any reason thereof.

9.

The tenderer whose tender is accepted will be informed regarding acceptance of his tender by a confirmation order

issued by the registered letter bearing the address mentioned in the tender. The successful tenderer, within three

days of receipt of confirmation of his tender, shall have to execute an agreement in the prescribe form on a proper

non judicial stamp paper (as per Kerala Stamp Act). If the contractor fails to execute the agreement the tender will

be cancelled and the Earnest Money Deposit submitted by the tenderer shall stand forfeited to the Kerala Forest

Department. The work will be retendered at the risk and cost of the tenderer or through any other manner

(including through the next higher tenderer). The loss, if any, to the Govt. consequent to the default, if not paid

by the defaulter within a reasonable time specified by the Assistant Conservator of Forests, shall be treated as

arrears on public revenue to be recovered from the defaulter under the provisions of the Kerala Revenue Recovery

Act 1968 and in such other manner as the Govt. may deem fit. The defaulter however will not be entitled

for gain, if any.

10.

The successful tenderer while signing the agreement shall furnish a security deposit for an amount equal to 10 per

cent of the total probable amount of contract, limited to a maximum of ` 5,00,000 (Rupees five lakhs only).

The security deposit will be released only after the successful competition of the contract work and after

producing the Non liability certificate from the concerned officers.

11.

The successful tenderer shall give an undertaking at the time of execution of agreement that he shall not sell,

mortgage or otherwise alienate the properties covered by the solvency certificate during the currency of the

contract.

12.

The post offers and representations sent, after receipt of tender in respect of the work shall at no account be

considered.

13.

The EMD of the unsuccessful tenderers will be returned as soon as possible after the tenders are finalized.

14.

The quantities of work shown in the schedule are approximate and it may vary on actual execution of work.

The undersigned reserves all the rights to change the quantity of the work.

15.

The quantity shown in the tender schedule are approximate. The actual extend of the contract area may vary as

per the final survey report, which will be binding on the successful tenderer.

16.

liable for the protection of the seedling till the completion of the seedling distribution.

should be paid along with the tenders by DD (cheques

or fixed deposit receipts will not be acceptable) in favour

of the undersigned payable at any Nationalized bank at

Munnar. Incomplete tender or tenders without EMD are

liable to be rejected. The preliminary agreement in stamp

paper worth ` 200 should be enclosed with tender.

The undersigned reserves the right to reject any tender

without assigning any reason. All other conditions

prevailing in the Kerala Public Works Department and

Forest Department are applicable to this tender

Page No. 815 of 49th Gazette dated 16-12-2013 published

by Additional Principal Chief Conservator of Forest (Pro.),

Thiruvananthapuram vide letter No. Pro (5) 26274/12 dated

22-11-2013. The existing rules and sale conditions are also

applicable to this e-auction.

The Divisional Forest Officer, Mannarkkad reserves

all the right to exclude any other vehicles shown

schedule above for sale. EMD amount of ` 1,500 for

vehicle can be remitted through online payment system to

MSTC by 6 p. m. on the previous day of the e-auction.

The buyer registration number has to be mentioned while

paying the EMD. If the sale value of vehicles is not paid

within the specified time period against any of the bid lot

by the H1, bidder, the EMD will be forfeited.

The successful bidder, 50% of the bid value after

adjusting the EMD already remitted shall be paid within 7

working days of issuance of acceptance letter. The mode

of payment is through e-treasury of Government of Kerala

or by cash in Sub Treasury, Mannarkkad. The successful

bidder shall be paid the GST with in time.

E-Auction document and connected records are

available in the website: www.mstcecommerce.com. All

bids/e-auction documents are to be submitted online only

and in the designated online cover(s) on the

www.mstcecommerce.com website and e-auction document

submitted manually/through post will not be entertained.

Online e-auction bids are to be accompanied with

relevant documents. E-auction/bids received on me

without the scanned copies of relevant documents will

not be considered and shall be summarily rejected.

Any further clarification on this e-auction can be obtained

from NIC/the e-auction help desk number available in the

www.mstcecommerce.com website. and from the Office of

the Divisional Forest Officer, Mannarkkad/Office of the

Mannarkkad/Attappady Range Forest Office during the

office hours. The details regarding e-payment (Bidders

Bank account number, where he/she is having core

banking facility and email ID) should be submitted along

with the e- auction document. E-auction documents

without these details will not be accepted. Technical bid

and financial bid shall be submitted in their respective

designated online covers. The forest department will not

be responsible for any inconvenience or loss to the

bidder while uploading/downloading the bid.

The bidders who wished to participate in the

e-auction should produce a certificate showing the

permanent address and signature of the bidders duly

attested by the concerned Village Officer, or any other

approved identity document along with the EMD through

online. Those who do not produce any approved identity

card or certificate will not be eligible to participate in the

e-auction.

Intending persons may ensure the quality of the

above vehicles put up for e-auction before the

commencement of the same and no complaints will be

entertained after e-auction. Any further notification to the

sale conditions that may be issued by the Government

after the issuance of this notification will also be

applicable to this, tender cum auction. The unsold

vehicles will be sold on the next auction date shown and

separate notification will not be published for the same.

If any modification or change in the sale condition

are intimated by the Additional Principal Chief

Conservator of Forest (Pro), Thiruvananthapuram that will

also be applicable to this E-Auction. The undersigned

reserves the right to alter the number of vehicles

mentioned above schedule or to cancel the e-auction of

any vehicle without further notice
