NOTIFICATION
In exercise of the powers conferred by section 71
of the Kerala Revenue Recovery Act, 1968 (15 of 1968), the Government of
Kerala, being satisfied that it is necessary to do so in public interest, hereby
declare that the provisions of the said Act shall be applicable to the recovery of
amounts due from any person or class of persons to the ESAF Small Finance
Bank if ESAF Small Finance Bank satisfies the provisions in S.R.O. No.1465/87
dated 13.10.1987, only in connection with loans falling under Agriculture,
Education, Housing and Micro Small Medium Enterprises for which the
provisions of the Securitisation And Reconstruction of Financial Assets and
Enforcement of Security Interest Act, 2002 (Central Act 54 of 2002) are not
applicable.

Explanatory Note
(This does not form part of the notification, but is intended to indicate its
general purport.)
For ensuring realization of amounts due to the ESAF Small Finance Bank
if ESAF Small Finance Bank satisfies the provisions in S.R.O. No.1465/87 dated
13.10.1987, from any person or class of person only in connection with loans falling
under Agriculture, Education, Housing and Micro Small Medium Enterprises for
which the provisions of the Securitisation And Reconstruction of Financial Assets and
Enforcement of Security Interest Act, 2002 (Central Act 54 of 2002) are not
applicable. The Government have decided that it is necessary to do so, in public
interest, to make applicable the provisions of the Kerala Revenue Recovery Act, 1968
(15 of 1968) to the ESAF Small Finance Bank.
The notification is intended to achieve the above object.
