WHEREAS,  in   exercise   of   the   powers   conferred   by  sub­section   (1)   of

section 32 of the Kerala Co­operative Societies Act, 1969 (21 of 1969), the Joint

Registrar   of   Co­operative   Societies   (General),   Kottayam   had   issued   orders

superseding the administrative committee of the Kottayam Housing Co­operative

Co-operation (D) Department

Society Limited No. K.348 in Kottayam District and appointed an administrator

to manage the affairs of the said society;

AND  WHEREAS, under sub­section (1) of section 32 of the said Act, the

term of an administrator or an administrative committee appointed to manage

the affairs of a society shall not exceed six months in the aggregate provided that

in   the   case   of   a   co­operative   society,   carrying   on   the   business   of   banking,

appointment of administrator or administrative committee shall not exceed one

year in the aggregate;

AND WHEREAS, the said term of one year of the administrator appointed

under sub­ section (1) of section 32 of the said Act to manage the affairs of the

Kottayam Housing  Co­operative  Society  Ltd.  No.   K.348  in  Kottayam  District

expired on 11^th November, 2014;

AND  WHEREAS,  the term of the administrator of the said society was

extended   further for a period of one year from 12^th  November, 2014 to 11^th

November,   2015   in   pursuance   of   notification   issued   under   G.O(P)

No.145/2015/Co­op   dated   12^th  November,   2015   and   published   as   S.R.O

No.840/2015 in the Kerala Gazette Extraordinary No.2805 dated 11^th December,

2015 and extended for a further period of one year from 12^th November, 2015 to

11^th  November,   2016   in   pursuance   of   notification   issued   under   G.O(P)

No.95/2016/Co­op   dated   6^th  September,   2016   and   published   as   S.R.O

No.600/2016 in the Kerala Gazette Extra ordinary No.1604 dated 9^th September,

2016, and extended for a further period of one year from 12^th November, 2016 to

11^th  November,   2017   in   pursuance   of   Notification   issued   under   G.O(P)

No.47/2018/Co­op dated 24^th April, 2018 and published as S.R.O No.307/2018

in the Kerala Gazette Extraordinary No.1301 dated 17^th  May, 2018 and was

extended for a further period of one year from 12^th  November, 2017 to 11^th

November,   2018   in   pursuance   of   notification   issued   under   G.O.(P)

No.125/2018/Co­op   dated   5^th  October,   2018   and   published   as   S.R.O.

No.715/2018 in the Kerala Gazette Extraordinary No.2555 dated 12^th October,

2018, and was extended for a further period of two years from 12^th November,

2018 to 11^th November, 2020 in pursuance of notification issued under G.O(P)

2021 and was extended for a further period of one year from 12^th  November,

2021 to 11^th November, 2022 in pursuance of notification issued under G.O.(P)

No.34/2022/Co­op dated 2^nd March, 2022 and published as S.R.O. No.292/2022

in the Kerala Gazette Extraordinary No.1025 dated 26^th  March, 2022 and was

also extended for a further period of one year from 12^th November, 2022 to 11^th

November,   2023   in   pursuance   of   notification   issued   under   G.O.(P)

No.75/2023/Co­op   dated   14^th  March,   2023   and   published   as   S.R.O.

No.397/2023 in the Kerala Gazette Extraordinary No.1053 dated 22^nd  March,

2023 and the period so extended also expired on 11^th November, 2023;

AND WHEREAS, the Registrar of Co­operative Societies has reported that

the election to the Board of Directors of the said society could not be conducted

within the period and has requested to permit him to extend the term of the

administrator of the said society for a further period of one year from 12^th

November, 2023 to 11^th November, 2024 or till a newly elected committee enter

upon office, whichever is earlier, to avoid administrative vacuum in the said

society ;

AND WHEREAS, the Government have examined the matter in detail and

are satisfied that it is necessary, in public interest, to direct that the provisions of

sub section (1) of section 32 of the said Act shall apply to the said society with

certain modifications and to permit the Registrar of Co­operative Societies to

extend the term of the administrator appointed under sub­section (1) section 32

of the said Act to manage the affairs of the said society for a further period of one

year from 12^th November, 2023 to 11^th November, 2024 or till a newly elected

committee enters upon office, whichever is earlier;

NOW, THEREFORE, in exercise of the powers conferred by section 101 of

the Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of

Kerala hereby direct that provisions of sub­section (1) of section 32 of the said

Act shall apply to the Kottayam Housing Co­operative Society Ltd. No. K. 348 in

Kottayam District with the modification of substituting the words “eleven years”

for the words “six months” for the purpose of enabling the Registrar of Co­

operative Societies to extend the term of the administrator appointed under sub­

section (1) of section 32 of the said Act to manage the affairs of the said society

for a further period of one year from 12^th  November, 2023 to 11^th  November,

2024 or till a newly elected committee enters upon office, whichever is earlier, to

avoid administrative vacuum in the said society.

The term of the administrative committee appointed under sub­section (1)

of section 32 of the Kerala Co­operative Societies Act, 1969 (21 of 1969), to

manage the affairs of the Kottayam Housing Co­operative Society Ltd. No. K.348

in   Kottayam   District   expired   on   11^th  November,   2014.     The   term   of   the

administrator of the said society lastly extended for a period of one year from

12^th November, 2022 to 11^th November, 2023 in pursuance of notification issued

under G.O.(P)  No.75/2023/Co­op  dated  14^th  March,  2023 and published as

S.R.O. No.397/2023 in the Kerala Gazette Extraordinary No.1053 dated 22^nd

March, 2023 and the period so extended also expired on 11^th November, 2023.

The Registrar of Co­operative Societies has reported that the election to the

Board of Directors of the said society could not be conducted within the period

and has requested to permit him to extend the term of  administrator of the said

society for  a  further  period of  one  year from  12^th  November,   2023  to 11^th

November, 2024 or till a newly elected committee enters upon office, whichever

is earlier, to avoid administrative vacuum in the said society. The Government

have considered the matter in detail and are satisfied that it is necessary, in

public interest, to direct that the provisions of sub­section (1) of section 32 of the

said Act shall apply to the said society with certain modifications and to permit

the Registrar of Co­operative Societies to extend the term of the administrator

appointed under sub­section (1) of section 32 of the said Act to manage the

affairs of the said society for a further period of one year from 12^th November,

2023 to 11^th  November, 2024 or till a newly elected committee enters upon

office, whichever is earlier, to avoid administrative vacuum in the said society.

This order is intended to achieve the above object.
