AND WHEREAS, the said term of one year of the administrator appointed

under sub­section (1) of section 33 of the said Act to manage the affairs of the

Neelamperoor   Labour   Contract   Co­operative   Society   Limited   No.A.906   in

Alappuzha District expired on 22^nd June, 2019; 

AND WHEREAS, under sub­section (1A) of section 33 of the said Act, the

Government may, by notification in the Gazette, for reasons to be recorded,

permit the Registrar of Co­operative Societies to extend the term of the said

administrator or administrative committee for a further period not exceeding one

year in the aggregate or till a newly elected committee enters upon office,

whichever is earlier; 

AND  WHEREAS,  the term of the administrator of the said society was

extended for a further period of one year from 23^rd  June, 2019 to 22^nd  June,

2020 in pursuance of notification issued under G.O(P)No.75/2020/Co­op. dated

19^th  August, 2020 and published as S.R.O.No.552/2020 in the Kerala Gazette

Extraordinary No.1980 dated 3^rd  September, 2020, and the term was further

extended for a period of one year from 23^rd June, 2020 to 22^nd June, 2021 in

pursuance of notification issued under G.O(P)No.117/2021/Co­op. dated 27^th

July,   2021   and   published   as   S.R.O.No.581/2021   in   the   Kerala   Gazette

Extraordinary No.2292 dated 2^nd August, 2021, and further extended for a period

of one year from 23^rd June, 2021 to 22^nd June, 2022 in pursuance of notification

issued under G.O(P)No.3/2022/Co­op. dated 4^th January, 2022 and published as

S.R.O.No.42/2022 in the Kerala Gazette Extraordinary No.111 dated 7^th January,

2022  and further extended for a period of one year from 23^rd June, 2022 to 22^nd

June, 2023 in pursuance of notification issued under G.O(P)No.31/2023/Co­op.

dated 31^st  January, 2023 and published as S.R.O.No.165/2023 in the Kerala

Gazette   Extraordinary   No.375   dated   2^nd  February,   2023   and   the   period   so

extended also expired on 22^nd June, 2023;

AND WHEREAS, the Registrar of Co­operative Societies has reported that

election to the Board of Directors of the said society could not be conducted

within the extended period due to the society was under liquidation and the

liquidator   was   appointed   by   the   Registrar   of   Co­operative   Societies   and   he

assumed   charge   on   5^th  August,   2023.     The   Registrar   has   requested   the

Government to extend the term of the administrator for a further period of one

month and thirteen days from 23^rd  June, 2023 to 5^th  August, 2023 to avoid

administrative vacuum in the said society; 

AND WHEREAS, the Government have examined the matter in detail and

are satisfied that it is necessary, in public interest, to direct that the provisions of

sub­section (1A) of section 33 of the said Act shall apply to the said society with

certain modifications and  to permit the Registrar of Co­operative Societies to

extend the term of the administrator appointed to manage the affairs of the said

society for a further period of one month and thirteen days from 23^rd June, 2023

to 5^th August, 2023 since the Liquidator assumed charge on 5^th August, 2023;  

NOW, THEREFORE, in exercise of the powers conferred by section 101 of

the Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of

Kerala hereby direct that the provisions of sub­section (1A) of section 33 of the

said Act shall apply to the Neelamperoor Labour Contract Co­operative Society

Limited No.A.906 in Alappuzha District with the modification of substituting the

words “five years one month and thirteen days” for the words “one year” and in

exercise of the powers under sub­section (1A) of section 33 of the said Act, as so

modified, permit the Registrar of Co­operative Societies to extend the term of the

administrator appointed to manage the affairs of the said society for a further

period of one month and thirteen days from 23^rd June, 2023 to 5^th August, 2023

to avoid administrative vacuum in the said society, since the liquidator taken

charge on 5^th August, 2023.

The term of the part­time administrator appointed under sub­section (1) of

section 33 of the Kerala Co­operative Societies Act, 1969 (21 of 1969) to manage

the affairs of the Neelamperoor Labour Contract Co­operative Society Limited

No.A.906 in Alappuzha District expired on 22^nd  June, 2019. The term of the

administrator of the said society was lastly extended for a further period of one

year from 23^rd June, 2022 to 22^nd June, 2023 in pursuance of notification issued

under G.O(P)No.31/2023/Co­op.   dated  31^st  January,   2023   and  published as

S.R.O.No.165/2023   in   the   Kerala   Gazette   Extraordinary   No.375   dated   2^nd

February, 2023 and the period so extended also expired on 22^nd June, 2023. The

Registrar of Co­operative Societies has reported that the election to the Board of

Directors of the said society could not be conducted within the extended period

and also the liquidator is taken charge on 5^th  August, 2023 to the process of

winding up of the society, since the revitalization of the society is not possible

and has requested to extend the term of the administrator for a further period of

one month and thirteen days from 23^rd June, 2023 to 5^th August, 2023  to avoid

administrative   vacuum,   since   the   liquidator   taken   charge   upon   office.   The

Government have examined the matter in detail and are satisfied that it is

necessary, in public interest, to permit the Registrar of Co­operative Societies to

extend the term of the administrator appointed to manage the affairs of the said

society for a further period of one month and thirteen days from 23^rd June, 2023

to 5^th August, 2023 to avoid administrative vacuum in the said society, since the

liquidator assumed charge on 5^th August, 2023.

This order is intended to achieve the above object.
