administrative committee appointed to manage the affairs of a society shall not

society, carrying on the business of banking, appointment of administrator or

administrative committee shall not exceed one year in the aggregate;

AND WHEREAS, the said term of one year of the administrator appointed

under sub­section (1) of section 32 of the said Act, to manage the affairs of the

Tirur Taluk Auto and Taxi Drivers Co­operative Society Limited No.M.723 in

Malappuram District expired on 8^th August, 2022;

AND WHEREAS, the term of the administrator of the said society extended

for a further period of one year from 9^th  August, 2022 to 8^th  August, 2023 in

pursuance   of   notification   issued   under   G.O.(P)No.32/2023/Co­op.   dated   4^th

February, 2023 and published as S.R.O. No.188/2023 in the Kerala Gazette

Extraordinary No.444 dated 7^th  February, 2023 and the period so extended also

expired on 8^th August, 2023;

  

AND WHEREAS, the Registrar of Co­operative Societies has reported that

the election to the Board of Directors of the said society could not be conducted

within the extended period and has requested the Government to extend the

term of the administrator for a further period of one year from 9^th August, 2023

to   8^th  August,   2024   or   till   a   newly   elected   committee   enters   upon   office,

whichever is earlier, to avoid administrative vacuum in the said society;

AND WHEREAS, the Government have examined the matter in detail and

are satisfied that it is necessary, in public interest, to direct that the provisions of

sub­section (1) of section 32 of the said Act shall apply to the said society with

certain modifications and to permit the Registrar of Co­operative Societies to

extend the term of the administrator appointed to manage the affairs of the said

society for a further period of one year from 9^th August, 2023 to 8^th August, 2024

or till a newly elected committee enters upon office, whichever is earlier;

NOW, THEREFORE, in exercise of the powers conferred by section 101 of

the Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of

Kerala hereby direct that the provisions of sub­section (1) of section 32 of the

said Act shall apply to the Tirur Taluk Auto and Taxi Drivers Co­operative Society

Limited No.M.723 in Malappuram District with the modification of substituting

the words “two years” for the words “six months” so as to enable the Registrar of

Co­operative Societies to extend the term of the administrator appointed to

manage the affairs of the said society for a further period of one year from 9^th

August, 2023 to 8^th August, 2024 or till a newly elected committee enters upon

office, whichever is earlier, to avoid administrative vacuum in the said society.

Explanatory Note

(This does not form part of the order, but is intended to indicate its general

purport.) 

As per sub­section (1) of section 32 of the Kerala Co­operative Societies

Act, 1969 (21  of 1969), the term  of  an  administrator  or an administrative

committee appointed to manage the affairs of a society shall not exceed six

months in the aggregate. Provided that in the case of a co­operative society,

carrying   on   the   business   of   banking,   appointment   of   administrator   or

administrative committee shall not exceed one year in the aggregate. The said

term of one year of the administrator or administrative committee appointed

under sub­section (1) of section 32 of the said Act, to manage the affairs of the

Tirur Taluk Auto and Taxi Drivers Co­operative Society Limited No.M.723 in

Malappuram District expired on 8^th August, 2022. The term of the administrator

of the said society extended for a further period of one year from 9^th  August,

2022   to   8^th  August,   2023   in   pursuance   of   notification   issued   under   G.O.

(P)No.32/2023/Co­op.   dated   4^th  February,   2023   and   published   as   S.R.O.

No.188/2023 in the Kerala Gazette Extraordinary No.444 dated 7^th  February,

2023 and the period so extended also expired on 8^th August, 2023. The Registrar

of Co­operative Societies has reported that the election to the Board of Directors
