WHEREAS,  under sub­section (1) of section 32 of the Kerala Co­

operative Societies Act 1969 (Act no. 21 of 1969), the Joint Registrar of

Co­operative Societies (General), Thiruvananthapuram had issued orders

for   superseding   the   Managing   Committee   of   the   Thiruvananthapuram

District   Merchants   Labours   Co­operative   Society   Ltd.   No.   T.   1315   in

Thiruvananthapuram   District   and   had   appointed   an   administrative

committee to manage the affairs of the said society; 

AND WHEREAS, under sub­section (1) of section 32 of the  said Act,

the   term   of   an   administrator   or   administrative  committee,   appointed   to

manage the affairs of a society shall not exceed  six  months  in  the  aggregate,

provided  that  in  the  case  of co­operative society, carrying on the business of

banking, appointment of administrator or administrative committee shall not

exceed one year in the aggregate;

AND  WHEREAS,  the said term  of  one  year of the administrative

committee appointed under sub­section (1) of section 32 of the said Act to

manage the affairs of the Thiruvananthapuram District Merchants Labours

Co­operative Society  Ltd.  No.  T.  1315  in  Thiruvananthapuram  District

expired on 4^th January, 2023;

  

AND WHEREAS, the term of the administrative committee of the said

society was extended for a period of one year from 5^th January, 2023 to 4^th

January,   2024   in   pursuance   of   notification   issued   under   G.O.(P)

No.220/2023/Co­op   dated   25^th 

October,   2023   and   published   as

S.R.O.No.1130/2023 in the Kerala Gazette Extraordinary No.3493 dated 30^th

October, 2023 and the period was extended further for a period of one year

from 5^th January, 2024 to 4^th January, 2025 in pursuance of notification issued

under G.O.(P)No.213/2024/Co­op dated 28^th November, 2024 and published

as S.R.O. No.1119/2024 in the Kerala Gazette Extraordinary No.3844 dated

30^th November, 2024 and the period was extended for a further period of one

year from 5^th January, 2025 to 4^th January, 2026 in pursuance of notification

issued under G.O(P)No.51/2025/Co­op dated 21^st  April, 2025 and published

as S.R.O. No.466/2025 in the Kerala Gazette Extraordinary No.1529 dated

22^nd April, 2025 and the period was also expired on 4^th January, 2026;

AND WHEREAS, the Registrar of Co­operative Societies has reported

that  the  election  to  the  Board  of  Directors  of  the  said society could not

be   conducted   within   the   extended   period   and  has   requested   the

Government to extend the term of the administrative committee  for a

further period of one year from  5^th January, 2026 to 4^th January, 2027 or

till a newly elected committee enters upon office, whichever is earlier, to

avoid administrative vacuum in the said society;

AND  WHEREAS,  the   Government   have   examined   the  matter   in

detail and are satisfied that it is necessary, in public interest, to direct that

the provisions of sub­section (1) of Section 32 of the said Act shall apply to

the said society with certain modifications  and  to  permit  the  Registrar  of

Co­operative Societies to extend the term of the administrative committee

appointed to manage the affairs of the said society for a further period of

one year from 5^th January, 2026 to 4^th January, 2027 or till a newly elected

committee   enters   upon   office,   whichever   is   earlier  to  avoid  the

administrative vacuum in the said society;

NOW,  THEREFORE,  in   exercise   of   the   powers   conferred   under

Section  101  of  the  Kerala  Co­operative  Societies  Act,  1969 (No.21 of

1969), the Government of Kerala hereby direct that provisions of sub­

section   (1)   of   Section   32   of   the   said   Act   shall   apply   to   the

Thiruvananthapuram District Merchants Labours Co­operative Society Ltd.

No. T. 1315 in Thiruvananthapuram District with the modifications of

substituting   the   words   “four   years”   for   the   words   “one   year”   and   in

exercise of the powers under sub­section (1) of section 32 of the said Act,

as  so  modified and to  permit the Registrar of Co­operative Societies to

extend the  term  of  the  administrator  or  administrative  committee

appointed to manage the affairs of the Thiruvananthapuram District Merchants

Labours Co­operative Society Ltd. No. T. 1315 in Thiruvananthapuram District

for a further period of one year from 5^th January, 2026 to 4^th January, 2027 or

till a newly elected committee enters upon office, whichever is earlier to avoid

administrative vacuum in the said society.

The term of the administrative committee appointed under sub­section

(1) of Section 32 of the Kerala Co­operative Societies Act 1969 (21 of 1969), to

manage the affairs of the Thiruvananthapuram District Merchants Labours Co­

operative Society Ltd. No. T. 1315 in Thiruvananthapuram District expired on

4^th January, 2023 and the period was lastly extended for a period of one year

from 5^th January, 2025 to 4^th January, 2026 in pursuance of notification issued

under   G.O(P)No.51/2025/Co­op   dated   21^st  April,   2025   and   published   as

S.R.O.No. 466/2025 in the Kerala Gazette Extraordinary No.1529 dated 22^nd

April, 2025 and the period was also expired on 4^th January, 2026. The Registrar

of Co­operative Societies has reported that the election to the board of directors

of the said society could not be conducted within the extended period and has

requested to extend the term of the administrative committee for a further
