का.आ.52 के माध्यम से 5व ं लद्दाख स्वायत्त पहाड ववकास पररषद, कारधिल के िठन के ललए

सदस्यों का चुनाव करने के ललए ननवााचन क्षेत्रों से आह्वान ककया है;

और जबकक, संघ राज्य प्रशासन लद्दाख ने ददनांक 05/08/2023 को प्रकालशत ददनांक

02.08.2023 के अधिसूचना का.आ.53 के माध्यम से 5व ं लद्दाख स्वायत्त पहाड ववकास

पररषद, कारधिल के िठन की नतधि ननयुक्त की है;

जबकक, 6 लसतंबर, 2023 के मानन य सवोच्च न्यायालय की लसववल अप ल संख्या

5707 of 2023 (SLP No. 18727 of 2023) के फैसले के तहत, ननवााचन ववभाि, संघ राज्य

प्रशासन लद्दाख के ददनांक 05/08/2023 के No. Secy/Election/2023290-301 के तहत

प्रकालशत का.आ. 53 के अनुसरण में ददनांक 02.08.2023 के अधिसूचना के तहत शुरू की

िई संपूणा चुनाव प्रकिया, को रद्द कर ददया िया है;

इसके अलावा, मानन य उच्चतम न्यायालय ने ननदेश ददया है कक 5व ं लद्दाख स्वायत्त

पहाड ववकास पररषद, कारधिल के िठन के ललए चुनाव की नई अधिसूचना ददनांक

06/09/2023 के फैसले की तारीख से सात ददनों के भ तर जारी की जाएि ;

अब, इसललए, मानन य सवोच्च न्यायालय के ददनांक 06/09/2023 के फैसले के

अनुपालन में और लद्दाख स्वायत्त पहाड ववकास पररषद (चुनाव) ननयम, 1995 के ननयम 12

के अनुसार, संघ राज्य प्रशासन लद्दाख एतदद्वारा 5व ं लद्दाख पहाड ववकास पररषद, कारधिल

के िठन के ललए ननम्नललखखत नतधियां/समय ननयुक्त करता है।:

आदिश आचार संहिता संघ राज्य लद्दाख के ई- गज़ट में इस अधिसूचना के प्रकािन की

तारीख से लागू िोगी और चुनाव प्रक्रिया पूरी िोने तक लागू रिेगी। आचार संहिता पूरे कारधगल

जज़ले के शलए लागू िोगी।

Ladakh, the 7^th of September, 2023

S.O.65.- Whereas, the Administration of the Union territory of Ladakh vide

Notification S.O. 52 dated 02-08-2023 has called upon the constituencies to elect the

members for constituting the 5^th Ladakh Autonomous Hill Development Council, Kargil;

And whereas, the Administration of the Union territory of Ladakh vide

Notification S.O. 53 dated 02.08.2023 published on 05/08/2023 has appointed the date

for constituting the 5^th Ladakh Hill Development Council, Kargil;

Whereas, vide the Judgement dated 6^th September, 2023 in Civil Appeal No.

5707 of 2023 (SLP No. 18727 of 2023) of the Hon’ble Supreme Court, the entire

election process, initiated pursuant to Notification dated 02.08.2023 issued by the

Administration of Union Territory of Ladakh, Election Department, UT of Ladakh under

S.O. 53 published vide No. Secy/Election/2023290-301 dated 05/08/2023 has been set

aside;

Further, the Hon’ble Supreme Court has directed that a fresh Notification calling

for election to constitute the 5^th Ladakh Autonomous Hill Development Council, Kargil

shall be issued within seven days from the date of its Judgement dated 06/09/2023;

Now, therefore, in compliance to the Judgement dated 06/09/2023 of the

Hon’ble Supreme Court and as per Rule 12 of the Ladakh Autonomous Hill Development

Councils (Election) Rules, 1995 the Administration of Union territory of Ladakh hereby

appoint the following dates/time for constituting the 5^th Ladakh Hill Development

Council, Kargil:

The Model Code of Conduct shall come into force from the date of publication of

this Notification in the official e-gazette of UT Ladakh and shall remain in force till such

time the election process is completed. The code of conduct shall be applicable for the

entire Kargil District.
