In exercise of the powers conferred by sub-section (1) of section 10 of the Contract

Labour (Regulation and Abolition) Act, 1970 (Central Act 37 of 1970), the Government of Kerala, after

consultation with the State Advisory Contract Labour Board constituted under sub-section (1) of

section 4 thereof, and after having considered the conditions of work and benefits provided for the

contract labour in the institution of P.M.S. Dental College, Vattappara, Thiruvananthapuram and all

other relevant factors, having found that the employment in the cleaning category in the P.M.S. Dental

College, Vattappara, Thiruvananthapuram, is of permanent nature, hereby prohibit, with effect from the

date of publication of this notification in the Gazette, the employment of contract labour in the

cleaning category in the said institution.

Explanatory Note

(This does not form part of the notification, but is intended its general purport.)

Under sub-section (1) of section 10 of the Contract Labour (Regulation and Abolotion) Act,

1970 (Central Act 37 of 1970), Government may, after consultation with the State Advisory Contract

Labour Board, prohibit, by notification in the Gazette, employment of contract labour in any process,

operation or other work in any establishment. The complaint of the Private Hospital Workers Congress

(INTUC (I)) regarding the contract labour employed in the institution of P.M.S. Dental College,

Vattappara, Thiruvananthapuram were accordingly referred to the State advisory Contract Labour

Board. The Advisory Board after considering all relevant factors in detail has advised the Government

that as the employment in the cleaning category in the P.M.S. Dental College, Vattappara,

Thiruvananthapuram is of a permanent nature, the employment of contract labour in cleaning category

in the said institution may be prohibited. The Government, after examine the matter in detail, have

decided to prohibit the employment of contract labour in the said category in the institution of P.M.S.

Dental College, Vattappara, Thiruvananthapuram.

The notification is intended to achieve the above object.
