भारत के माननीय िवोच्ि न्द्यायालय द्वारा ददनांक 19-09-2022 को पाररत आदेश के

अनुपालन में िंघ राज्य प्रशािन लद्दाख ने लापता बच्िों और बच्िों के ववरुद्ध अन्द्य अपराधों

के सलए पुसलि स्टेशनों में पैरा-लीगल स्वयंिेवकों को िूिीबद्ध करने की योजना तैयार की है।

संघ राज्य लद्दाख में लापता बच्चों के शलए पुशलस स्टेिन में पैरा-लीगल स्ियंसेिकों के पैनल

की योजना।

I. पृष्ठभूशम

ननिःशु्क कानूनी िहायता और िहायता का अचधकार ककिी भी अपराध के आरोपी

व्यलतत के सलए ननष्पक्ष और उचित प्रकिया का एक अननवायष घटक है। यह अनुच्छेद

21 की गारंटी में ननदहत है। इिसलए, यह आवश्यक है कक आपराचधक प्रकिया के

िभी िरणों में न्द्याय तक पहुंि उपलब्ध हो। आपराचधक प्रकिया के शुरुआती िरण में

न्द्याय तक पहुंि का अपना महत्त्व है। यह अन्द्य बातों के अलावा, ऐिे िमय में लोगों

के अचधकारों की िुरक्षा िुननलश्ित करता है जब वे िबिे अचधक अिुरक्षक्षत होते हैं।

यह आपराचधक न्द्याय प्रणाली को मजबूत करता है।

जबकक आपराचधक मुकदमा िलाने के िरण में एक प्रसशक्षक्षत वकील की िेवाओं की

उपलब्धता और अनुमानतिः, उन लोगों के सलए मुफ्त कानूनी िहायता की उपलब्धता,

जो अपने बल पर वकील का खिष वहन नहीं कर िकते, अचधकांश न्द्यायक्षेत्रों में आम

है, किर भी पूवष-परीक्षण िरणों के दौरान कानूनी िहायता का अपना महत्त्व है। यह

ऐिे िमय में लोगों के अचधकारों की िुरक्षा िुननलश्ित करता है जब वे िबिे अचधक

अिुरक्षक्षत होते हैं। यह आपराचधक न्द्याय प्रणाली को मजबूत करता है।

बिपन बिाओ आंदोलन बनाम भारत िंघ और अन्द्य में माननीय िवोच्ि न्द्यायालय

ने ररट याचिका (सिववल) िंख्या 75/2012 के माध्यम िे कहा कक:

“प्रत्येक पुसलि स्टेशन में ववशेर् रूप िे ननदेसशत और प्रसशक्षक्षत कम िे कम

एक पुसलि अचधकारी होना िादहए, जो ककशोर अचधननयम की धारा 63 के

िंदभष में ककशोर क्याण अचधकारी के रूप में नासमत ककया जाना िादहए।

हम इि िुझाव को भी स्वीकार करने के इच्छुक हैं कक पुसलि स्टेशन में

सशफ़्ट में एक ववशेर् ककशोर अचधकारी की ड्यूटी होनी िादहए ताकक यह

िुननलश्ित ककया जा िके कक इि आदेश में ननदहत ननदेशों का ववचधवत

कायाषन्द्वयन ककया जा रहा है। सुरक्षा में और िृद्धि के शलए, हम राष्रीय

कानूनी सेिा प्राधिकरण जजसका प्रतततनधित्ि उसके सदस्य सधचि विज्ञ

अधििक्ता सुश्री अतनता िेनॉय, के माध्यम से कर रहे हैं, को भी तनदेि देते

हैं, कक पैरा-कानूनी स्ियंसेिकों, जजन्हें कानूनी सेिा प्राधिकरण द्िारा भती

ककया गया है, की सेिाओं का उपयोग ककया जाए, ताकक लापता बच्चों और

बच्चों के खखलाफ अन्य अपरािों से संबंधित शिकायतों के तनपटारे के तरीके

पर नजर रखने के शलए पुशलस स्टेिन में शिफ़्ट में कम से कम एक पैरा-

लीगल स्ियंसेिक मौजूद रहे।

यह िंवैधाननक आदेश भी है कक कानूनी िहायता एक मौसलक अचधकार है। भारत

का िंववधान अनुच्छेद 39ए पैरा लीगल स्वयंिेवकों को ववशेर् महत्त्व देता है

और इिे नीिे पुन: प्रस्तुत ककया गया है:

राज्य यह िुननलश्ित करेगा कक कानूनी प्रणाली का िंिालन िमान अविर

के आधार पर न्द्याय को बढावा दे, और ववशेर् रूप िे, न्द्याय पाने के अविर

िुननलश्ित करने के सलए उपयुतत कानून या योजनाओं या ककिी अन्द्य तरीके

िे मुफ्त कानूनी िहायता प्रदान करे। ककिी भी नागररक को आचथषक या

अन्द्य अक्षमताओं के कारण वंचित नहीं ककया जाएगा ।

िंवैधाननक आदेश के अनुिार और माननीय िवोच्ि न्द्यायालय के ननदेश पर

लद्दाख कानूनी िेवा प्राचधकरण ने लापता बच्िों के मामलों में िहायता

प्रदान करने के सलए िंघ राज्य लद्दाख के ववसभन्द्न पुसलि स्टेशनों में पैरा-

लीगल स्वयंिेवकों की िेवाएं प्रदान करने के सलए ननम्नसलखखत योजना तैयार

की है।

योजना का नाम: इि योजना को िंघ राज्य लद्दाख कानूनी िेवा प्राचधकरण

(लापता बच्िों के सलए पुसलि स्टेशनों में पैरा कानूनी स्वयंिेवक) योजना,

2023 कहा जाएगा।

योजना का प्रयोजन एिं उद्देश्य:- योजना का उद्देश्य लापता बच्िों के माता-

वपता/असभभावकों को पुसलि स्टेशन में एिआईआर/गुमशुदगी की ररपोटष दजष कराने

तथा लापता बच्िों का पता लगाने में कानूनी िेवाएं प्रदान करना है।

योजना का उद्देश्य बुननयादी प्रकृनत की कानूनी िेवाएं प्रदान करने के सलए एक

िस्ती मशीनरी प्रदान करना है; एिआईआर दजष करने में िहायता करना, ननददष्ट

पोटषल पर िॉमष 'एम' (गुमशुदा व्यलततयों की जानकारी) भरना और लापता बच्िों का

पता लगाने िे जुडे िभी िंस्थानों को िूिना भेजना िुननलश्ित करना, गुमशुदा बच्िों

का शारीररक वववरण और िोटो युतत 'ह्यू एंड िाई नोदटि' तैयार करना और

प्रकाशन हेतु भेजा जाना।

II. पररभाषाएँ:

क) लापता बच्चा– ऐिा बच्िा जो कहााँ है, उिके माता-वपता, कानूनी असभभावक या

ककिी अन्द्य व्यलतत या िंस्था लजिको कानूनी रूप िे बच्िे को िौंपा गया है, जैिा

भी मामला हो, को नहीं पता और न ही उन्द्हें बच्िे के गायब होने की पररलस्थनतयााँ

या कारण पता है। ऐिे बच्िे को तब तक लापता माना जाएगा जब तक उिका पता

न िल जाए या उिकी िुरक्षा स्थावपत न हो जाए और जब तक उिे देखभाल और

िुरक्षा की आवश्यकता है।

बी) पैरा लीगल स्ियंसेिक- पैरा-लीगल स्वयंिेवक (पीएलवी) वे व्यलतत होते हैं जो

मैदिक की न्द्यूनतम योग्यता के िाथ िमाज के ववसभन्द्न वगों िे लाए जाते हैं।

III.

बच्चे के लापता होने पर अपनाई जाने िाली प्रकिया

क) लापता बच्िे के िंबंध में सशकायत प्राप्त होने पर, तस्करी या अपहरण के मामले

के रूप में तुरंत एिआईआर दजष की जानी िादहए।

बी) बाल क्याण पुसलि अचधकारी को िूचित करें और बच्िे का पता लगाने के सलए

तत्काल कारषवाई के सलए एिआईआर को ववशेर् ककशोर पुसलि इकाई को अग्रेवर्त

करें।

ग) पुसलि के अनतररतत कतषव्य :

लापता बच्िे की हाल की तस्वीर एकत्र करें और लजला गुमशुदा व्यलतत इकाई,

गुमशुदा व्यलतत दस्ते, राष्िीय अपराध ररकॉडष ब्यूरो/मीडडया आदद के सलए प्रनतयां

बनाएं;

ii.

ननददष्ट पोटषल www.trackthemissingchild.gov.in पर िॉमष "एम" (लापता व्यलतत

िूिना प्रपत्र) भरें। ववसशष्ट ननददष्ट ''गुमशुदा व्यलतत िूिना प्रपत्र'' भरें और तुरंत

गुमशुदा दस्ता, लजला गुमशुदा व्यलतत इकाई, राष्िीय अपराध ररकॉडष ब्यूरो, राज्य

अपराध ररकॉडष ब्यूरो, केंरीय जांि ब्यूरो, पीआरिी, रेलवे पुसलि और अन्द्य िंबंचधत

िंस्थानों को भेजें।

iii.

ननददष्ट पोटषल पर िंबंचधत जानकारी अपलोड करने के बाद, लापता बच्िे या बाल

देखभाल िंस्थान के माता-वपता या कानूनी असभभावक के पते और िंपकष िोन नंबर

के िाथ ननकटतम कानूनी िेवा प्राचधकरण के कायाषलय को डाक/ईमेल द्वारा

एिआईआर की प्रनत भेजें।

iv.

प्रकाशन के सलए भेजे जाने वाले लापता बच्िे की तस्वीर और भौनतक वववरण वाले

पयाषप्त िंख्या में ह्यू एंड िाई नोदटि तैयार करें।

लापता बच्िे की तस्वीर और वववरण को यथािंभव प्रकासशत या प्रिाररत करके

व्यापक प्रिार करें।

(ए) प्रमुख िमािार पत्र

(बी) टेलीववजन/इलेतिॉननक मीडडया,

(िी) स्थानीय केबल टेलीववजन नेटवकष और

(डी) िोशल मीडडया और उिके बाद, जैिा भी मामला हो, बोडष या िसमनत या बाल

न्द्यायालय द्वारा िुधार के सलए प्रस्तुत ककया जाएगा;

vi.

लाउडस्पीकर के उपयोग और प्रमुख स्थानों पर ह्यू एंड िाई नोदटि के चिपकाने और

ववतरण के माध्यम िे आिपाि के क्षेत्र में व्यापक प्रिार करें। जनता तक पहुंिने के

सलए िोशल नेटवककिंग पोटषल, एिएमएि अलटष और सिनेमा हॉल में स्लाइड का

उपयोग ककया जा िकता है।

vii.

शहर या कस्बे के िभी आउटलेटों जैिे कक रेलवे स्टेशन, बि स्टैंड, हवाई अड्डों,

क्षेत्रीय पािपोटष कायाषलयों और अन्द्य प्रमुख स्थानों पर लापता बच्िों के मामलों के

सलए मानक िंिालन प्रकिया पर ह्यू एंड िाई नोदटि ववतररत करें।

viii.

मूवी चथएटर, शॉवपंग मॉल, पाकष, गेम पालषर जैिे रुचि के क्षेत्रों और स्थानों और ऐिे

क्षेत्र जहां लापता या भागे हुए बच्िों की पहिान की जा िकती है और उन पर नजर

रखी जा िकती है की खोज करें;

ix.

लजि क्षेत्र िे बच्िे के लापता होने की िूिना समली थी, उिके आिपाि और िभी

िंभाववत मागों, पारगमन और गंतव्यों पर स्थावपत तलोज िककषट टेलीववजन कैमरों

की ररकॉडडिंग को स्कैन करें।

ननमाषणाधीन स्थलों, अप्रयुतत भवनों, अस्पतालों और तलीननकों, िाइ्ड लाइन िेवाओं

और अन्द्य स्थानीय आउटरीि कायषकताषओं, रेलवे पुसलि और अन्द्य स्थानों िे पूछताछ

करें।

xi.

लापता बच्िों का वववरण पडोिी राज्यों के लजला अपराध ररकॉडष ब्यूरो और िीमावती

पुसलि स्टेशनों के स्टेशन हाउि अचधकाररयों (एिएिओ) को उनके अचधकार क्षेत्र में

िभी पुसलि िौककयों के प्रभाररयों िदहत भेजा जाना िादहए और िंबंचधतों के िाथ

ननयसमत बातिीत करनी िादहए ताकक अनुवती कारषवाई िुननलश्ित की जा िके।

d) पुसलि स्टेशनों पर पैनल में शासमल वकीलों और पैरा लीगल स्वयंिेवकों (पीएलवी)

के माध्यम िे लजला कानूनी िेवा प्राचधकरण की िेवाएं लें।

e) www.trakethemissingchil.gov.in पोटषल पर जानकारी अपलोड करें। यदद

जानकारी पहले ही अपलोड हो िुकी है, तो पोटषल पर अपलोड ककए गए मामले के

वववरण के िाथ अनुपालन का समलान करें।

f) बच्िे या उिके पररवार के सलए खतरे के स्तर का आकलन करें और उनकी िुरक्षा

िुननलश्ित करने के सलए तत्काल कदम उठाएं।

g) आव्रजन अचधकाररयों, िीमा िुरक्षा बल (बीएिएि), रेलवे और अन्द्य पररवहन

प्राचधकरण, प्रांतीय/क्षेत्रीय और नगरपासलका एजेंसियां, और लापता बच्िों का पता

लगाने और उनकी बरामदगी/बिाव के सलए िेवा ववतरण में शासमल कोई भी गैर

िरकारी िंगठन को भी िूचित करें।

d) पुसलि स्टेशनों पर पैनल में शासमल वकीलों और पैरा लीगल स्वयंिेवकों (पीएलवी) के

माध्यम िे लजला कानूनी िेवा प्राचधकरण की िेवाएं लें।

e) www.trakethemissingchil.gov.in पोटषल पर जानकारी अपलोड करें। यदद जानकारी पहले

ही अपलोड हो िुकी है, तो पोटषल पर अपलोड ककए गए मामले के वववरण के िाथ अनुपालन का

समलान करें।

f) बच्िे या उिके पररवार के सलए खतरे के स्तर का आकलन करें और उनकी िुरक्षा िुननलश्ित

करने के सलए तत्काल कदम उठाएं।

g) आव्रजन अचधकाररयों, िीमा िुरक्षा बल (बीएिएि), रेलवे और अन्द्य पररवहन प्राचधकरण,

प्रांतीय/क्षेत्रीय और नगरपासलका एजेंसियां, और लापता बच्िों का पता लगाने और उनकी

बरामदगी/बिाव के सलए िेवा ववतरण में शासमल कोई भी गैर िरकारी िंगठन को भी िूचित

करें।

इिसलए, यह अत्यंत आवश्यक है कक पैरा लीगल स्वयंिेवकों (पीएलवी) को कानून की

उन बुननयादी अवधारणाओं िे पररचित कराया जाए लजनका िामना हम अपने दैननक जीवन में

करते हैं। िमाज में होने वाले आम टकराव अतिर कानून की अनदेखी का नतीजा होते हैं।

हालााँकक पैरा-लीगल स्वयंिेवकों (पीएलवी) को कानूनी व्यविायी बनने के सलए प्रसशक्षक्षत नहीं

ककया जा िकता है, लेककन उन्द्हें कानूनी जानकारी दी जा िकती है। उन्द्हें नागररकों के बुननयादी

अचधकारों के बारे में िूचित ककया जाएगा ताकक उन्द्हें नागररकों के अचधकारों और कतषव्यों और

पीडडत व्यलततयों को राहत पहुाँिने के सलए कानूनी िहायता की उपलब्धता के बारे में जागरूक

ककया जा िके।

1 पैरा-लीगल स्ियंसेिकों की सेिाएं: लापता बच्िों के माता-वपता, असभभावकों और पररवार के

िदस्यों की िहायता के सलए पैरा-लीगल स्वयंिेवकों (पीएलवी) की िेवाओं का उपयोग उन्द्हें

पुसलि स्टेशनों में तैनात करके ककया जाएगा। प्रारंभ में पैरा-लीगल स्वयंिेवकों (पीएलवी) को 7

पुसलि स्टेशनों में िुबह 7:00 बजे िे शाम 6 बजे तक प्रनतननयुतत ककया जाएगा। पैरा-लीगल

स्वयंिेवकों (पीएलवी) को उनके िंज्ञान में आने वाले ककिी भी मामले में ववशेर् ध्यान देने के

िंबंध में िप्ताह के दौरान ककए गए कायों के िंबंध में एक वखणषत प्रारूप में डीएलएिए को हर

िप्ताह एक ररपोटष जमा करनी होगी।

2 पैनल में िाशमल ककए जाने िाले पैरा लीगल स्ियंसेिकों (पीएलिी) की संख्या: 7 पुसलि

स्टेशन हैं और इि प्रकार 14 पैरा लीगल स्वयंिेवकों (पीएलवी) को पैनल में शासमल करना

उचित होगा, ताकक उन्द्हें सशफ्ट में तैनात ककया जा िके।

3 पाररश्रशमक की दर: माननीय कायषकारी अध्यक्ष के अनुमोदन के िंदभष में, पैरा-कानूनी

स्वयंिेवकों को प्रनत सशफ्ट या प्रनत ददन 500/- रुपये का मानदेय ददया जाएगा।

4 योग्यता और आयु मानदंड: पीएलवी के रूप में ियननत होने के सलए आवश्यक न्द्यूनतम

योग्यता इंटरमीडडएट (10+2) है। आयु मानदंड 25-65 वर्ष है, कानून के छात्रों के मामले को

छोडकर, लजनके सलए आयु मानदंड 18-65 वर्ष है।

5 चयन की प्रकिया: पैरा लीगल स्वयंिेवकों (पीएलवी) का ियन ववज्ञ िदस्य िचिव, लद्दाख

कानूनी िेवा प्राचधकरण द्वारा गदठत एक िसमनत द्वारा व्यलततगत िाक्षात्कार के माध्यम िे

ककया जाएगा।

6 तनयुजक्त का कायसकाल: पैरा लीगल स्वयंिेवकों (पीएलवी) को शुरू में एक वर्ष की अवचध के

सलए िूिीबद्ध ककया जाएगा लजिे उनके प्रदशषन के आधार पर ववज्ञ िदस्य िचिव की सििाररश

पर आगे बढाया जाएगा। पुसलि स्टेशनों में रोटेशनल आधार पर पैरा लीगल स्वयंिेवकों

(पीएलवी) की प्रनतननयुलतत की जाएगी।

7 पैरा लीगल स्ियंसेिकों (पीएलिी) का पैनल और प्रशिक्षण: पैरा लीगल स्वयंिेवक

(पीएलवीएि) को लद्दाख कानूनी िेवा प्राचधकरण द्वारा िूिीबद्ध ककया जाएगा, और

ननम्नसलखखत ववर्यों पर प्रसशक्षक्षत ककया जाएगा:

ए) बाल अधिकार :-

• पैरा-लीगल स्वयंिेवकों को बच्िों िे िंबंचधत ववसभन्द्न कानूनों की िमझ

प्रदान करना।

• उन्द्हें ववसभन्द्न ऐिी पररलस्थनतयों का स्पष्ट पररप्रेक्ष्य देना लजनमें बच्िे

कदठन पररलस्थनतयों में हो िकते हैं और उन्द्हें राहत की आवश्यकता है।

बी) ककिोर न्याय (बालकों की देखरेख और संरक्षण) अधितनयम, 2015

• ककशोर न्द्याय (बच्िों की देखभाल और िंरक्षण) अचधननयम, 2015

भारत में ककशोर न्द्याय के सलए प्राथसमक कानूनी ढांिा है।

• अचधननयम ककशोर अपराध की रोकथाम और उपिार के सलए एक ववशेर्

दृलष्टकोण प्रदान करता है और ककशोर न्द्याय प्रणाली के पूवाषवलोकन में

बच्िों की िुरक्षा, उपिार और पुनवाषि के सलए एक रूपरेखा प्रदान करता

है।

सी) गुमिुदा बच्चों के मामलों की मानक संचालन प्रकिया

• मानक िंिालन प्रकिया (एिओपी) में लापता और बरामद ककए गए

बच्िों के मामलों िे ननपटने में पुसलि, बाल, क्याण, िसमनत और

ककशोर न्द्याय बोडष की िहायता करने की पररक्पना की गई है।

• (एिओपी) का उद्देश्य लापता बच्िों के मामलों िे ननपटने के सलए

ददशाननदेश बनाना है जो और दहतधारकों के िाथ िमन्द्वय में काम करेंगे

और लापता बच्िों के मुद्दों पर तत्काल प्रनतकिया देंगे।

• असभयोजन िदहत त्वररत और प्रभावी कानून प्रवतषन िुननलश्ित करना।

लापता बच्िों को और अचधक पीडडत होने िे रोकने के सलए तंत्र और

प्रणासलयााँ बनाना। िुननलश्ित करना कक पीडडतों/गवाहों को उचित और

िमय पर िुरक्षा/देखभाल/ध्यान प्रदान ककया जाए।

डी) बाल श्रम (पररिीक्षा और वितनयमन) अधितनयम, 1986

ई) यौन अपराि अधितनयम, 2012 से बच्चों का संरक्षण

• यौन शोर्ण के मामले में बच्िे की िुरक्षा, िंरक्षा और िुरक्षा के अचधकार को

िुरक्षक्षत करना।

• बच्िों को यौन गनतववचधयों के सलए प्रलोभन या जबरदस्ती िे बिाना।

• वेश्यावृवि में बच्िों के शोर्णकारी उपयोग और अश्लील िामग्री के ननमाषण को

रोकना।

• हर स्तर- ररपोदटिंग, िाक्ष्य की ररकॉडडिंग, जांि और अपराधों का पता लगाने- पर

बच्िे के दहतों की रक्षा के सलए एक व्यापक कानून प्रदान करना।

• िंवेदनशील और त्वररत िुनवाई के सलए ववशेर् अदालतों की स्थापना का प्रावधान

करना।

फ़) भारत का संवििान

• पैरा-लीगल स्वयंिेवकों को िंववधान की मूल िंरिना के बारे में जानकारी देना।

• पैरा-लीगल स्वयंिेवकों को ननबषल और वंचितों के प्रनत िंववधान की िंवेदनशीलता

के बारे में जानकारी देना।

• पैरा-लीगल स्वयंिेवकों को यह बताना कक ककि प्रकार कानूनी िेवाएं िंववधान की

मूल िंरिना िे उत्पन्द्न होती हैं।

जी) कानूनी सेिा प्राधिकरण अधितनयम और पैरा-लीगल स्ियंसेिकों की भूशमका

• प्रनतभाचगयों को कानूनी िेवा प्राचधकरण, अचधननयम 1987 के तहत कानूनी िेवा

िंस्थानों की िंपूणष िंरिना और कायषप्रणाली िे पररचित कराना।

• प्रनतभाचगयों को NALSA की योजना का अवलोकन कराना।

• प्रनतभाचगयों को पैरा-लीगल स्वयंिेवकों की भूसमका, तया करें और तया न करें,

उनिे अपेक्षक्षत व्यवहार के मानकों के बारे में जानकारी देना।

एि) अपराधिक न्याय प्रणाली

• प्रनतभाचगयों को आपराचधक प्रकिया का कायषिाधक ज्ञान देना।

• प्रनतभाचगयों को आपराचधक कायषवाही में शासमल असभयुततों और पीडडतों के

अचधकारों और कतषव्यों के बारे में िूचित करना।

iv. कोर कमेटी का गठन:

लापता बच्िों के सलए योजना को कियालन्द्वत करने के उद्देश्य िे, प्रत्येक डीएलएिए

में िचिव लजला कानूनी िेवा प्राचधकरण की अध्यक्षता में एक कोर िसमनत होगी,

और इिमें एक मदहला पुसलि अचधकारी शासमल होगी जो आईपीएि रैंक िे नीिे की

न हो (आईपीएि प्रसशक्षु अचधकाररयों िदहत) जो कक पुसलि ववभाग िे नोडल

अचधकारी भी होगी, 2 पैनल अचधवतता (लजनमें िे एक मदहला होगी), लजला बाल

क्याण िसमनत के अध्यक्ष और कायषिम अचधकारी, आईिीडीएि।

इिके अलावा, पुसलि अधीक्षक लजला कानूनी िेवा प्राचधकरण और पुसलि स्टेशनों के

बीि िमन्द्वय स्थावपत करने के सलए इि योजना के उद्देश्य के सलए एक मदहला

पुसलि अचधकारी को नोडल अचधकारी ननयुतत ककया जाएगा, जो आईपीएि प्रसशक्षु

अचधकाररयों के पद िे नीिे की न हो।

शासमल होगा। ऐिी ररपोटष पर िंबंचधत थानेदार की मोहर और हस्ताक्षर होंगे।

V. वित्तीय तनटहतार्स

अभी तक, लद्दाख कानूनी िेवा प्राचधकरण ने 32 पीएलवी को प्रसशक्षण ददया है और

ननधाषररत शु्क के अनुिार, पैरा-लीगल स्वयंिेवकों को 500/- रुपये प्रनत ददन का

भुगतान ककया जा रहा है जो महीने में 10 ददन काम कर रहे हैं।

पैरा लीगल स्वयंिेवक (पीएलवी) लापता बच्िों और बच्िों के खखलाि अन्द्य अपराधों

का पता लगाने में पीडडत/आवेदकों/सशकायतकताषओं की िहायता के सलए पुसलि

स्टेशनों का दौरा करेंगे। िंबंचधत SHO द्वारा उनकी उपलस्थनत के उचित ित्यापन

के बाद पैरा लीगल स्वयंिेवक (PLV) को मानदेय का भुगतान ककया जाएगा।

प्रारंभ में पैरा-लीगल स्वयंिेवक को िभी 7 पुसलि स्टेशनों में सशफ्ट में यानी िुबह

07:00 बजे िे दोपहर 01:00 बजे तक और दोपहर 01:00 बजे िे शाम 7:00 बजे

तक प्रनतननयुतत ककया जाएगा। पीएलवी को 500/- रुपये प्रनत सशफ्ट का मानदेय

ददया जाएगा। और शुरुआत में 14 पैरा लीगल वालंदटयर को कायष पर लगाया

जाएगा।

िंबंचधत पुसलि स्टेशन, पुसलि स्टेशनों में पैरा-लीगल स्वयंिेवकों (पीएलवी) के बैठने

In compliance to order dated 19-09-2022, passed by the Hon’ble Supreme

Court of India in the writ Petition (C) No. 427, in the case titled Bachpan

Bachao Andolan V/s Union of India. The Administration of Union

territory of Ladakh hereby framed the Scheme for empanelment of Para-

Legal Volunteers in the Police Stations for missing children and other

offences against children.

SCHEME FOR EMPANELMENT OF PARA –LEGAL VOLUNTEERS

IN POLICE STATION FOR MISSING CHILDREN IN UNION

TERRITORY OF LADAKH.

Background

Right to free legal aid and assistance is an essential ingredient of reasonable,

fair and just procedure for a person accused of any offence. It is implicit in

the guarantee of Article 21. It is, therefore, essential that access to justice is

available at all stages of the criminal process. Access to justice is during the

early stages of the criminal process has its importance. It ensures, amongst

other things, protection of the rights of people when they are most

vulnerable. It strengthens the criminal justice system.

While availability of services of a trained lawyer at the stage of trail in the

criminal prosecution and inferentially, of free legal aid, for those who cannot

afford a lawyer on their own, is the norm in most jurisdictions, legal aid

during pre-trail stages has its importance. It ensures, amongst other things,

protection of the rights of people when they are most vulnerable and thereby

strengthen the criminal justice system.

Hon’ble Supreme Court in Bachpan Bachao andolan versus Union of

India & Ors vide Writ Petition (Civil) No. 75/2012 held that:

“Each police station should have at least one police Officer, especially

instructed and trained and designated as a Juvenile Welfare Officer in

terms of Section 63 of Juvenile Act. We are also inclined to accept

the suggestion that there should be, in shifts, a Special Juvenile

Officer on duty in the police station to ensure that the directions

contained in this order are duly implemented. To add a further

safeguard, we also direct the National Legal Service

Authority, which is being represented by its Member

Secretary through Ms. Anitha Shenoy, learned advocate ,

that the para-legal volunteers, who have been recruited by

the Legal Services Authority, should be utilized, so that there

is at least, one para-legal volunteer, in shifts, in the police

station to keep a watch over the manner in which the

complaints regarding missing children and other offences

against children, are dealt with.”

It is also a constitutional mandate that legal aid is a Fundamental right.

Article 39A Constitution of India gives special importance to Para Legal

Volunteers and same is reproduced below:

The state shall secure that the operation of the legal system promotes

justices, on a basis of equal opportunity, and shall, in particular,

provide free legal aid, by suitable legislation or schemes in or any

other way, to ensure that opportunities for securing justices are not

denied to any citizen by reason of economic or other disabilities.

As per the constitutional mandate and on the directions of Hon’ble Apex

Court Ladakh Legal Services Authority has framed the following Scheme for

providing Services of Para-Legal Volunteers in various Police Stations in Union

territory of Ladakh for providing assistance in cases of missing children.

Name of the Scheme: The Scheme shall be called the Union territory of

Ladakh Legal Services Authority (Para Legal Volunteers in Police Stations for

Missing Children) Scheme, 2023.

Aim and Objective of the Scheme: - The objective of the scheme is to

provide legal services to the parents/guardians of the missing children in

Police Station in lodging FIR/Missing report and in tracing the missing

children.

The aim of the scheme is to provide an inexpensive machinery for rendering

legal services of basic nature like; assistance in lodging FIR, filling form ‘M’

(Missing Persons information) on the designated portal and ensure sending of

the information to all the institution to all the institutions connected with

tracing of the missing children, prepare hue & cry notices containing

photographs and physical description of the missing children to be sent for

publication.

II.

Definitions:

a) Missing Child – A child whose where abouts are not known to the parents,

legal guardian or any other person or institution legally entrusted with the

custody of the child, whatever may be the circumstances or causes of

disappearance, and shall be considered missing and in need of care and

protection until located or his safety and wellbeing established.

b) Para Legal Volunteers – Para –Legal Volunteers (PLVs) are persons who are

drawn from different section of the society with minimum qualification of

matriculation.

III.

Procedure to be followed when the child goes missing

a) Upon receipt of a complaint regarding a missing child, an FIR should be

registered forthwith as a case of trafficking or abduction.

b) Inform a Child Welfare Police Officer and forward the FIR to the Special Juvenile

Police Unit for immediate action for tracing the child.

c) Police shall also:

Collect a recent photograph of the missing child and make copies for District

Missing Persons Unit, Missing Persons Squad, National Crime Records

Bureau/Media etc.;

xiii.

Fill form “M’’ (Missing Persons Information Form) on the designated portal

www.trackthemissingchild.gov.in. Fill the specific designated ‘’Missing Persons

Information Form’’ and immediately send to Missing Squad, District Missing

Persons Unit, National Crimes Records Bureau, State Crimes Records Bureau,

and Central Bureau of Investigation, PRCs, Railway Police and other related

Institutions.

Send copy of FIR by post/email to the office of nearest Legal Services

Authority along with addresses and contact phone numbers of parents or

legal guardian of the missing child or the child care institution, after uploading

the relevant information on to the designated portal.

xv.

Prepare sufficient number of Hue and Cry notices containing photograph and

physical description of the missing child to be sent for publication.

Give wide publicity by publishing or telecasting the photograph and the

description of missing child, as feasible in

(a) Leading Newspapers

(b) Television/Electronic Media,

(d) Social media and thereafter submit for rectification by the Board or the

Committee or the Children Court, as the case may be;

xvii.

Give wide publicity in the surrounding area through the use of loudspeaker

and the distribution and affixture of Hue and Cry notice at prominent places.

Social networking portals, short message service alerts and slide in cinema

halls can be used to reach out the masses.

xviii. Distribute Hue and Cry notice at all the outlets of the city or town that is

Railway Stations, bus stands, STANDARD OPERATING PROCEDURE FOR

CASES OF MISSSING CHILDREN at airports, regional passport offices, and

other prominent places.

xix.

Search areas and spots of interest such as movie theatres, shopping malls,

parks, game parlors and areas where missing or run away children should be

identified and watched;

xx.

Scan the recordings of the Close Circuit Television Cameras installed in the

vicinity of the area from where the child was reported missing and on all

possible routes, transit and destinations.

xxi.

Inquire from under construction sites, unused buildings, hospitals and clinics,

child line services and other local outreach workers, railway police and other

places.

xxii.

Details of missing children should be sent to the District Crime Records

Bureau of the neighbouring States and Station House Officers (SHOs) of the

bordering police stations including in charge of all police posts in their

jurisdiction and shall conduct regular interaction with concerned so that follow

up action is ensured.

d) Invoke the services of District Legal Services Authorities through empanelled

lawyers and the Para Legal Volunteers (PLVs) at the police stations.

e) Upload information on the www.trakethemissingchil.gov.in portal. In case the

information is already uploaded, match the compliant with case details uploaded

on the portal.

f) Assess the level of threat or danger to the child, or his/her family and take

immediate steps to ensure their protection.

g) Also inform immigration authorities, Border Security Force (BSF). Railways and

other transport authorities, provincial/territorial and municipal agencies, and any

NGOs involved in service delivery for spotting and recovering/rescuing the

missing children.

d) Invoke the services of District Legal Services Authorities through empanelled lawyers

and the Para Legal Volunteers (PLVs) at the police stations.

e) Upload information on the www.trakethemissingchil.gov.in portal. In case the

information is already uploaded, match the compliant with case details uploaded on

the portal.

f) Assess the level of threat or danger to the child, or his/her family and take immediate

steps to ensure their protection.

g) Also inform immigration authorities, Border Security Force (BSF). Railways and other

transport authorities, provincial/territorial and municipal agencies, and any NGOs

involved in service delivery for spotting and recovering/rescuing the missing children.

Therefore, it is extremely essential that Para Legal Volunteers (PLVs) are introduce to

the basic concepts of law that we encounter in our day to day life. The common

conflicts in the society, very often, are the result of ignorance of law. Although the

Para-Legal Volunteers (PLVs) cannot be trained to become legal practitioners but they

can be legally informed. They would be informed about basic rights of the citizens so

as to make them aware about the rights and duties of the citizens and availabilities of

legal recourse for getting relief for aggrieved persons.

1 Services of Para- legal Volunteers: Services of Para-legal volunteers (PLVs)

shall be utilized by deputing them in police stations to assist the parents,

guardians and family members of Missing Children. Initially Para-Legal volunteers

(PLVs) shall be deputed in 7 Police Stations, 7:00 AM to 6:00 PM. Para-Legal

Volunteers (PLVs) would be required to submit a report every week to DLSA

regarding the work done during the week in any matter regarding special

attention which comes to his/her notice in a described format.

2 Number of Para Legal Volunteers (PLVs) to be empanelled: There are 7

Police Stations and as such it would be appropriate to empanel 14 Para Legal

Volunteers (PLVs), so that they can be deputed in shift.

3 Rate of remuneration: In reference to the approval of the Hon’ble Executive

Chairman, Para- Legal Volunteers shall be paid an honorarium of Rs 500/- per

shift or per day.

4 Qualification and Age Criteria: Minimum qualifications required to be selected

as a PLV is Intermediate (10+2). The age criteria is 25-65 years except in case of

Law Students for which the age criteria is 18-65 years.

5 Procedure of Selection: Para Legal Volunteers (PLVs) shall be selected through

Personal Interview by a committee to be constituted by Ld. Member Secretary,

Ladakh Legal Services Authority.

6 Tenure of engagement: Para Legal Volunteers (PLVs) shall be empanelled

initially for a period of one year which shall be further extended on

recommendation of the Ld. Member Secretary, on the basis of their performance.

Para Legal Volunteers (PLVs) shall be deputed on rotational basis in the police

stations.

7 Empanelment and Training of Para Legal Volunteers (PLVs) : Para Legal

Volunteers (PLVS) shall be empanelled by Ladakh Legal Services Authority, and

shall be trained on the following topics:

a. Child Rights :-

• To provide Para-Legal Volunteers and understanding of the

different laws relating to children.

• To give them a clear perspective of the different situations in which

the children can be in difficult circumstances and need relief.

b. Juvenile Justice (Care and protection of children) Act, 2015

• Juvenile Justice (Care and Protection of Children) Act, 2015 is the

primary legal framework for juvenile justice in India.

• Act provides for a special approach towards the prevention and

treatment of juvenile delinquency and provides a framework for the

protection, treatment and rehabilitation of children in the preview of

juvenile justice system.

c. Standard Operating Procedure of Cases of Missing Children

• Standard Operating Procedure (SOP) envisages assisting Police,

Child, Welfare, Committee and Juvenile Justice Board in dealing

with the cases of missing and found or recovered children.

• Objective of the (SOP) is to put in place guidelines which dealing

with cases of missing children and to work in co-ordination with

stakeholder and respond with urgency to issues of missing children.

• Ensure expeditious and effective law enforcement including

prosecution. Create mechanism and systems to prevent further

victimization of missing children. Ensure that appropriate and timely

protection/care/attention is provided to Victims/witnesses.

d. Child Labour (Probation and Regulation) Act, 1986

• An Act to prohibit the engagement of children in certain

employments and to regulate the conditions of work of children in

certain employments.

e. Protection of children form Sexual Offences Act, 2012

• To secure a child’s right to safety, security and protection form

sexual abuse.

• To protect children from inducement or coercion to sexual activity.

• To prevent exploitative use of children in prostitution and

generation of pornographic material.

• To provide a comprehensive legislation to safe guard the interest of

the child at every stage – reporting, recording of evidence,

investigation and trail of offences.

• To provide for establishment of special courts for sensitive and

speedy trial.

f. Constitution of India

• To inform the Para-Legal Volunteers about the basic structure of

the constitution.

• To inform the Para-Legal Volunteers about the sensitivity of the

Constitution toward the week and the underprivileged.

• To inform the Para-Legal Volunteers how legal services emanate

from the basic structure of the constitution.

g. Legal Services Authority Act & Role of Para-Legal Volunteers

•

To introduce the participants to the entire structure and working of

the legal services institutions under the Legal Services Authorities,

Act 1987.

•

To give the participants an overview of the scheme of NALSA.

•

To give the participants an inside into the role of Para-Legal

Volunteers, do’s and don’ts, Standards of the behaviour expected

from them.

h. Criminal Justice System

• To give the participants a working knowledge of criminal procedure.

• To inform the participants about the rights and duties of accused

and victims involved in the criminal proceedings.

IV.

Constitution of Core Committee:

For the purpose of carrying out the scheme for missing children, each DLSA

shall have a core Committee headed by Secretary District Legal Services

Authority, and consisting of a female police officer not below the rank of IPS

(including IPS trainee officers) who shall also be the Nodal Officer from Police

Department, 2 Panel Advocates (one of whom shall be female), Chairman of

District Child Welfare Committee and Programme Officer, ICDS,

Further, the Superintendent of Police shall appoint a female Police Officer

(not below the rank of IPS trainee officers) to be the Nodal Officer for the

purpose of this Scheme to coordinate between the District Legal Services

Authority and Police Stations.

The Para Legal Volunteers (PLVs) visiting the police station would submit

their report on monthly basis to District Legal Services Authorities mentioning

therein the complete details of cases they attend in police stations including

FIR/DDR No., name of child/parents/guardian, kind/nature of assistance

provide to them. Such report shall stamp and signed by the SHO concerned.

Financial Implication

As of today, Ladakh Legal Services Authority has imparted training to 32 PLVs

and as per the fee scheduled, Para-Legal Volunteers are being paid Rs. 500/-

per day and are working for 10 days in a month.

The Para Legal Volunteers (PLVs) shall visit the Police stations to assist the

victim/applicants/complainants in tracing the missing children and other

offences against the children. The honorarium will be paid to the Para Legal

Volunteers (PLVs) after due verification of his/her attendance by the

concerned SHO.

Initially Para-Legal Volunteers will be deputed in all the 7 police Stations, in

shift i.e from 07:00 am to 01:00 pm and from 01:00 pm to 7:00pm.PLVs shall

be paid an honorarium of Rs. 500/- per shift and initially 14 Para Legal

Volunteer has to be engaged.

Concerned Police Stations would be providing paraphernalia for proper sitting

and working of Parva Legal Volunteers (PLVs) in the police stations. Offences

stationery to the Para Legal Volunteers (PLVs) would be provided by Ladakh

Legal Services Authority from its own funds.

Funds for the scheme would be demanded from the state government after

notification of the Scheme.
