               WHEREAS, under sub­section (1) of section 32 of the Kerala Co­operative

Societies   Act,   1969   (21   of   1969),   the   Joint   Registrar   of   Co­operative   Societies

(General), Kottayam had issued orders for suspending the Managing Committee of the

Poonjar Service Co­operative Bank Limited No.3963 in Kottayam District and had

appointed an administrator to manage the affairs of the said Bank under sub­section

(1) of section 32 of the said Act;

         AND WHEREAS, under sub­section (1) of section 32 of the said Act, the term of

an administrator or administrative committee, appointed to manage the affairs of the

society shall not exceed six months in aggregate provided that in the case of Co­

operative Society, carrying on the business of banking, appointment of administrator or

administrative committee shall not exceed one year in the aggregate;

          AND WHEREAS, the said term of one year of the administrator appointed under

sub­section (1) of section 32 of the said Act to manage the affairs of the Poonjar

Service Co­operative Bank Limited No. 3963 in Kottayam District expired on 17^th

December, 2019;

        AND WHEREAS, the term of administrator of the said bank was extended for a

period of six months from 18^th  December, 2019 to 17^th  June, 2020 in pursuance of

notification issued under G.O.(P)No.122/2020/Co­op. dated 13^th  October, 2020 and

published as S.R.O.No.738/2020 in the Kerala Gazette Extraordinary No.2666 dated 8^th

November, 2020 and further extended for a period of two years from 18^th  June, 2020

to 17^th June, 2022 in pursuance of notification issued under G.O.(P)No.143/2022/Co­

op. dated 12^th August, 2022 and published as S.R.O.No.878/2022 in the Kerala Gazette

Extraordinary No.3118 dated 14^th  September, 2022, and further extended for a period

of six months from 18^th June, 2022 to 17^th December, 2022 in pursuance of notification

issued under G.O.(P)No.220/2022/Co­op. dated 29^th November, 2022 and published as

S.R.O.   No.1164/2022   in   the   Kerala   Gazette   Extraordinary   No.4100   dated   2nd

December, 2022 and further extended for a period of six months from 18^th  December,

2022   to   17^th

 June,   2023   in   pursuance   of   notification   issued   under   G.O.

(P)No.43/2023/Co­op. dated 24^th February, 2023 and published as S.R.O.No.263/2023

in the Kerala Gazette Extraordinary No.693 dated 27^th  February, 2023, and further

extended for a period of six months from 18^th  June, 2023 to 17^th  December, 2023 in

pursuance of notification issued under G.O.(P)No.191/2023/Co­op. dated 26^th August,

2023 and published as S.R.O.No.925/2023 in Kerala Gazette Extraordinary No.2855

dated 4^th  September, 2023 and extended for a further period of six months from 18^th

December, 2023 to 17^th  June, 2024 in pursuance of notification issued under G.O.

(P)No.42/2024/Co­op. dated 2^nd March, 2024 and published as S.R.O.No.252/2024 in

Kerala Gazette Extraordinary No.878 dated 7^th March, 2024 and the period so extended

expired on 17^th  June, 2024;

         AND WHEREAS, the Registrar of Co­operative Societies has reported that the

election to the Board of Directors of the said Bank could not be conducted within the

extended period due to pending disposal of writ petition WP(C) 42547/2018 before the

Hon’ble High Court with regard to the removal of the previous governing body and the

cancellation of the election proceedings and has therefore requested the Government to

extend the term of the administrator for a further period of six months from 18^th June,

2024 to 17^th  December, 2024 or till a newly elected committee enter upon office,

whichever is earlier, to avoid administrative vacuum in the said Bank;

       AND WHEREAS, the Government have considered the matter in detail and are

satisfied that it is necessary, in public interest, to direct that the provisions of sub­

section (1) of section 32 of the said Act shall apply to the said Bank with certain

modification and to permit the Registrar of Co­operative Societies to extend the term of

the administrator appointed to manage the affairs of said Bank for a further period of

six months from 18^th  June, 2024 to 17^th   December, 2024 or till a newly elected

committee enters upon office, whichever is earlier;

           NOW, THEREFORE, in exercise of the powers conferred by section 101 of the

Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of Kerala here

by direct that provisions of sub­section (1) of section 32 of the said Act shall apply to

the Poonjar Service Co­operative Bank Limited No. 3963 in Kottayam District with the

modification of substituting the words " five years " for the words “one year” and in

exercise of powers under sub­section (1) of section 32 of the said Act, as so modified to

permit the Registrar of Co­ operative Societies to extend the term of the administrator

appointed to manage the affairs of the said Bank for a further period of six months

from 18^th  June, 2024 to 17^th  December, 2024 or till a newly elected committee enters

upon office, whichever is earlier, to avoid administrative vacuum in the said Bank.

Explanatory Note

(This does not form part of the order, but is intended to indicate its general

purport.)

        The term of the administrator appointed under sub­section (1) of section 32

of the Kerala Co­operative Societies Act, 1969 (21 of 1969), to manage the

affairs of the Poonjar Service Co­operative Bank Limited No.3963 in Kottayam

District expired on 17^th December, 2019. The term of administrator of the said

bank was lastly extended for a further period of six months from 18^th  December,

2023   to   17^th  June,   2024   in   pursuance   of   notification   issued   under   G.O.

(P)No.42/2024/Co­op.   dated   2^nd 

March,   2024   and   published   as

S.R.O.No.252/2024 in Kerala Gazette Extraordinary No.878 dated 7^th  March,

2024 and the period so extended also expired on 17^th  June, 2024. The Registrar

of Co­operative Societies has reported that election to the said Bank could not be

conducted within the above period due to pending disposal of writ petition

WP(C) 42547/2018 before the Hon’ble High Court with regard to the removal of
