ORDER

        

       WHEREAS, under sub­section (1) of section 33 of the Kerala Co­operative Societies

Act, 1969 (21 of 1969), the term of an administrator or an administrative committee

appointed to manage the affairs of a society shall not exceed one year in the aggregate;

       AND WHEREAS, the said term of one year of the Administrator appointed under

sub­section (1) of section 33 of the said act to manage the affairs of the Kuttanad Taluk

Co-operation (C) Department

Private Secondary Teachers Co­operative Society Limited No. A. 843 in Alappuzha

District expired on 3^rd  February, 2021;

        AND   WHEREAS,   under   sub­section   (1A)   of   section   33   of   the   said   Act,   the

Government may, by notification in the Gazette, for reasons to be recorded, permit the

Registrar of Co­operative Societies to extend the term of the said administrator or

administrative committee appointed to manage the affairs of a society for a further

period not exceeding one year in the aggregate or till a newly elected committee enters

upon office, whichever is earlier;

       AND WHEREAS, the Registrar of Co­operative Societies has reported that the

election to the Board of Directors of the said society could not be conducted within the

period and has requested to extend the term of the Administrator for a further period

of four years from 4^th   February, 2021 to 3^rd   February,  2025 or till a newly elected

committee enters upon office, whichever is earlier to avoid administrative vacuum in

the said society;

         AND WHEREAS, the Government have examined the matter in detail and are

satisfied that it is necessary, in public interest to direct that the provisions of sub­

section (1A) of section 33 of the said Act shall apply to the said society with certain

modification and to permit the Registrar of Co­operative Societies to extend the term of

the Administrator appointed to manage the affairs of the said society for a further

period of four years from 4^th  February, 2021 to 3^rd  February, 2025 or till a newly

elected committee enters upon office, whichever is earlier;

     NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala

Co­operative Societies Act, 1969 (21 of 1969), the Government of Kerala here by direct

that provisions of sub­section (1A) of section 33 of the said Act shall apply to the

Kuttanad Taluk Private Secondary Teachers Co­operative Society Limited No. A. 843 in

Alappuzha District with the modification of substituting the words 'four years' for the

words 'one year' and in exercise of the powers under sub­section (1A) of section 33 of

the said Act, as so modified, permit the Registrar of Co­operative Societies to extend

the term of the Administrator appointed to manage the affairs of the said society for a

further period of four years from 4^th  February, 2021 to 3^rd  February, 2025, or till a

newly   elected   committee   enters   upon   office,   whichever   is   earlier   to   avoid

administrative vacuum in the said society.

Explanatory Note 

         (This does not form part of the order, but is intended to indicate its general

purport.)

The term of the Administrator appointed under sub­section (1) of section 33 of

the Kerala Co­operative Societies Act, 1969 (21 of 1969) to manage the affairs of the

Kuttanad Taluk Private Secondary Teachers Co­operative Society Limited No. A.843 in

Alappuzha   District   expired   on   3^rd  February,   2021.   The   Registrar   of   Co­operative

Societies has reported that the election to the Board of Directors of the said society

could not be conducted within the period and has requested to extend the term of the

administrator for a further period of four years from 4^th February, 2021 to 3^rd February,

2025. The Government have examined the matter in detail and are satisfied that it is

necessary, in public interest, to permit the Registrar of Co­operative Societies to extend

the term of the Administrator appointed to manage the affairs of the said society for a

further period of four years from 4^th  February, 2021 to 3^rd  February, 2025 or till a

newly   elected   committee   enters   upon   office,   whichever   is   earlier,   to   avoid

administrative vacuum.

     This order is intended to achieve the above object.
