ORDER

WHEREAS, under sub­section (3) of section 32 of the Kerala Co­operative

societies Act, 1969 (21 of 1969), the Joint Registrar of Co­operative Societies

(General)   had   issued   orders   superseding   the   managing   committee   of   the

Thakazhi Service Co­operative Bank Limited No.1832 in Alappuzha District and

appointed an administrator to manage the affairs of the said Bank under sub­

Co-operation (C) Department

section (1) of the said section;

       AND WHEREAS, the term of one year of the administrator appointed under

sub­section (1) of section 32 of the said Act to manage the affairs of the Thakazhi

Service Co­operative Bank Limited No.1832 in Alappuzha District expired on 18^th

February, 2014;

       AND WHEREAS, under sub­section (1) of section 32 of the said Act, the term

of an administrator or administrative committee appointed to manage the affairs

of a society shall not exceed six months in the aggregate, provided that in the

case of a co­operative society, carrying on the business of banking, appointment

of administrator or administrative committee shall not exceed one year in the

aggregate;

       AND WHEREAS, the term of the administrator of the said Bank was further

extended for a period of two years from 19^th  February, 2014 to 18^th  February,

2016 in pursuance of notification issued under G.O.(P)No.92/2015/Co­op. dated

29^th  July, 2015 and published as S.R.O.No. 530/2015 in the Kerala Gazette

Extraordinary No.1905 dated 13^th  August, 2015 and the term was extended

further for a period of one year from 19^th  February, 2016 to 18^th  February, 2017

in pursuance of notification issued under G.O.(P)No.66/2016/Co­op. dated 29^th

June,   2016   and   published   as   S.R.O.No.   458/2016   in   the   Kerala   Gazette

Extraordinary No.1170 dated 2^nd  July, 2016, and the term was extended further

for a period of one year from 19^th   February, 2017 to 18^th  February, 2018 in

pursuance of notification issued under G.O.(P)No.02/2018/Co­op. dated 17^th

January,   2018   and   published   as   S.R.O.No.122/2018   in   the   Kerala   Gazette

Extraordinary No.501 dated 3^rd March, 2018 and the administrator was replaced

with an administrative committee which took charge on 31^st  October, 2017 and

the term of the administrative committee was extended for one year from 19^th

February, 2018 to 18^th  February, 2019 i n pursuance of notification issued under

G.O.(P)No.148/2018/Co­op.   dated   5^th

 November,   2018   and   published   as

S.R.O.No. 804/2018 in the Kerala Gazette Extraordinary No.2847 dated 16^th

November, 2018 and the term was extended further for a period of one year

from 19^th   February, 2019 to 18^th  February, 2020 in pursuance of notification

issued   under   G.O.(P)No.156/2020/Co­op.   dated   20^th  November,   2020   and

published as S.R.O No.842/2020 in the Kerala Gazette Extraordinary No.2897

dated 27^th   November, 2020 and the period so extended also expired on 18^th

February, 2020; 

      AND WHEREAS, the Registrar of Co­operative Societies has reported that the

election to the Board of Directors of the said Bank could not be conducted within

the extended period due to paucity of funds and that steps are being taken for

the revitalization of the said Bank and has requested to extend the term of the

administrative committee for a further period of five years from 19^th  February,

2020 to 18^th  February, 2025 or till a newly elected committee enters upon office,

whichever is earlier, to avoid administrative vacuum in the said Bank;

      AND WHEREAS, the Government have examined the matter in detail and are

satisfied that it is necessary, in public interest, to direct that the provisions of

sub­section (1) of section 32 of the said Act shall apply to the said Bank with

certain modifications and to permit the Registrar of Co­operative Societies to

extend the term of the administrative committee appointed to manage the affairs

of the said Bank for a further period of five years from 19^th February, 2020 to 18^th

February, 2025 or till a newly elected committee enters upon office, whichever is

earlier ;

         NOW, THEREFORE, in exercise of the powers conferred by section 101 of

the Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of

Kerala hereby direct that the provisions of sub­section (1) of section 32 of the

said Act shall apply to the Thakazhi Service Co­operative Bank Limited No.1832

in Alappuzha District with the modifications of substituting the words “ten years”

for the words “one year” and in exercise of powers under sub­section (1) of

section 32 of the said Act, as so modified, permit the Registrar of Co­operative

Societies   to   extend   the   term   of   the   administrative   committee   appointed   to

manage the affairs of the said Bank for a further period of five years from 19^th

February, 2020 to 18^th February, 2025 to avoid administrative vacuum in the said

Bank.

          The term of the administrator appointed under sub­section (1) of section

32 of the Kerala Co­operative Societies Act, 1969 (21 of 1969), to manage the

affairs of the Thakazhi Service Co­operative Bank Limited No.1832 in Alappuzha

District expired on 18^th  February, 2014. The appointment of the administrator

was replaced with an administrative committee and the term was lastly further

extended for a period of one year from 19^th February, 2019 to 18^th   February,

2020   in   pursuance   of   notification   issued   under   G.O.(P)No.156/2020/Co­op.

dated 20^th November, 2020 and published as S.R.O No.842/2020 in the Kerala

Gazette Extraordinary No.2897 dated 27^th  November, 2020 and the period so

extended also expired on 18^th   February, 2020. The Registrar of Co­operative

Societies has reported that the election to the Board of Directors of the said Bank
