NOTIFICATION

In exercise of the powers conferred by sub-sections (2) and (3) of Section 35 of the

Surrogacy (Regulation) Act, 2021 (No. 47 of 2021) and sub-sections (2) and (3) of Section 12

of the Assisted Reproductive Technology (Regulation) Act, 2021 (No. 42 of 2021), the

Government of Kerala hereby make the following amendment to the notification issued under

G. O. (P) No. 25/2022/H&FWD dated 20th June, 2022 and published as S.R.O. No. 629/2022

in the Kerala Gazette Extraordinary No. 2088 dated 24th June, 2022, namely:—

AMENDMENT

In the said notification, for the entries against serial number (iv) the following entries

shall be substituted, namely:—

“(iv) Smt. Smitha, C. S., Deputy Secretary, Law Department – Member, Ex-officio”.

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport.)

Sub-sections (2) and (3) of Section 35 of the Surrogacy (Regulation) Act 2021, (No. 47

of 2021) and sub-sections (2) and (3) of Section 12 of the Assisted Reproductive Technology

(Regulation) Act, 2021, (No. 42 of 2021) every State Government have to appoint an

appropriate authority for the purpose of the said Acts. As such the Government of Kerala have

appointed an appropriate authority in which Smt. V. Helena Thomas, Joint Secretary from Law

department was appointed as Ex-officio member. Since she has been promoted as Additional

Law Secretary in the Law Department and hence the Government have decided to replace her

with Smt. Smitha, C. S., Deputy Secretary, Law Department as the Ex-officio member in the

aforesaid appropriate authority for the purpose of the said Acts.

This notification is intended to achieve the above object.
