NOTIFICATION

In exercise of the powers conferred by 2nd proviso to subsection 7 of section 19 of the Right to

Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013

(Central Act 30 of 2013), the Government of Kerala hereby extend the time limit in publishing the

declaration as per sub-section 1 of section 19 to the Notification issued under sub-section (1) of

section 11 as per G.O(P) No. 7/2023/RD dated 12th January, 2023 and published in the Extra

Ordinary Gazette No. 132 dated 12th January, 2023, namely:-

G.O(P) No. 7/2023/RD dated 12th January, 2023 and published in the Extra Ordinary Gazette

No. 132 dated 12th January, 2023 has been issued in accordance with the provisions of sub-section

(1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of 159.80 Ares of land in

Kuttiyadi Village of Kozhikode district for the construction of Kuttiyadi Bypass.

AND WHEREAS, the District Collector, Kozhikode has reported that as per Section 19 (7) of

LARR Act, 2013, the 19 (1) Declaration has to be published within 12 months from the date of

issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per

G.O(P) No. 7/2023/RD dated 12th January, 2023 and published in the Extra Ordinary Gazette No. 132

dated 12th January, 2023 will expire on 11.01.2024 and therefore requested to extend the time limit for

publishing the 19(1) Declaration.

NOW THEREFORE, sanction is accorded to extend the time limit in publishing the Declaration

for a further period of 6 months from the date of expiry of the 11(1) notification ie. 11.01.2024 by

invoking the provisions contained in 2nd proviso to Section 19(7) of the LARR Act, 2013 with regard to

the acquisition of 159.80 Ares of land in Kuttiyadi Village of Kozhikode district for the construction of

Kuttiyadi Bypass, subject to the condition that no more extension be granted under any

circumstances.

G.O(P) No. 7/2023/RD dated 12th January, 2023 and published in the Extra Ordinary Gazette

No. 132 dated 12th January, 2023 has been issued in accordance with the provisions of subsection (1)

of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation

and Resettlement Act, 2013 with regard to the acquisition of 159.80 Ares of land in Kuttiyadi Village of

Kozhikode district for the construction of Kuttiyadi Bypass. As per Section 19(7) of LARR Act, 2013,

the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1)

Notification (preliminary notification) and that the 11(1) Notification issued as per G.O(P) No.

7/2023/RD dated 12th January, 2023 and published in the Extra Ordinary Gazette No. 132 dated 12th

January, 2023, will expire on 11.01.2024 and hereby extend the time limit for publishing the 19(1)

Declaration.

The notification is intended to achieve the above object.
