WHEREAS, under rule 185 A of the Kerala Co- operative Societies

Rules, 1969, the committee of a society may with the prior approval of the

Registrar, appoint persons who are technically or professionally qualified or

persons with experience and expertise by way of deputation or on a contract

basis for a specified period not exceeding five years;

AND WHEREAS, under the provisions to the said rules no such

contract appointment shall be made to the posts mentioned in sub-rules (2), (3)

and (4) of rule 185 or to any other post in any Society, which is engaged in

banking business;

AND WHEREAS, vide G.O.(Rt)No.222/2020/Co-op dated 07^th May,

2020 and G.O.(Rt)No.714/2022/Co-op dated 01^th November, 2022, the

Government of Kerala approved the post of Chief Legal Officer provisionally

till the new special rule came into effect. Accordingly, Sri.Pushkarakshan V.P

appointed as Chief Legal Officer for a period of one year from 9^th February,

2023 to 8^thFebruary, 2024 and term expired on 8^th February, 2024;

AND WHEREAS, the Board of Directors of Kerala Bank has resolved

to request the Government of Kerala through Registrar of Co-operative

Societies to exempt the said bank from the provisions of rule 185 A of the

Kerala Co-operative Societies Rules, 1969, for the purpose of enabling the

said Bank to appoint Sri.Pushkarakshan V.P as Chief Legal Officer on contract

basis for a period of one year from 9^th February, 2024 on a consolidated pay

of Rs.1,00,000/-(Rupees one lakh only) per month, considering the

qualification and experience;

AND WHEREAS, the Government have examined the matter in detail

and are satisfied that it is necessary to exempt the said Bank from the

provisions of rule 185 A of the Kerala Co-operative Societies Rules, 1969, for

the purpose of enabling the said Bank to appoint Sri.Pushkarakshan V.P as

Chief Legal Officer on contract basis for a period of one year from 9^th

February 2024 on a consolidated pay of Rs.1,00,000/-(Rupees one lakh only)

per month;

Now, THEREFORE, in exercise of the powers conferred by rule 181 of

the Kerala Co-operative Societies Rules, 1969, the Government of Kerala

hereby exempt the Kerala State Co-operative Bank from the provisions of rule

185 A of the said Rules, so as to enable the said Bank to appoint Sri.

Pushkarakshan V.P as Chief Legal Officer on contract basis for a period of one

year from 9^th February, 2024 on a consolidated pay of Rs.1,00,000/-(Rupees

one lakh only) per month.

Explanatory Note

(This does not form part of the order, but it is intended to indicate the general

purport)

As per rule 185A of the Kerala Co operative Societies Rules, 1969, the

committee of a society may, with the prior approval of the registrar, appoint

persons who are technically or professionally qualified or persons with

experience and expertise by way of deputation or on a contract basis for a

specified period not exceeding five years. Under the provisions to the said

rules no such contract appointment shall be made to the posts mentioned in

sub-rules (2), (3) and (4) of rule 185 or to any other post in any Society, which

is engaged in banking business. Vide G.O.(Rt)No.222/2020/Co-op dated 07^th

May, 2020 and G.O.(Rt)No.714/2022/Co-op dated 01^th November, 2022, the

Government of Kerala approved the post of Chief Legal Officer provisionally

till the new special rule came into effect. Accordingly, Sri.Pushkarakshan V.P

appointed as Chief Legal Officer for a period of one year from 9^th February,

2023 to 8^thFebruary, 2024 and term expired on 8^th February, 2024. The Board

of Directors of Kerala State Co operative Bank has requested the Government

through Registrar of Co-operative Societies to exempt the said Bank from the

provisions of rule 185 A of the Kerala Co-operative Societies Rules, 1969, for

consolidated pay of Rs 1,00,000/- (Rupees one lakh only) per month on the

said Bank. The Government have considered the matter in detail and have

decided to exempt the said Bank from the provisions of rule 185 A of the

Kerala Co-operative Societies Rules, 1969, so as to enable the said Bank to

appoint Sri.Pushkarakshan V.P as Chief Legal Officer on contract basis for a

period of one year from 9^thFebruary, 2024 on a consolidated pay of

Rs.1,00,000/-(Rupees One Lakh only), considering his qualification and

experience.
