ORDER

     WHEREAS, under sub­section (3) of section 32 of the Kerala Co­operative Societies

Act, 1969 (21 of 1969), the Joint Registrar of Co­operative Societies (General) had

issued orders superseding the managing committee of Mukkom Service Co­operative

Bank Limited No. F 1241 in Kozhikkode District and appointed an administrative

committee to manage the affairs of the said Bank under sub­section(1) of the said

Co-operation (C) Department

      AND WHEREAS, the term of one year of the administrative committee appointed

under sub­section (1) of section 32 of the said Act, to manage the affairs of the

Mukkom Service Co­operative Bank Limited No. F1241 in Kozhikkode District expired

on 19^th  July, 2024;

      AND WHEREAS, under sub­section (1) of Section 32 of the said Act, the term of

Administrator   or   Administrative   Committee   appointed   to   manage   the   affairs   of   a

society shall not exceed six months in the aggregate provided that in the case of a Co­

operative society, carrying on the business of Banking, appointment of Administrator or

Administrative Committee shall not exceed one year in the aggregate;

      AND WHEREAS, the term of the administrative committee of the said Bank was

extended further for a period of six months from 20^th  July, 2024 to 19th January, 2025

in pursuance of Notification issued under G.O(P) No.136/2024/Co­op dated 11^th  July,

2024   and   published   as   S.R.O.No.   609/2024   in   the   Kerala   Gazette   Extraordinary

No.2244 dated 11^th  July, 2024 and the period so extended also will expire on 19^th

January, 2025;

        AND WHEREAS, the Registrar of Co­operative Societies has reported that election

to the said Bank could not be conducted within the above said period due to WP(C)

32495/2024 pending before Hon’ble High Court of Kerala and has requested to extend

the term of the administrative committee for a further period of six months from 20^th

January, 2025 to 19^th  July, 2025 or till a newly elected committee enters upon office,

which ever is earlier, to avoid administrative vacuum;

       AND WHEREAS, the Government have considered the matter in detail and are

satisfied that it is necessary, in public interest, to direct that the provisions of sub­

section (1) of section 32 of the said act shall apply to Mukkom Service Co­operative

Bank Limited No.F 1241 in Kozhikkode District with certain modifications and to

permit the Registrar of Co­operative Societies to extend the term of the administrative

committee appointed to manage the affairs of the said society for a further period of six

months from 20^th  January, 2025 to 19^th  July, 2025 or till a newly elected committee

enters upon office, which ever is earlier;

           NOW, THEREFORE, in exercise of the powers conferred by section 101 of the

Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of Kerala here

by direct that the provisions of sub­section (1) of section 32 of the said act shall apply

to Mukkom Service Co­operative Bank Limited No. F1241 in Kozhikkode District with

certain modification of substituting the words “two years” for the words “one year” and

in exercise of powers conferred under sub­section (1) of section 32 of the said Act, as

so modified permit the Registrar of Co­operative Societies to extend the term of the

Administrative Committee appointed to manage the affairs of the said Bank for a

further period of six months from 20^th January, 2025 to 19^th  July, 2025 or till a newly

elected committee enters upon office, whichever is earlier, to avoid administrative

vacuum.

Bank Limited No. F1241 in Kozhikkode District expired on 19^th  July, 2024. The term of

the administrative committee of the said Bank was extended further for a period of six

months from 20^th  July, 2024 to 19^th  January, 2025 in pursuance of Notification issued

under G.O(P) No.136/2024/Co­op dated 11^th  July, 2024 and published as S.R.O. No.

609/2024 in the Kerala Gazette Extraordinary No.2244 dated 11^th  July, 2024 and the

period so extended also will expire on 19th January, 2025. The Registrar of Co­

operative Societies has reported that election to the said Bank could not be conducted

within the extended period due to WP(C) 32495/2024 pending before Hon’ble High

Court of Kerala and requested to extend the term of administrative committee for a

further period of six months from 20^th January, 2025 to 19^th  July, 2025 or till a newly

elected committee enters upon office which ever is earlier. The Government have

considered the matter and are satisfied that it is necessary, in public interest to direct

that the provisions of sub­section (1) of section 32 of the said act shall apply to the said

Bank with certain modification and permit the Registrar of Co­operative Societies to

extend the term of the Administrative Committee appointed to manage the affairs of

the said Bank for a further period of six months from 20^th  January, 2025 to 19^th  July,

2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid

administrative vacuum.

      This order is intended to achieve the above object.
