It is proposed to conduct e-auction of sand accumulated in Pamba River due to recent floods

during August 2018 and subsequently collected at Areekkakavu depot in the following dates. The sand

will be auctioned in quantities of 10 M³ of 40 lots, 5 M³ of 15 lots and 1 M³ of 25 lots respectively.

The sand is tested by NCESS and certified that this sand is ideal for all type of construction as well

as landscaping purposes. The e-auction of sand will be conducted through MSTC Ltd. Those who

have registered as bidders at MSTC can only be participate in the e-auction. The details can be

Special Terms and Conditions

1. The retail sale is governed by the General Terms & Conditions (GTC), Buyer Specific

Terms & Conditions (BSTC) and Special Terms & Conditions (STC) of the e-auction. In case

of any conflict or differences among any of the provisions of GTC, BSTC & STC, the

provisions of STC will supersede the others in the particular e-auction. The terms &

conditions, including the list of materials appearing on the date of e-auction is final and binding

on the participant buyers.

2. Kerala Forest Department, the owner/seller, will be hereinafter referred to as ‘Principal’ and

‘MSTC Ltd.’, the Selling Agent of Kerala Forest Department will be hereinafter referred to

as ‘MSTC’. Wherever the word Buyer, Purchaser, Successful Buyer is indicated, it will be

referred to as ‘Successful Buyer’.

3. Validity of Bids : All offers by buyers will be valid for acceptance by MSTC for a period

of 7 (Seven) days. In case the 7th day falls on a holidy or remains closed for Principal/

MSTC, the validity of the offer will be deemed to be automatically extended up to the next

working day of Principal/MSTC.

4. Inspection : The intending buyer or his authorized representative may inspect the materials as

per the schedule mentioned above, between 10 hrs. and 17 hrs. on any working day

at the location specified with the prior intimation to the Depot Officer concerned. The detailed

descriptions of all lots including annexure, if any, are available at the respective

Divisional Forest Office also.

5. The description/quality indicated are furnished to enable buyers to quote their rates. Buyers

are advised to quote their rates only after inspection of items at site. In case, the buyers

do not prefer to inspect, neither the sale could be invalidated nor the buyer can make any

claim/compensation whatsoever on account of any defect in description, deficiency in the

quantity. Notwithstanding anything contained in the e-auction sale notice or advertisement

issued as to description and particulars of material put up for sale, the sale is on “As is Where

is and no Complaint Basis” only. No plea or misunderstanding or ignorance or conditions

put forth subsequent to any confirmation of sale shall be accepted. The Principle of

“Caveat Emptor” (let the buyer be aware) will apply.

6. Conditional offers will not be accepted/entertained.

7. Lot Formation : The sand will be sold in lots having quantities viz, 10 m³, 5 m³ and 1 m³.

The entire stock of material (sand) will be heaped in one location at deport, no separate

lot formation.

8. Earnest Money Deoposit (EMD) Prior to offer for sale:—

(i) An intended buyer has to pay an amount of 1,000 as EMD to participate offer for

sale.

EMD can be remitted through e-treasury (https://e-treasury.kerala.gov.in/) till 6 p.m. on

the previous day of the offer. The buyer registration number has to be mention while

paying the EMD. For the benefit of the buyers who are not well versed with online

transaction, Divisional Forest Officer will accept EMD in the form of Demand Draft

payable at any nationalized bank drawn in favour of Divisional Forest Officers concerned,

as was done in the old system, by 2 p.m. on the previous day of auction. Only registered

customers who have remitted the EMD in time will be able to participate in the e-auction.

If the offered value is not paid within the specified time period against any of the lot/lots

by the offeror, the EMD will be forfeited.

(ii) The EMD of the unsuccessful bidder will be returned on the next working day on the

completion of the e-auction.

(iii) The EMD of the successful bidder will be kept with the Principal for adjustment against

the sale value of the bid lots or for compensating any loss incurred to the Government

as per conditions noted below in Clause No. 12 & 13.

9. The sale will be affected as follows:

The prospective buyer who has remitted the EMD and is eligible to participate in the offer

for sale can quote the price/m³ of sand. The minimum bid increment shall be 10/m³ or

multiples of 10.

10. Issuance of acceptance Letter:

The Acceptance Letter will be issued for the accepted lot immediately, for making balance

payments by the successful buyer within 7 days from the date of issuance of acceptance

letter and the same will be communicated by e-mail.

11. GST, FDT, TCS and other taxes:

The material value, working cost, GST, FDT, TCS and other taxes as per the prevailing tariff

wherever applicable at the time of delivery on the sale of materials cover under this sale shall

be payable by the successful buyer before taking delivery of material.

12. Issue of sale intimation letter:

Wherever the highest bid (H-1Bid) is acceptable on confirmed basis are Subject to Approval

(STA) basis, depending upon the Reserve Price fixed by the Principal immediately on closing

of the e-auction. Sale Intimation Letter will be issued automatically by e-mail to the

respective Successful Bidder informing him whether his bid has been accepted on confirmed

basis on STA basis. Bidders must, therefore, keep a watch on their incoming, e-mail in this

regard. Principal has the power to accept or reject any highest bid, accepted on STA basis,

without citing any reason. The decisions towards acceptance or rejection will be intimated by

e-mail to the respective bidders by e-mail.

13. Remittance of Balance Amount and Removal of Lots:

(a) The successful buyer should remit the payments as per the following manner:

(i)

Immediately on receipt of the acceptance letter from MSTC, the buyer shall remit the

entire amount of the materials (less EMD), Chalan for the balance amount the taxes

will be issued by the Depot Officer concerned with a currency up to

7 working days.

(ii)

The mode of payment is through e-treasury of Government of Kerala or DD drawn

from a Nationalized Bank payable at respective station in favour of ^,Divisional Forest

Officer or by cash in the respective Treasury.

(iii) If any amount is charged by Bank for clearing the DD, the same shall be borne by

the buyer himself. If the DD is dishonoured by the Bank, the bidder who remitted

the DD will be treated as defaulter and necessary actions will be initiated against him

as per the law and as per sale conditions.

(iv) If the buyer fails to remit the amount as prescribed in the Acceptance Letter within

the prescribed time period, the offer will be treated as cancelled and all remittance

including EMD will be forfeited without giving any notice and the lots will be

re-auctioned.

(v)

If the last day prescribed for remittance happens to be a public holiday, the amount

can be remitted without penalty on the next working day.

(vi) The material will be delivered only to the successful buyer or their authorized

representatives against presentation of e-Auction Identity Card issued by MSTC.

If the successful buyer desires to authorize a representative or an agent for delivery,

in such case, the buyer shall produce suitable Power of Attorney or authorization

letter duly attested by a Notary Public authorizing his representative or agent to lift

the materials from Principal.

(vii) If the successful buyer clears all his dues, is allowed to remove lots without paying

any ground rent within 7 days. He is allowed to remove the materials for another

7 days by paying ground rent @ 10 per cubic meter.

(viii) The successful buyer will be solely responsible for removal and transport of sand

from sale depot once sold. The department is not responsible for any loss or damage

to the materials kept at depot compound, once it is sold.

(ix) The measurement of the sand will be done in accordance with the volume in m³

of sand loaded on Lorry/vehicle viz, length of platform (in meter) x breadth of

platform (in meter) x height of this sand (in meter) loaded on lorry/vehicle.

(x)

The buyer needs to obtain transit pass from the Depot Officer for transportation.

14. Penalty for the defaulters:

Under no circumstances the lots will be allowed to be removed beyond the above time

period. If the buyer fails to remove the lots within the prescribed time limit, the lots will be

re-auctioned and all moneys remitted by the buyer will be forfeited without any notice to

the buyer.

15. Other Conditions:

(a) Blacklisted buyers will not be allowed to participate in any e-auctions.

(b) The successful buyers are bound to abide by changes in terms & conditions of e-auction

consequent upon any amendments in the existing Kerala Forest Act, 1961 or extant Rules.

(c) All the litigations related to e-auction will be entertained only in the Courts within the

jurisdiction of the Depot Officer concerned.

16. Principal/MSTC reserves the right to accept/reject and cancel any offer, amend the quantity

under any lot or withdraw any lot at any stage under this sale after acceptance of sale/issue

of sale order/deposit of full sale value by the buyer, without assigning any reason thereof and

the value of such material paid for, shall be refundable. Principal/MSTC shall not be

responsible for any damages/loss whatsoever to buyers on account of such withdrawal, at any

stage from the e-auction sale.

17. Force majeure: Principal/MSTC will not be in any way responsible for failure to deliver the

material due to cause beyond their control such as strike, lockout, cessation of work by

labourers, shortened hours, act of God or other causes of other contingencies whatsoever.

The buyer shall not be entitled to cancel the contract and the period of delivery shall

automatically get extended proportionately.

18. Conduct during delivery: Buyers shall solely be responsible for movement and proper

behaviour of their deputies, agents and labourers within Principal premises. If any damage

is caused to the Government property, the buyer is responsible to make good such damage

to the satisfaction of Principal and the decision of Principal in this regard shall be

final and binding.

19. Accidents etc. to buyer’s labourer: Principal/MSTC will not any point of time be responsible

for any injuries caused due to accident within the premises or at the place of work and the

buyer will make proper arrangement for medical attention and treatment to his labour

representative.The buyer will be solely responsible for any claim arising out of the

employment, injuries to labourers in the course of the employment under any statute. It is the

responsibility of the buyer to provide necessary safety appliances (like hand gloves, tools,

helmet, safety goggles, boots etc.) to the labourers who are engaged for handling of the

goods.

20. Black Listing: If it is found that the buyer is not following the terms and conditions of

payment, delivery or other conditions of the e-auction and also indulging in any malpractices

either by himself or by his agents, deputies or observer, such buyer are liable to be blacklisted

and appropriate action will be taken as deemed fit by Principal.

21. In the event of any dispute in connection with this sale, the decision of Principal/MSTC shall

be final and binding on the parties to the e-auction sale. Further any such dispute, doubts or

differences of opinion arising at the time of payment or Delivery, buyers shall agree and abide

by the decision of Principal.

22. No interest will be paid to the purchaser on the amount paid or deposited by him and on the

amount refundable to him, if any.

23. The terms and conditions are supplementary to the remedy available under the law.

24. Any auctioned materials shall not be sold or parted with any of the employees of

Principal/MSTC.

25. Complaints/grievances from buyers regarding sale shall be addressed to the Grievance

Redressal Committee constituted under the Chairmanship of Circle Chief Conservator of

Forest, for the purpose of adjudicating complaints regarding e-auction of timber. The Grievance

Redressal Committee is authorized to take decisions relating to the grievance or complaints

which include cancellation/confirmation of the offer, imposing of any penalty and forfeiture of

EMD and matters related thereto.

It is hereby notified that Teak timber IV, Teak Poles & Teak billets collected

through thinning & final felling from 2015 TP Muthalathodu, 2010 TP Kumbhavurutty,

1960 TP Pallimundan, 1987 TP Alinjamon & 1987 TP Kodamala in Achencovil Range and

1960 TP Mlamthadam at Kallar Range will be sold through e-Auction as shown in the

schedule, by M/S MSTC Ltd, Bangalore, subject to the conditions published by the M/S

MSTC Ltd and in the Kerala Gazette No. 49 Vol. IV dated. 15.12.2015 vide Notification

No. Pro. (4) 26243/13 dated: 21.11.2015 of the Additional Principal Chief Conservator of

Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest Department.

Besides the quantity shown in the schedule, the quantity if any delivered to dumping depots

before the date of e-Auction and that could be lotted immediately before the e-auction will

also be placed in the proposed e-auction. Those who wish to participate in the e-auction

have to remit EMD as shown in the schedule as e-payment before the e-auction through

MSTC limited. Registration number of the bidder should be entered while remitting the

EMD amount. Bidders those who are registered and have remitted the EMD before the e-

auction will be permitted to take part in the e-auction. Successful bidders will have to remit

35% of the bid amount within 7 (seven) days after obtaining the confirmation of e-auction

sale from MSTC. If any successful bidder fails to remit the 35% amount within the

stipulated time, the EMD will be forfeited to Govt. and which is non-refundable under any

circumstances. If any of the Banks demand a commission for converting the Demand Draft

to cash, the bidder will have to suffer the commission charges. Successful bidders will also

have to remit the balance value, Forest Development Tax, GST, Income Tax and such other

taxes that are prevailing at the time of e-auction within the stipulated time limit.

/ e-treasury / demand draft / MSTC through the internet online banking of SBT or through

1. Bidders are requested to upload the copy of following documents Registration

certificate duly attested by the PWD Kerala, EMD exemption certificate (if any),

preliminary agreement executed in a white paper worth, duly filled up to proforma for

availing e-payment by Online, failing which such tenders will be rejected.

2. The bidding authority reserves the right to modify / cancel any / all bids without

assigning any reason. The Forest Department will not be responsible for any error

like missing of scheduled data, while downloading by the bidder and non receipt of

documents.

3. Any further clarifications on this tender can be obtained from NIC/KITM the e-Tender help

desk number available in the www.etenders.kerala.gov.in website and from this office

(04923 243179) during the office hours. The details regarding e- payment (bidder’s bank

4. The Forest department will not be responsible for any inconvenience or loss to the bidder

The wildlife warden, Silent Valley reserves all the right to exclude any class or quantity of

materials shown in the schedule above for sale. EMD amount of 20,000 can be remitted through

online payment system to MSTC by 2 p.m. on the previous day of the e-auction. The buyer

registration number has to be mentioned while paying the EMD. If the sale value of bid materials is

not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will

be forfeited.

The successful bidder, 35% of the bid value after adjusting the EMD already remitted shall be

paid within 7 working days of issuance of acceptance letter. The mode of payment is through

e-treasury of Government of Kerala.

All bids/e-auction documents are to be submitted online only and in the designated online cover(s) on

the www.mstcecommerce.com website and e-auction document submitted manually/through post will

not be entertained.

The bidders who wished to participate in the e-auction should produce a certificate showing

the permanent address and signature of the bidders duly attested by the concerned Village Officer

or any other approved Identity document along with the EMD through online. Those who do not

produce any approved Identity Card or Certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity or quality of materials put up for e-auction before

the commencement of the same and no complaints will be entertained after e-auction. The quantity

may become ready for sale after the publication of this notification will also be included in the tender

cum auction. Any further notification to the sale conditions that may be issued by the Government

after the issuance of this notification will also be applicable to this tender cum auction. The unsold

materials in the e-auction will be placed along with the materials that may in the dumping depots on

subsequent dates will be sold on the next auction date shown in the schedule and separate

notification will not be published for the same.

If any modifications or change in the sale conditions are intimated by the Additional Principal

Chief Conservator of Forests (FM), Thiruvananthapuram that will also be applicable to this

e-auction. The undersigned reserves the right to alter the quantities of the materials mentioned in the

above schedule or to cancel the e-auction of any material without further notice.
