WHEREAS,   under   sub­section   (1)   of   section   33   of   the   Kerala   Co­operative

societies Act, 1969 (21 of 1969), the term of an administrator or an administrative

committee appointed to manage the affairs of a society shall not exceed one year in the

aggregate;

      AND WHEREAS, the said term of one year of the administrator appointed under

sub­section (1) of section 33 of the said Act to manage the affairs of the Kodikulam

Service   Co­operative   Bank   Limited   No.   2823   in   Idukki   District   expired   on   4^th

November, 2020;

        AND   WHEREAS,   under   sub­section   (1A)   of   section   33   of   the   said   Act,   the

Government may, by notification in the Gazette, for reasons to be recorded, permit the

Registrar of Co­operative Societies to extend the term of the said administrator or

administrative committee for a further period not exceeding one year in the aggregate

or till a newly elected committee enters upon office, whichever is earlier;

        AND WHEREAS, the term of the administrator of the said Bank was extended

further for a period of one year from 5^th  November, 2020 to 4^th  November, 2021 in

pursuance of Notification issued under G.O(P) No.63/2022/Co­op dated 25^th  April,

2022   and   published   as   S.R.O.No.   520/2022   in   the   Kerala   Gazette   Extraordinary

No.1734 dated 27^th  May, 2022 and extended for a further period of one year from 5^th

November, 2021 to 4^th  November, 2022 in pursuance of Notification issued under

G.O(P) No.227/2022/Co­op dated 12^th  December, 2022 and published as S.R.O.No.

1215/2022 in the Kerala Gazette Extraordinary No.4297 dated 17^th  December, 2022

and  extended  for   a   further   period   of   one   year   from   5^th  November,   2022   to   4th

November, 2023 in pursuance of Notification issued under G.O(P) No. 36/2023/Co­op

dated 14^th February, 2023 and published as S.R.O.No. 208/2023 in the Kerala Gazette

Extraordinary No.522 dated 14^th February, 2023, and extended for a further period of

one year from 5^th November, 2023 to 4^th November, 2024 in pursuance of Notification

issued   under   G.O(P)   No.   62/2024/Co­op   dated   3^rd  April,   2024   and   published   as

S.R.O.No. 372/2024 in the Kerala Gazette Extraordinary No.1264 dated 4^th April, 2024

and the period so extended also expired on 04^th  November, 2024;

         AND WHEREAS, the Registrar of Co­operative Societies has reported that the

election to the Board of Directors of the said bank could not be conducted within the

period and has requested to extend the term of administrator for a further period of

one year from 5^th  November, 2024 to 4^th  November, 2025 or till a newly elected

committee enters upon office, whichever is earlier, to avoid administrative vacuum in

the said Bank;

         AND WHEREAS, the Government have considered the matter in detail and are

satisfied that it is necessary, in public interest, to direct that the provisions of sub­

section (1A) of section 33 of the said Act shall apply to the said bank with certain

modification and to permit the Registrar of Co­operative Societies to extend the term of

the administrator appointed to manage the affairs of the said Bank for a further period

of one year from 5^th  November, 2024 to 4^th  November, 2025 or till a newly elected

committee enters upon office, whichever is earlier;

        NOW, THEREFORE, in exercise of the powers conferred by section 101 of the

Kerala Co­operative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby

direct that provisions of sub­section 1A of section 33 of the said Act shall apply to

Kodikulam Service Co­operative Bank Limited No. 2823, in Idukki District, with the

modification of substituting the words “five years” for the word “one year” and in

exercise of powers under sub­section (1A) of section 33 of the said Act, as so modified,

permit the Registrar of Co­operative Societies to extend the term of the administrator

appointed to manage the affairs of the said Bank for a further period of one year from

5^th  November, 2024 to 4^th  November, 2025  or till a newly elected committee enters

upon office, whichever is earlier, to avoid administrative vacuum in the said Bank.

Explanatory Note

  (This does not form part of the order, but is intended to indicate its general

purport.)

        The term of the administrator appointed under sub­section (1) of section 33 of the

Kerala Co­operative Societies Act, 1969 (21 of 1969), to manage the affairs of the

Kodikulam Service Co­operative Bank Limited No. 2823, in Idukki District expired on

04^th  November, 2020.  The term of the administrator of the said  Bank was  lastly

extended for a further period of one year from 5^th November, 2023 to 4^th November,

2024 in pursuance of Notification issued under G.O(P) No. 62/2024/Co­op dated 3^rd

April, 2024 and published as S.R.O.No. 372/2024 in the Kerala Gazette Extraordinary

No.1264 dated 4^th  April, 2024 and the term so extended expired on 04^th  November,

2024. The Registrar of Co­operative Societies has reported that the election to the

Board of Directors of the said bank could not be conducted within the period and has

requested to extend the term of the administrator for a further period of one year from

5^th November, 2024 to 4^th November, 2025 in order to avoid administrative vacuum.

The Government have considered the matter in detail and are satisfied that it is

necessary, in the public interest to permit the Registrar of Co­operative Societies to

extend the term of the administrator appointed to manage the affairs of the said Bank

for a further period of one year from 5^th November, 2024 to 4^th  November, 2025 or till

a   newly   elected   committee   enters   upon   office,   whichever   is   earlier,   to   avoid

administrative vacuum in the said bank;

        This order is intended to achieve the above object.
