Explanatory Note
(This does not form part of the notification, but is intended to indicate its general
purport.)
As per rule 13A(1) of Part II of the Kerala State and Subordinate Services Rules, 1958,
temporary exemption for passing special or departmental test for appointment/promotion to a
post is granted subject to the condition that if the person does not pass the test within three years
from the date of such appointment, the person shall be reverted to the lower post, as per sub-rule
(2) thereunder. The said rule does not contemplate granting temporary exemption for passing
departmental test prescribed for declaration of probation. But without considering the said

aspect, the rule has been misinterpreted and the benefit has been extended in the case of
departmental test prescribed for declaring probation which leads to many litigation and disputes.
Hence, the Government have decided to amend the said Rules by inserting a proviso after clause
(b) of sub rule (1) of Rule 13A.
The notification is intended to achieve the above object.
