क्रमाांक:- 03 - 1987 (1987 का केंरीय अधिननयम िंख्या 39) में ननहित िक्षम प्राविानों के

िाथ पहित िंघ राज्य लद्दाख के कानूनी िेवा प्राधिकरण ववननयमन, 2021 के ववननयम 26

एवं हदनांक 09 अप्रैल, 2020 के क.आ. 13 के माध्यम िे अधििूधित िंघ राज्य लद्दाख के

कानूनी िेवा प्राधिकरण ननयम, 2020 द्वारा प्रदत्त शक्ततयों का प्रयोग करते िुए, माननीय मुख्य

न्द्यायािीश, उच्ि न्द्यायालयजम्मू-कश्मीर और लद्दाख [िंघ राज्य लद्दाख के कानूनी िेवा

प्राधिकरण के िंरक्षक-प्रमुख.] ननम्नसलखखत ननयमबनातेिैंयथा :-

(1) इन ननयमों को िंघ राज्य लद्दाख कानूनी िेवा प्राधिकरण/िसमनतयां (अधिकारी और

कममिारी) भती ननयम, 2023 किा जाएगा ।

(2)यि ननयम लागू िोने के तत्काल िमय िे प्रभाव में आएंगे।

2. पररभार्ाएँ

इन ननयमों में, जब तक कक अन्द्यथा िंदसभमतन िो-

क) "बोर्ष" का अथम िै िेवा के िंवगम में िीिी भती या पदोन्द्ननत के माध्यम िे ररतत पदों को

भरने के सलए ियन प्रकिया को पूरा करने के उद्देश्य िे गहित ियन बोर्म या ववभागीय

पदोन्द्ननत िसमनत;

ख) कैर्र" का अथम िै िेवा का कैर्र;

ग) "मुख्य न्यायािीि" का अथम िै जम्मू-कश्मीर और लद्दाख उच्ि न्द्यायालय के मुख्य

न्द्यायािीश;

घ) सिम प्राधिकारी" का अथम िै िंघ राज्य लद्दाख कानूनी िेवा प्राधिकरण के कायमकारी

अध्यक्ष;

ङ) प्रततयोगी परीिा" का अथम इन ननयमों द्वारा ननिामररत एक सलखखत परीक्षा या परीक्षण िै

क्जिमें ऐिे पाठ्यिम और ियन का तरीका शासमल िै जो िक्षम प्राधिकारी द्वारा या उिके

आदेशों के तित िमय-िमय पर प्रनतस्पिी उम्मीदवारों की शॉर्म-सलक्स्र्ंग के सलए आयोक्जतककया

जाएगा । ककए गए उम्मीदवारों की िॉर्ष-शलस्र्उनके मौखखक/शलखखत परीिा में प्राप्त योग्यता के

आिार पर होगा l

च) "सरकार" का अथम िै िंघ राज्यप्रशािन लद्दाख;

छ) "उच्च न्यायालय" का अथम उच्ि न्द्यायालय जम्मू-कश्मीर और लद्दाख िै;

ज) "सांघ राज्य लद्दाख का तनवासी" का अथम िै कक कोई व्यक्तत जो ककिी भी कानून, ननयम

या ववधिक बबंदु में लद्दाख िंघ क्षेत्र में राज्य प्रशािन के तित रोजगार के सलए उपयुततता के

रूप में ननिामररत ननवाि मानदंर्ों को पूरा करता िै।

i) "सेवा" का अथम िै िंघ राज्य लद्दाख कानूनी िेवा प्राधिकरण/िसमनत िेवा;

3. सेवा का गठन

(1) इन ननयमों के प्रारंभ िोने की तारीख िे,िंघ राज्य लद्दाख कानूनी िेवा प्राधिकरण/िसमनत

िेवा का गिन ककया जाएगा;

बशते कक िेवा के प्रारंसभक गिन के सलए, कानूनी िेवा प्राधिकरणों/िसमनतयों में वास्तववक

आिार पर स्वीकृत पद पर ननयुतत और पद िारण करने वाले ककिी भी व्यक्तत को इन ननयमों

के तित िेवा में ननयुतत माना जाएगा;

4. सेवाओां की सांख्या और सांरचना

(1)िेवा के िंवगम की अधिकृत स्थायी और अस्थायी िंख्या और इिमें शासमल पदों के स्वरूप

को िमय-िमय पर िरकार की स्वीकृनत के िाथ मुख्य न्द्यायािीश / िंरक्षक-प्रमुख द्वारा

कायमकारी अध्यक्ष के परामशम िे ननिामररत ककया जाएगा, और इन ननयमों के तित िेवा का

आरंसभक गिन इन ननयमों िे जुडी अनुसूची में हदए गए ननदेश अनुिार िोगा।

बशते कक मुख्य न्द्यायािीश िरकार की पूवम मंजूरी िे िेवा के कैर्र में ननहदमष्र् अवधि या

उद्देश्यों के सलए अस्थायी पद िृक्जत कर िकते िैं, जैिा कक िंरक्षक-प्रमुख और/ कायमकारी

अध्यक्ष द्वारा िमय-िमय पर आवश्यक िमझ जाता िै।

(2) मुख्य न्द्यायािीश िर तीन िालोंमें या ऐिे अन्द्य अंतराल में, िेवा के कैर्र की ताकत और

िंरिना की किर िे जांि कर िकते िैं जैिा कक आवश्यक िो,और उिमें ऐिे बदलाव कर िकते

िैं जो कायमकारी अध्यक्ष के सिफ़ाररश और िरकार की पूवम अनुमनत िे उधित िमझें।

5. सेवा में भती की योग्यता एवां ववधि

(1) कोई भी व्यक्तत िेवा में शासमल ककिी भी वगम, श्रेणी या ग्रेर् में ककिी भी पद पर ननयुक्तत

या पदोन्द्ननत के सलए तब तक योग्य निीं िोगा जब तक कक उिके पाि इन ननयमों की

अनुिूिी II में ननिामररत योग्यता और अनुभव न िो, और िामान्द्य तौर पर िरकारी कममिाररयों

के सलए उि िमय लागू ननयमों और आदेशों में प्रदान की गई भती की अन्द्य आवश्यकताओं को

पूरा न करतािो।

(2)िेवा में ननयुक्तत ननम्नानुिार की जाएगी:

क) िीिी भती द्वारा, क्जिमें उच्ि न्द्यायालय या अिीनस्थ न्द्यायालयों या िरकार िे व्यक्ततयों

के स्थानांतरण और प्रनतननयुक्तत द्वारा ननयुक्तत शासमल िोगी।

बी) पदोन्द्ननत द्वारा; और

ग) कुछ िीिी भती द्वारा और कुछ पदोन्द्ननत द्वारा।

बशते कक उच्ि न्द्यायालय और/या अिीनस्थ न्द्यायालयों की स्थापना पर स्थानांतरण या

प्रनतननयुक्तत द्वारा ननयुतत ऐिे ककिी भी व्यक्तत को कानूनी िेवा प्राधिकरणों/िसमनतयों की

िेवा में स्थायी रूप िे शासमल ककया जा िकता िै, अगर उिके पाि पद के सलए आवश्यक

योग्यता िै तो।

बशते कक स्थानांतरण और प्रनतननयुक्तत के अलावा िीिी भती प्रनतयोगी परीक्षा के आिार पर

की जाएगी।

बशते कक उम्मीदवारों का ियन िमय-िमय पर कायमकारी अध्यक्ष द्वारा गहित और/या

नामांककत िदस्य िधिव िहित दो या अधिक अधिकाररयों वाले बोर्म द्वारा ककया जाए।

6. पररवीिा

(1) िीिी भती द्वारा िेवा में ननयुतत व्यक्तत दो िाल के सलए पररवीक्षा पर िोंगे और उनकी

पुक्ष्र् िंघ राज्य लद्दाख के िरकारी कममिाररयों पर लागू सिववल िेवा (वगीकरण, ननयंत्रण और

अपील) ननयमों के प्राविानों के तित की जाएगी।

(2) इन ननयमों के तित िेवा में ननयुतत व्यक्तत का वेतन िरकार द्वारा िमय-िमय पर जारी

सिववल िेवा ववननयमों या िामान्द्य ननयमों के प्राविानों के अनुिार हदया जाएगा।

7. तनयुक्ततयों में आरिण

स्थानांतरण या प्रनतननयुक्तत के अलावा िीिी भती द्वारा ननयुक्ततयााँ करते िमय आरक्षण

िमय-िमय पर जारी ककए गए ननयमों के अनुिार ककया जाएगा।

8. प्रशििण एवां ववभागीय परीिा

िीिी भती द्वारा िेवा में ननयुतत व्यक्ततयों को पररवीक्षा के दौरान ऐिे प्रसशक्षण िे गुजरना

िोगा और पररवीक्षा अवधि के दौरान ऐिी ववभागीय परीक्षा उत्तीणम करनी िोगी जो िमय-िमय

पर ननिामररत की जा िकती िै।

9. सीिी भती हेतु सरकारी सेवकों की योग्यता

िरकारी िेवा में पिले िे िी कायमरत व्यक्तत िेवा में ककिी ववशेष वगम या श्रेणी में ररतत पद पर

िीिी भती के सलए उधित माध्यम िे आवेदन कर िकता िै, यहद उिके पाि ऐिे वगम या श्रेणी

के पद पर भती के सलए ननिामररत योग्यताएं िैं तो। ऐिे िरकारी िेवकों की ऊपरी आयु िीमा

वि िोगी जो िमय-िमय पर िंघ राज्य लद्दाख के प्रशािन द्वारा जारी ककए गए िामान्द्य

आदेशों में प्रदान की गई िै:

बशते कक ऐिे पद के मामले में क्जिके सलए उच्ि डर्ग्री या योग्यता, ववशेषज्ञता और/या

अनुभव की आवश्यकता िो तोविााँकायमकारी अध्यक्ष आयु िीमा को बढ़ा िकतेिैं।

10 वररष्ठता सूची का रखरखाव

िेवा के िदस्यों की वररष्िता को िंघ राज्य लद्दाख के कममिाररयों पर लागू सिववल िेवा

(वगीकरण, ननयंत्रण और अपील) ननयमों के तित ववननयसमत ककया जाएगा।

11. तनयुक्तत के शलए अयोग्यता

कोई भी व्यक्तत िेवा में ननयुक्तत के सलए तब तक योग्य निीं िोगा जब तक कक वि व्यक्तत

िंघ राज्य लद्दाख का ननवािी न िो।

बशते कक यि ननयम जम्मू और कश्मीर पुनगमिन अधिननयम, 2019 की िारा 89 (2) के

प्राविानों या प्रशािन द्वारा ननिामररत ऐिे ननयमों के तित िंघ राज्य लद्दाख में आवंहर्त िेवा

वाले व्यक्ततयों पर लागू निीं िोगा।

12. छूर्का अधिकार

"इन ननयमों में ननहित ककिी भी बात के बावजूद, जब कायमकारी अध्यक्ष को यि िंतोष िोता िै

कक ककिी ननयम के प्राविान के प्रयोग िे ककिी ववशेष मामले में अनापेक्षक्षक कहिनाई िोती िै

या िो िकती िै, तो वि आदेश द्वारा उि ननयम की आवश्यकताओं को या तो खाररज कर

िकते िैं या किर उिे उि िीमा तक और उन शतों के िाथ िल्का कर िकते िैं, जैिा कक

मामले को न्द्यायिंगत तरीके िे ननपर्ने के सलए वे आवश्यक मानते िैं; बशते कक मामले को

ननयमों के अनुिार और िंबंधित के अनुकूल ननपर्ाया जाएl

13. अवशिष्र् मामले

इन ननयमों द्वारा ववशेष रूप िे उल्लेखखत निीं ककए गए मामलों के िंबंि में, िेवा के िदस्य

िामान्द्य रूप िे िंघ राज्य लद्दाख में सिववल िेवाओं पर लागू ननयमों/ववननयमों और आदेशों

द्वारा शासित िोंगे।

"बशते कक जिां उपयुमतत ननयमों में उक्ल्लखखत मामलों िे िंबंधित ककिी भी शक्तत का प्रयोग

ककिी भी ननयम के तित िरकार द्वारा िंभाववत िो, तो इन ननयमों के अनुिार, उिी शक्तत

का प्रयोग मुख्य न्द्यायािीश/ िंरक्षक-प्रमुख द्वारा ककया जाएगा, और उि शक्तत को तबतक

ववत्त ववभाग की मंजूरी की आवश्यकता न िोिरकार द्वारा मुख्य न्द्यायािीश के पाि माना

जाएगा।"

14. खांर्न और बचत

(1) इन ननयमों के अनुरूप और इन ननयमों के प्रारंभ िोने िे तुरंत पिले लागू िोने वाले िभी

ननयम ननरस्त ककए जाते िैं।

(2) ऐिे ननरिन के बावजूद, इि प्रकार ननयमों के प्राविानों के तित की गई कोई भी ननयुक्तत,

आदेश या की गई कारमवाई इि ननयम के िंबंधित प्राविानों के तित की गई मानी जाएगी।

15. व्याख्या

(1) यहद इिमें शासमल ककिी भी ननयम के आवेदन या व्याख्या के िंबंि में कोई िंदेि

उत्पन्द्न िोता िैतो, उिे कायमकारी अध्यक्ष और/ या मुख्य न्द्यायािीश/ िंरक्षक-प्रमुख,को

जैिा भी मामला िो भेजा जाएगा, और उनका ननणमय अंनतम एवं अननवायम िोगा।

16. प्रतततनधि-मांर्ल

मुख्य न्द्यायािीश/ िंरक्षक-प्रमुख, एक ववशेष या िामान्द्य आदेश द्वारा, इन ननयमों के

तित प्रदत्त या प्राप्त िभी या कोई भी शक्तत और कायों को कायमकारी अध्यक्ष को िौंप

िकते िैं।

NOTIFICATION

Ladakh, the 17^thday of August, 2021

No:- 03 -In exercise of the powers conferred by Regulation 26 of the Union

Territory of Ladakh Legal Services Authority Regulation, 2021 read with the

enabling provisions contained in the Legal Services Authorities Act, 1987 (Central

Act No. 39 of 1987) and the U.T of Ladakh Legal Services Authority Rules, 2020,

formed by the Administration of U.T of Ladakh vide Notification, S.O 13 dated 9^th of

April, 2020, Hon’ble the Chief Justice of High Court of J&K and Ladakh [Patron-in-

Chief, U.T of Ladakh Legal Services Authority]makes the following Rules.-

1. Short title and Commencement:

(1) These rules may be called the Union Territory of Ladakh Legal Services

Authorities/Committees (Officers and Employees) Recruitment Rules, 2023.

(2) They shall come into force with immediate effect.

2. Definitions

In these rules, unless the context otherwise requires; -

a) “Board” means the Selection Board or the Departmental Promotion Committee

constituted for the purposes of carrying out selection process for filling up of the

vacant posts in the cadre of the Service, either by way of direct recruitment or by

promotion;

b) “Cadre” means the cadre of the Service;

c) “Chief Justice” means the Chief Justice of the High Court of Jammu & Kashmir

and Ladakh;

d) “Competent Authority” means the Executive Chairman of the Union territory

of Ladakh Legal Services Authority;

e) “Competitive Examination” means a written examination or test prescribed

by these rules with such syllabus and mode of selection as may be laid down by

or under the orders of the Competent Authority, from time to time, conducted

for short-listing of the competing candidates on the basis of merit obtained in

such written examination/test followed by viva voce of the shortlisted

candidates;

f) “Government” means the Administration of Union territory of Ladakh;

g) “High Court” means the High Court Jammu & Kashmir and Ladakh;

h) "Resident of Union territory of Ladakh" means any person who satisfies the

criteria of residence as may be prescribed for the purpose of employment under

the Administration of Union territory of Ladakh under any Act, Rule or Regulation

having force of law in Union territory of Ladakh,

3. Constitution of Service

(1) From the date of commencement of these rules, there shall be constituted the

Union territory of Ladakh Legal Services Authorities/Committees Service;

Provided that for the purpose of initial constitution of the Service, any

person appointed to and holding a sanctioned post in the Legal Services

Authorities/Committees on substantive basis shall be deemed to have been

appointed to the Service under these rules;

4. Strength and Composition of the Services

(1) The authorized permanent and temporary strength of the cadre of the Service

and the nature of the posts included therein shall be determined by the Chief

Justice / Patron-in-Chief in consultation with the Executive Chairman and as

sanctioned by the Government, from time to time, and shall at the initial

constitution of the Service under these rules be such as specified in Schedule

I annexed to these rules;

Provided that Chief Justice with the prior sanction of the Government may

create temporary posts in the cadre of the Service for specified period or

purposes as may be considered necessary by the Patron-in-Chief and/or the

Executive Chairman from time to time.

(2) The Chief Justice may at the interval of every three years or at such other

intervals as may be necessary re-examine the strength and composition of the

cadre of the service and make such alterations therein as he may deem fit on

the recommendations of the Executive Chairman and with the prior sanction of

the Government;

5. Qualification and method of recruitment to the service

(1) No person shall be eligible for appointment or promotion to any post in any

class, category or grade borne on the Service unless he possesses the

qualification and experience as laid down in Schedule II to these rules, and

fulfils other requirements of recruitment as provided in the rules and orders for

the time being in force to the Government servants in general.

(2) Appointment to the Service shall be made: -

a) by direct recruitment, which shall include appointment by transfer and

deputation of persons from amongst the members of the staff borne on the

establishment of the High Court and/or of the Subordinate Courts or from the

Government.

b) by promotion; and

c) Partly by-direct recruitment and partly by promotion.

Provided that any such person borne on the establishment of the High

Court and/or of the Subordinate Courts, appointed by transfer or deputation,

may be permanently absorbed in the Service of the Legal Services Authorities

/ Committees, subject to his/her possessing the qualification requisite for the

post.

Provided further that direct recruitment other than by transfer and

deputation shall be made on the basis of Competitive Examination.

Provided further that the selection of candidates shall be made by the

Board comprising two or more officers, including the Member Secretary,

constituted and/or nominated by the Executive Chairman from time to time.

6. Probation

(1) Persons appointed to the service by direct recruitment shall be on

probation for two years and their confirmation shall be made under the

provisions of Civil Services (Classification, Control and Appeal) Rules,

applicable to the Government Employees of Union territory of Ladakh.

(2) The pay of a person appointed to the service under these rules shall be

regulated as per the provisions of Civil Service Regulations or general

rules as issued from time to time by the Government.

7. Reservation in appointments

While making appointments by direct recruitment, other than by transfer

or deputation, reservation shall be made in accordance with the rules governing

the subject and issued from time to time.

8. Training and Departmental Examination

Persons appointed to the service by direct recruitment shall be required to

undergo such training during the course of probation and to pass such

departmental examination during the period of probation as may be prescribed

from time to time.

9. Eligibility of Government servants for direct recruitment

A person already in Government service may apply through proper channel for

direct recruitment to a vacant post in any particular class or category in the

Service, if he possesses the educational and other qualifications prescribed for

recruitment to such class or category of post. The upper age limit of such

Government servants shall be such as provided in the general orders issued by

the administration of Union territory of Ladakh from time to time:

Provided that in the case of a post that requires a higher degree or

qualification, specialization and/or experience,theExecutive Chairman may higher

age limit.

10. Maintenance of seniority lists

Seniority of the members of the service shall be regulated under the Civil

Service (Classification, Control and Appeal) Rules, applicable to employees of

Union territory of Ladakh.

11. Disqualification for appointment

No person shall be qualified for appointment to the Service unless the person is

a Resident of Union territory of Ladakh.

Provided that this rule shall not apply to persons allotted service in Union

territory of Ladakh under the provisions of section 89 (2) of Jammu and

Kashmir Reorganization Act, 2019, or such Rules as may be prescribed by the

Administration.

12. Powers to relax

Notwithstanding anything contained in these rules, where the Executive

Chairman is satisfied that operation of any rule causes or is likely to cause

undue hardship in any particular case, he may, by order, dispense with or relax

the requirements of that rule to such extent and subject to such conditions as

he may consider necessary for dealing with the case in a just and equitable

manner; provided that the case is not dealt with in a manner less favourable to

the concerned than in accordance with the rules.

13. Residuary matters

In regard to matters not specifically covered by these rules, the members of the

service shall be governed by the rules / regulations and orders applicable to the

Civil Services in the Union territory of Ladakh in general.

Provided that where any of the powers relating to the matters mentioned

in the above Rules is exercisable by the Government under any rules, the same

shall, under these rules, be exercised by the Chief Justice / Patron-in-Chief, and

the power vested in the Government in that behalf shall be deemed to vest in

the Chief Justice except to the extent where sanction of the Finance Department

may be required.

14. Repeal and Savings

(1) All rules corresponding to these rules and enforce immediately before the

commencement of these rules are repealed.

(2) Notwithstanding such repeal, any appointment, order made or action taken

under the provisions of the rules so repealed shall be deemed to have been

made or taken under the corresponding provisions of this rules.

15. Interpretation

(1) If there arises any doubt regarding application or interpretation of any of

the rules herein contained, the same shall be referred to the Executive

Chairman and or the Chief Justice / Patron-in-Chief, as the case may be,

whose decision thereon shall be final and binding.

16. Delegation

The Chief Justice/Parton-in-Chief may, by a special or general order, delegate all

or any of the powers and functions as conferred or enjoyed under these rules, to the

Executive Chairman.
