ORDER

             WHEREAS, under sub-section (1) of section 33 of the Kerala Co-operative

Societies Act,1969 (21 of 1969), the term of an administrator or an administrative

committee appointed to manage the affairs of a society shall not exceed one year in the

aggregate.

AND WHEREAS, the said term of one year of the administrator appointed under

sub-section (1) of section 33 of the said Act, to manage the affairs of the West Land

Manual Dredges sand Processing and Marketing Co-operative Society Limited. No-890

in Malappuram District expired on 11^th October,2021.

AND WHEREAS, under sub-section (1A) of section 33 of the said act, the

Government may, by notification in the gazette, the reason to be recorded, permit the

Registrar of Co-operative Societies to extend the term of the said administrator or

administrative committee for a further period of one year in the aggregate or till a newly

elected committee enters upon office whichever is earlier;

AND WHEREAS, The Registrar of Co-operative Societies has reported that the

election to the Board of Directors of the Society could not be conducted within the

extended period due to the society is under process of liquidation and has requested to

extend the term of the administrator for a further period of three years from 12^th

October,2021 to 11^th October, 2024 to avoid administrative vacuum in the said society;

AND WHEREAS, the Government have considered the matter in detail and are

satisfied that it is necessary, in public interest, to direct that the provisions of sub-section

(1A) of section 33 of the said Act shall apply to the said society with certain

modifications and to permit the Registrar of Co-operative Societies to extend the term of

the administrator appointed to manage the affairs of the said society for a further period

of three years from 12^th October 2021 to 11^th October ,2024 to avoid administrative

vacuum in the said society;

NOW, THEREFORE, in exercise of the powers conferred by section 101 of the

Kerala Co-operative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby

direct that the provisions of sub-section(1A) of section 33 of the said Act shall apply to

the West Land Manual Dredges sand Processing and Marketing co-operative society

Limited. No-890 in Malappuram District with the modification substituting the word

"three year" for the words "One Year" and in exercise of the powers under sub-section

(1A) of section 33 of the said Act as so modified, permit the Registrar of Co-operative

Societies to extend the term of the Administrator appointed to manage the affairs of the

said society for a further period of three year from 12^th October ,2021 to 11^th

October,2024 to avoid administrative vacuum in the said society;

Explanatory Note

The term of the administrator appointed under sub-section(1) of section 33 of the

Kerala co-operative Societies Act, 1969 (21 of 1969), to manage the affairs of West

Land Manual Dredges sand Processing and Marketing Co-operative Society Limited.

No-890 from Malappuram District expired on 11^th October,2021. The Registrar of Co-

operative Societies has reported that the election of the Board of Directors of the society

could not be conducted within the said extended period due to the society is under

process of liquidation and the extension of the term of administrator is very essential and

has requested to extend the term of the administrator for a further period of three years

from 12^th October,2021 to 11^th October,2024 to avoid administrative vacuum in the said

society;

This order is intended to achieve the above object.
