Vol. 45 dated 19.09.2000 as Sl.No.21 and Erratum Notification vide EFL12-252/2006 dated 18.01.2007 published in Gazette No. 8,

Explanatory Note

(This does not form part of the Notification, but is intended to serve its general purport)

An approximate extent of 8.5653 Ha of land in Survey No. 403/3, 5A of Kuzhalmannam 1 Village in Alathur Taluk in

Palakkad District was originally notified as Ecologically Fragile Land under Section 3(2) of the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act, 2003 ordinance 2000 vide Notification No.C4-21437/2000 dated 26.08.2000,

published in Kerala Gazette No.37, Vol. 45 dated 19.09.2000 as Sl. No.21. Later an Erratum Notification vide EFL12-252/2006

dated 18.01.2007 was published in Gazette No.8, Vol-52, dated 20.02.2007 corrected the extent as 3.5653 Ha.

The Hon’ble EFL tribunal, Palakkad in the judgment dated 31.10.2015 in EFL OA 12/2009 and Hon’ble High Court in the

judgment dated 28.11.2024 in MFA 144/2018 declared that the land does not come under the purview of Ecologically Fragile Land.

Hence and extent of 3.5653 Ha land in Survey No. 403/3, 5A of Kuzhalmannam 1 Village in Alathur Taluk in Palakkad District is de-

notified from the purview of Ecologically Fragile Lands. This de-notification is intended to achieve the above purpose.

CONDITIONS

1.

Bidders shall remit the e-tender document fee and the Earnest Money Deposit using online payment

option of e-procurement system only and submitted through the internet online banking of State Bank

of India or through NEFT for other banks. Bidders opting for NEFT facility of online payment are

advised to exercise this option at least 48 hours before the closing date of bid to ensure that payment

towards tender document fees and EMD are credited and a confirmation is reflected in the e-

procurement system. The online NEFT remittance form provided by e-procurement system for

making a NEFT transaction is not a payment confirmation. Kerala Forest Department/NIC/ SBI shall

not be responsible for any kind of delay in payment status confirmation.

The contractor must have a valid PWD Electric License.

3.

Bidders are requested to submit scanned copy of the following documents - Registration certificate

duly attested by the Superintending Engineer/ Executive Engineer, PWD Kerala, GST Registration

certificate, PAN, Bank details, EMD exemption certificate (if any), preliminary agreement executed

in Kerala Stamp paper worth Rs.200/-, duly filled up proforma for availing e-payment by Online.

Technical bid and financial bid shall be submitted in their respective designated online covers.

Subsequently the hard copy of attested copy of Registration certificate, EMD exemption certificate (if

any), preliminary agreement in original, proof of prequalification etc. would be submitted offline in a

sealed cover super scribing the name of work and tender number to the office of the Divisional Forest

officer, Achencovil through speed post / registered post as prescribed in the time schedule, failing

which such tenders will be rejected.

way of Final Felling, Final Thinning and silvicultural thinning in various plantations in

Pariyaram/Vellikulangara/Palappilly Ranges stacked at Dumping Depots under Chalakudy

Division will be sold in E-Auction on dates noted below through M.S.T.C., subject to the terms

and conditions laid down in Pro(4) 29243/13 dt 21.08.2014 & subsequent amendments Pro(5)

6835/2009 dt 02.12.2009 of Additional Principal Chief Conservator of Forests (P), as per

general conditions of the sale of tree growth prevailing in the Department and general

conditions of sale of standing trees in plantations prevailing in the Department and special

Sale Conditions

1. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of Rs.20,000/- (Rupees

Twenty Five Thousand only) for Teak poles,Fire wood,Rs.25,000/- for Miscellaneous trees

,Rs.50,000/- for Teak timber till 6 pm on the previous day of the auction through e-chalan in e-

treasury in the head of account of account 0408-01-101-99-05 for participating in the e-auction.

Send the copy of above e-chalan to the e-mail id [email protected]. The buyer

registration number has to be mentioned while paying the EMD.

2. The successful Tenderers/Bidders have to remit 35% of the sale value , after adjusting E.M.D

already remitted, within 07 days from the date of confirmation. If he fails to remit this amount, the

EMD will be forfeited to Government and the area will be re-auctioned at his risk and loss.

3. In case of unsuccessful bidders , the E.M.D will be returned to the bidders

4. The successful Tenderers/Bidders have to pay GST (as per Rule), FDT, Income Tax etc at the

rate prevailing from time to time.

5. Intending tenderers/ bidders may inspect the trees/logs themselves of the quality and quantity of

the produce before participating in the auction. Complaints if any, regarding the quality and

quantity etc. received after the e-auction will not be entertained.

6. If the value fetched in the resale/re-e-auction is less than that obtained in the original e-auction,

the difference between them together with all incidental expenditure to fixing up of the resale

including notification charges as assessed by the Divisional Forest Officer concerned will be

recovered from the defaulting Tenderers/Bidders through legal means including Revenue Recovery

Act in force.

7. The confirmation of the e-auction sale will ordinarily be communicated to the party concerned as

early as possible.

8. All common conditions regarding sale coupes are also applicable to this e-auction. Further details

The Divisional Forest Officer, Palakkad reserves all the right to include or exclude any

vehicles shown in the schedule above for sale. Those who wish to participate in the e-auction

may register with MSTC Ltd. The buyer registration number has to be mentioned while paying

the EMD. If the sale value of vehicles is not paid within the specified time period against any of

the bid vehicle by the Highest, bidder, the EMD will be forfeited.

The successful bidder shall pay 50% of the bid value after adjusting the EMD already

remitted, paid within 7 working days of issuance of acceptance letter. The mode of payment is

through e-treasury of Government of Kerala or by cash in District Treasury, Palakkad. The

successful bidder shall be paid the GST with in time.

details will not be accepted. Technical bid and financial bid shall be submitted in their respective

designated online covers. The Forest department will not be responsible for any inconvenience

the permanent address and signature of the bidders duly attested by the concerned Village
