NOTIFICATION

In exercise of the powers conferred by sub-section (1) of section 2 of the Kerala Public

Services Act, 1968 (19 of 1968), read with section 3 thereof, the Government of Kerala hereby

make the following rules further to amend the Kerala Service Rules, namely:-

RULES

1. Short title and commencement.- (1) These rules may be called the Kerala Service (Tenth

Amendment) Rules, 2023.

(2) They shall come into force at once.

2. Amendment of the Rules.- In Part III of the Kerala Service Rules,-

(i) for rule 135, the following rule shall be substituted, namely:-

"135. Lapses and Forfeiture – If a Pension/Family Pension/ Compassionate

Allowance remains undrawn for more than three years, the Pension/Family

Pension/Compassionate Allowance ceases to be payable".

(ii) for rule 136, the following rule shall be substituted, namely:-

"136. If the pensioner afterwards appears, the Disbursing Officer may reclaim

the pension payment order and renew his payment, if the period is less than 3 years.

In case where pension remains undrawn for more than three years both halves of

Pension Payment Order are to be forwarded to Accountant General for revalidation.

The amount of arrears cannot be paid, without the previous sanction of the

Government, if such amount exceeds Rs.3,00,000/-.

Note 1.- The term Pension includes Pension, Family Pension and Compassionate

Allowance.

Note 2.- The request for arrears along with arrear statement shall be forwarded to

Finance Department by the Disbursing Officer for Sanction".

(iii) for the heading for rule 138, the following heading shall be substituted, namely:-

"138. Deceased Pensioners or Family Pensioners."

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport.)

As per rule 135 of Part III of the Kerala Service Rules, if a pension remains undrawn for

more than three years, the pension ceases to be payable. But the family pension and compassionate

allowance remains silent there. Also in rule 136, related with the payment of arrears to pensioners

also same clarification is needed. Hence the Government decided to include Family Pension and

Compassionate Allowance in rule 136 of Part III of the Kerala Service Rules.

The notification is intended to achieve the above object.
