NOTIFICATION

In exercise of the powers conferred by 1st proviso to section 14 of the Right to Fair

Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement Act, 2013

(Central Act 30 of 2013), the Government of Kerala hereby extend the time limit in publishing the

Notification as per sub-section (1) of Section 11 of LARR Act, 2013, from the date of appraisal of the

Social Impact Assessment report by the Expert Group namely:

G.O.(P)No.92/2022/RD dated 11.03.2022 and published in the Extra Ordinary Gazette No 824

dated 15.03.2022 has been issued in accordance with the provisions as per section (1) of section 4 of

the Right to Fair Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement

Act, 2013 (Central Act 30 of 2013) with regard to the acquisition of 12.34 Hectares of land in Nadama

and Manakunnam Villages of Ernakulam district for four laning of road from SN Junction (Tripunithura)

to Poothotta.

AND WHEREAS, the District Collector, Ernakulam has informed that as per section 14 of

LARR Act, 2013 where a preliminary notification under sub-section (1) of section 11 is not issued

within twelve months from the date of appraisal of the Social Impact Assessment report submitted by

the Expert Group under section 7, then, such report shall be deemed to have lapsed and a fresh

Social Impact Assessment shall be required to be undertaken prior to acquisition proceedings under

section 11. The date of appraisal of the Social Impact Assessment report by the Expert Group under

section 7 was submitted on 11/11/2022 and the Notification under sub-section (1) of section 11 needs

to be issued on or before 11/11/2023.

AND WHEREAS, the District Collector, Ernakulam has informed that as per 1st proviso to

section 14 of LARR Act, 2013, Government have the power to extend the period of twelve months, if in

its opinion circumstances exist justifying the same and hence requested to extend the time limit in

publishing the Notification as per sub-section (1) of Section 11 of LARR Act, 2013 from the date of

expiry.

NOW THEREFORE, sanction is accorded to extend the time limit for a further period of 6

months from the date of expiry ie. 11.11.2023 in publishing the Notification under subsection (1) of

section 11 by invoking the provisions contained in 1st proviso to section 14 of LARR Act, 2013 with

regard to the acquisition of 12.34 Hectares of land in Nadama and Manakunnam Villages of

Ernakulam district for four laning of road from SN Junction (Tripunithura) to Poothotta subject to the

condition that no more extension be granted under any circumstances.
